Tobacco purchasing plan

Legal analysis: tobacco leaf purchase refers to the tobacco leaf purchase unit purchasing tobacco leaves from tobacco farmers according to the tobacco leaf purchase price stipulated by the state and the national tobacco leaf standard. Flue-cured tobacco and famous air-cured (sun-cured) tobacco are raw materials of cigarette industry and are exclusive products. According to the provisions of the tobacco monopoly law, tobacco companies shall purchase them in a unified way, and no other department or individual may purchase them.

Legal basis: Article 9 of People's Republic of China (PRC) Tobacco Monopoly Law. The tobacco purchasing plan shall be issued by the planning department of the local people's government at or above the county level according to the plan issued by the planning department of the State Council, and no other unit or individual may change it. Tobacco companies or their entrusted units shall sign tobacco purchase contracts with tobacco growers. The tobacco purchase contract shall stipulate the tobacco planting area. The purchase price of tobacco leaves shall be formulated by the competent price department of the State Council in conjunction with the competent tobacco monopoly administration department of the State Council in accordance with the principle of graded pricing.

Article 10 Tobacco leaves shall be purchased by tobacco companies or their entrusted units in accordance with the prescribed purchase standards and prices, and no other unit or individual may purchase them. Tobacco companies and their entrusted units shall, in accordance with the standards stipulated by the state, purchase all tobacco leaves produced by tobacco farmers according to the planting area agreed in the tobacco purchase contract, and shall not lower the price, and properly handle disputes arising from the purchase of tobacco leaves.
