One. illegal entry

Foreigners who don't have valid entry documents and visas, or who don't enter from open ports, or who enter the country privately without inspection at China's border checkpoints are illegal immigrants.

For foreigners who enter the country illegally, the public security organs will detain them for examination or monitor their residence according to relevant rules. After examination, the exit-entry administration department of the public security organ may, according to this Law, impose a fine of 654.38+10,000 yuan to 654.38+10,000 yuan on foreigners, or detain them for more than 3 days and less than 654.38+10,000 days. They can also leave the country or be deported within a certain period of time. If the circumstances are serious enough to constitute a crime, the responsibility will be investigated according to law.

The second is illegal residence.

Foreigners who do not hold valid identity documents, residence permits or visas during their stay in China are illegal residents.

For foreigners staying illegally, according to the relevant rules, the exit-entry administration department of public security can give them a warning or a fine of 500 yuan for every day of illegal residence, with a total amount not exceeding 5,000 yuan, or detention for more than 3 days 10 days; If the circumstances are serious, it shall be ordered to leave the country within a time limit.

Third, illegal employment.

Without the approval of the competent department of China, the private employment of foreigners in China is illegal. Foreigners who come to China for employment need to apply for a foreigner's employment permit by the employing unit. Foreigners who hold the Certificate of Foreign Experts issued by the China Bureau of Foreign Experts Affairs and the temporary performance permit for commercial cultural performances approved by the Ministry of Culture are not required to apply for a foreigner's employment permit.
