Chapter I General Provisions Article 1 In order to severely punish criminal activities such as smuggling, trafficking, transporting, manufacturing drugs and illegally planting narcotic plants, prohibit taking and injecting drugs, protect citizens' physical and mental health and maintain social order, these Regulations are formulated in accordance with the Decision of the NPC Standing Committee on Narcotics Control and relevant laws and regulations, and in light of the actual situation in Sichuan. Article 2 Drugs mentioned in these Regulations refer to opium, heroin, morphine, marijuana, cocaine, methamphetamine, dihydroetorphine hydrochloride, demerol and other narcotic drugs and psychotropic drugs that can make people addicted. Article 3. Severely punish criminal activities such as smuggling, trafficking, transporting, manufacturing drugs and illegally planting drug plants. Smoking and injecting drugs are strictly prohibited. The policy of comprehensive management and the principle of combining specialized agencies with the mass line and combining punishment with education should be implemented. Poisons must be punished, investigated and forbidden. Article 4 People's governments at all levels shall organize and coordinate drug control work; The public security organ is the competent department for drug control. Article 5 Public security organs, procuratorial organs, judicial organs and judicial administrative organs must strictly perform their respective statutory duties in drug control. Health, medicine, civil affairs, industry and commerce, chemical industry, light industry, commerce, customs, civil aviation, railways, transportation, education and other relevant departments and township (town) people's governments and sub-district offices shall perform their respective duties, conscientiously implement prevention, management, education and other measures, and actively participate in drug control work. All state organs, social organizations, enterprises and institutions, villagers' committees and residents' committees have the responsibility of drug control in their respective jurisdictions, systems and units, and should carry out drug control publicity and education and cooperate with drug control work. Chapter II Punishment Article 6 In any of the following circumstances, criminal responsibility shall be investigated in accordance with the decision of the NPC Standing Committee on Drug Control:

(1) Smuggling, selling, transporting or manufacturing drugs;

(2) Illegally holding more than 200 grams of opium, more than 10 grams of heroin or a large quantity of other drugs;

(3) shielding criminals who smuggle, sell, transport or manufacture drugs, hiding, transferring or concealing drugs or property obtained from crimes for criminals, or concealing or disguising the illegal nature and source of property obtained from drug sales;

(4) illegally transporting or carrying acetic anhydride, ether, chloroform or other articles often used in the manufacture of narcotic drugs and psychotropic substances into or out of the country, or providing these articles to others knowing that others are manufacturing drugs;

(5) Illegally planting more than 500 opium poppy plants or a large number of other original drug plants, or illegally planting opium poppy, marijuana and other original drug plants, and planting or resisting eradication after being dealt with by the public security organs;

(6) forcing, luring, abetting or deceiving others to take or inject drugs;

(seven) allowing others to take drugs, inject drugs and sell drugs;

(8) Persons who produce, transport, trade and use narcotic drugs and psychotropic substances under state control according to law, in violation of state regulations, provide narcotic drugs and psychotropic substances under state control to criminals who smuggle and sell drugs or people who take or inject drugs. Article 7 It is strictly forbidden to mix poppy shells and poppy seeds into foods, beverages and other foods for sale. If poppy shells and poppy seeds are adulterated in food, beverages and other foods sold, which constitutes a crime, criminal responsibility shall be investigated according to law.

If it does not constitute a crime, the public security organ shall confiscate the illegal income and impose a fine of not less than 5,000 yuan but not more than 100,000 yuan; The person in charge directly responsible for the unit and other directly responsible personnel shall be fined between 3,000 yuan and 5,000 yuan; And may be ordered to suspend business for rectification for one to three months; If it is still not corrected after rectification, the person in charge directly responsible for the owner and the unit and other directly responsible personnel may implement reeducation through labor, and the business license shall be revoked by the administrative department for industry and commerce. Article 8 In any of the following circumstances, which are not enough to be investigated for criminal responsibility, reeducation through labor shall be implemented, and the public security organ shall impose a fine of not less than 1,000 yuan but not more than 10,000 yuan:

(a) shelter, introduce others to take or inject drugs;

(2) Deliberately providing other people with devices for taking or injecting drugs;

(3) illegally buying, selling or transporting poppy seeds, poppy seedlings and seeds and seedlings of other narcotic plants;

(4) forcing or inducing others to sell or inject narcotic drugs and psychotropic substances under state control, or issuing prescriptions or certificates that do not meet the relevant provisions to defraud narcotic drugs and psychotropic substances under state control. Article 9. After receiving criminal punishment, reeducation through labor or administrative punishment for drug crimes, those who engage in illegal drug activities are not serious enough to be investigated for criminal responsibility shall be given reeducation through labor and given a heavier punishment, and the public security organ shall impose a fine of not less than 3,000 yuan but not more than 10,000 yuan. Article 10 Anyone who takes or injects drugs shall be detained by the public security organ for not more than 15 days and may be fined not more than 2,000 yuan; Those who take or inject drugs after compulsory detoxification shall be given reeducation through labor. Article 11 No unit or individual may illegally grow opium poppy or other narcotic plants anywhere for any reason.

If the number of original plants illegally planted with opium poppy or other drugs is less than 500, the public security organ shall detain them for less than 15 days and may also impose a fine of less than 3,000 yuan; The original plants of drugs illegally planted shall be forcibly eradicated by the township (town) people's government and the public security organs, and the villagers' committee shall actively assist them.

Illegal cultivation of original plants of drugs, which have been eradicated automatically before harvest, can be exempted from punishment.
