Regulations of Guangzhou Municipality on Parking Lot

Chapter I General Provisions Article 1 In order to strengthen the planning and construction of parking lots, standardize the use and management of parking lots, guide the public to travel green, and promote the coordinated development of urban traffic, these Regulations are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China, the Implementation Regulations of the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, use and management of parking lots within the administrative area of this Municipality.

Parking lots as mentioned in these Regulations refer to places where motor vehicles are parked, including public parking lots, special parking lots, temporary parking lots and temporary parking spaces on urban roads.

The provisions of these Regulations shall not apply to the planning, construction, use and management of special parking lots such as buses and trams, road passenger vehicles and road cargo transport vehicles. Article 3 The municipal traffic administrative department shall be responsible for the management of parking lots within the administrative area of this Municipality and organize the implementation of these Regulations, and perform the following duties:

(a) to organize the preparation, adjustment, promulgation and implementation of special planning for urban road parking lots and temporary parking spaces;

(two) organize relevant units to build public parking lots with urban transportation hubs;

(three) responsible for the daily management of public parking lots, temporary parking lots and temporary urban road berths independently invested by the Municipal People's Government;

(4) Establish and improve the basic database of parking lots;

(5) Establish a unified parking information management system;

(six) the establishment of parking operators, motor vehicle parking credit records;

(seven) to guide and supervise the district traffic administrative departments and the units entrusted by them to be responsible for the daily management of urban road temporary berths to carry out parking lot management;

(eight) to guide the parking lot industry associations to carry out industry self-discipline and service work;

(nine) the implementation of relevant administrative penalties according to law;

(ten) other duties as prescribed by laws and regulations. Article 4 District traffic administrative departments shall be responsible for the management of parking lots within their respective administrative areas and perform the following duties:

(a) to cooperate with the preparation, adjustment and implementation of special parking lot planning;

(two) responsible for the daily management of public parking lots and temporary parking lots independently built by the District People's Government;

(three) responsible for the filing of operating parking lots;

(four) to do a good job in the management of temporary urban road berths within their respective administrative areas according to law;

(five) the implementation of relevant administrative penalties according to law;

(six) other duties as prescribed by laws and regulations. Fifth public security organs are responsible for road traffic safety management, parking lot fire supervision and safety technical prevention supervision. , to assist the traffic administrative department in the preparation of urban road temporary berth planning, investigate and deal with urban road traffic, parking lot fire protection, safety technical prevention and other illegal acts according to law.

The price administrative department is responsible for the management of motor vehicle parking service charges, and investigate and deal with illegal parking charges according to law.

The relevant administrative departments of land, planning, housing, construction, industry and information technology, finance, industry and commerce, taxation, quality and technical supervision, environmental protection, water affairs, gardens, urban management and civil air defense shall, according to their respective functions and duties, do a good job in the management of parking lots. Article 6 Sub-district offices and town people's governments shall assist the District People's governments and their relevant administrative departments to do a good job in motor vehicle parking management, parking resources investigation and publicity and education within their respective jurisdictions, and guide the residents' committees, villagers' committees and owners' committees to carry out parking lot management and services. Article 7 The municipal and district people's governments shall incorporate the funds needed by the government to build and manage parking lots and support social forces to build public parking lots into the fiscal budget at the corresponding level. The municipal price administrative department shall evaluate the parking lot charging standards under government guidance and government pricing management at least every five years, and the evaluation results shall be used as the basis for adjusting the charging standards.

The municipal price administrative department shall, jointly with relevant departments, formulate bargaining rules for residential parking lots, which shall be published after being approved by the Municipal People's Government. When the motor vehicle parking service charges in residential parking lots are included in the pricing catalogue of Guangdong Province, the government-guided price management shall be implemented. Article 9 The municipal traffic administrative department shall, jointly with the municipal planning, construction and other administrative departments and the district people's government, regularly organize the investigation of all kinds of parking lot resources in the city, establish the basic database of parking lots, and update the data in real time, and the relevant units and individuals shall cooperate. Article 10 The municipal traffic administrative department shall establish a unified parking information management system in the whole city, implement dynamic management of the collected parking information, and release information such as the distribution position, number of berths, usage status, charging standards, etc. of operating parking lots and temporary urban road berths in real time.

The District People's Government shall set up an intelligent parking guidance system within its administrative area, release parking guidance information, and be responsible for the operation, maintenance and management of the parking guidance system.

The district traffic administrative department shall organize and urge the parking lot operators within its jurisdiction to upload the relevant parking data to the parking information management system in real time and directly according to the technical specifications.
