Regulations of People's Republic of China (PRC) Municipality on Ship Safety Supervision

Chapter I General Provisions Article 1 In order to ensure the safety of life and property on water, prevent water pollution caused by ships, and standardize ship safety supervision, according to the Law of People's Republic of China (PRC) on Maritime Traffic Safety, the Law of the People's Republic of China on the Protection of Marine Environment, the Law of People's Republic of China (PRC) Port, the Regulations of People's Republic of China (PRC) on the Administration of Inland River Traffic Safety and the Law of the People's Republic of China on the Protection of Marine Environment. Article 2 These Rules shall apply to the safety supervision of ships and water facilities in China and foreign ships sailing, berthing and operating in waters under the jurisdiction of China.

These rules do not apply to warships, fishing boats and sports vessels. Article 3 The ship safety supervision and management shall follow the principles of legality, fairness, honesty and convenience. Article 4 The Ministry of Transport shall be in charge of the national ship safety supervision.

The national maritime administrative agency is responsible for the national ship safety supervision.

Maritime administrative agencies at all levels shall, in accordance with their duties and authorization, implement ship safety supervision. Article 5 The term "ship safety supervision" as mentioned in these Rules refers to the safety supervision and management activities carried out by the maritime administrative agency according to law on whether the ship and its related activities comply with laws, regulations, rules, relevant international conventions and the provisions of the regional cooperation organization for port state control. Ship safety supervision is divided into ship site supervision and ship safety inspection.

On-site supervision of ships refers to the daily safety supervision and spot check activities carried out by the maritime administrative agency on ships.

Ship safety inspection refers to the safety supervision and inspection activities carried out by the maritime administrative agency on a regular basis on ship safety and pollution prevention technology, crew allocation and competency, and working conditions at sea, including flag state supervision and inspection and port state supervision and inspection. Article 6 A maritime administrative agency shall be equipped with necessary personnel, equipment and materials to meet the needs of ship safety supervision and management. Article 7 On-site supervision of ships shall be carried out by maritime administrative law enforcement personnel with corresponding responsibilities. Article 8 Maritime administrative law enforcement personnel engaged in ship safety inspection shall obtain corresponding qualification certificates and constantly update their knowledge. Article 9 The maritime administrative agency shall establish a social supervision mechanism for the safety status of ships, publicize the channels for reporting and complaining, and improve the handling mechanism for reporting and complaining.

The maritime administrative agency shall keep confidential the informants and complainants. Chapter II Reports on Ship Entry and Exit Article 10 Ships registered in China sailing in waters under the jurisdiction of China shall make reports on ship entry and exit in accordance with regulations. Article 11 A ship shall report its entry and exit information to the maritime administrative agency that leaves or enters the port four hours before it is expected to leave or enter the port. If the voyage is less than 4 hours, report when leaving the last port.

If the ship sails on a fixed route and the single voyage does not exceed 2 hours, it can report the entry and exit information at least once a day.

The ship shall be responsible for the completeness and authenticity of the report. Article 12 The inbound and outbound information reported by a ship shall include voyage dynamics, information about people on board, passenger and cargo carrying information, expected arrival and departure time and place. Thirteenth ships can report the information of ships' entry and exit through the Internet, fax, SMS, etc. , and make corresponding records in the ship's navigation or log book. Article 14 The maritime administrative agency and the waterway transportation administrative department shall establish an information platform to share the information of ships entering and leaving the port. Chapter III Total Quality Management of Ships Article 15 The maritime administrative agency shall establish a unified information platform for total quality management of ships, collect and process relevant information of ships, and establish a total quality file of ships. Article 16 The information platform for total quality management of ships shall include the following information:

(1) Basic information of the ship;

(2) the implementation of relevant regulations on ship safety and pollution prevention management;

(3) Water traffic accidents and pollution accidents;

(four) the maritime administrative agency's administrative punishment for illegal acts of water traffic safety;

(five) accept the ship safety supervision;

(six) the safety and integrity of shipping companies and ships;

(seven) the ship's entry and exit report or entry and exit procedures;

(eight) to pay the relevant fees and taxes in accordance with the relevant provisions;

(9) Technical status of ship inspection. Article 17 The maritime administrative agency shall conduct comprehensive quality assessment on ships according to the information listed in Article 16, and publish the results of comprehensive quality assessment. Article 19 The national maritime administrative agency shall formulate the selection criteria for ships subject to safety supervision.

The maritime administrative agency shall, in combination with the actual situation of the jurisdiction, select ships for ship safety supervision within a specified time interval in accordance with the principles of comprehensive coverage, highlighting key points, openness and convenience, and the target ship selection criteria stipulated by the port state supervision regional cooperation organization and the national maritime administrative agency of China's accession, taking into account the ship type, ship age, defects in previous ship safety supervision and the safety management status of shipping companies. Article 20 For ships that are not included in the target ship selection criteria, except for special inspections in accordance with the provisions of Article 21, the maritime administrative agency shall not, in principle, board the ship to implement ship safety supervision.
