How to deal with traffic violation SMS notification?

The received traffic violation information is processed as follows:

(1) You can go to the local illegal traffic police team for handling, or you can handle it yourself through the service platform;

(2) After receiving the short message or inquiring about the violation record on the traffic website, the owner can go to the traffic police team where the violation is located within one month before the annual inspection of the motor vehicle.

According to the provisions of the Traffic Law, after a motor vehicle violates the rules, it can generally be inquired online or notified by SMS within 3 to 7 days, and no later than 13 working days. If it is found and signed by the traffic police at the scene, the owner needs to go to the local traffic police team within 15 days after the violation. If it is left untreated for more than 15 days, a late payment fee of 3% shall be paid every day, but the amount of the late payment fee shall not exceed twice the original fine; If the photo is taken by electronic eye monitoring, the owner can check the violation records on the traffic website, and can go to the traffic police team in violation of the regulations within one month before the annual review of the motor vehicle, instead of within 15 days, but be careful not to exceed one scoring cycle of the driver's license as far as possible, so as to avoid the situation that one scoring cycle is not cleared in time, resulting in the cumulative deduction of 12 points in the next scoring week.

At present, it can be handled that car owners need to bring their driver's license and driving book to any traffic police team in violation of regulations. If there is no fine, they can pay the fine directly at ICBC or online, or they can pay it at Alipay. However, if there are points deducted, you must first go to the traffic police team to confirm the violation and deduct points before you can pay the fine.

The procedure for handling traffic violations is as follows: if the violator is fined above 200 yuan (excluding this number), his driver's license is suspended or revoked, or a unit is fined according to laws and regulations, an investigation shall be conducted, evidence shall be collected, and a punishment decision shall be made according to the general procedure.

The general procedure of traffic violation punishment: investigate and collect evidence, inform the matters, reasons, basis and related rights of punishment, listen to statements and arguments or hold hearings, and make a decision on punishment.

1. The traffic police impose a fine of not more than 200 yuan on an individual at the scene, and can make a decision on punishment on the spot;

2. If the traffic police handle a case in a different place and impose a fine on the owner, manager or driver of an illegal motor vehicle according to the traffic technical monitoring records, a summary procedure may be applied to make a penalty decision.

Therefore, it is illegal to take summary procedures and impose a fine of less than 200 yuan. According to the Regulations on Road Traffic Handling Procedures, traffic policemen with more than one year's experience in road traffic management can handle traffic accidents with summary procedures only after they have passed the training and examination by the traffic management department of the municipal public security organ with districts.

2. Legal basis: Article 90 of the Road Traffic Safety Law of the People's Republic of China

Motor vehicle drivers who violate the provisions of laws and regulations on road traffic safety shall be given a warning or fined from 20 yuan to 200 yuan. If there are other provisions in this law, it shall be punished in accordance with its provisions.

Article 95

If a motor vehicle driving on the road does not carry a motor vehicle number plate, inspection mark or insurance mark, or does not carry a driving license or driver's license with it, the traffic control department of the public security organ shall detain the motor vehicle, notify the parties concerned to provide the corresponding number plate and mark or go through the corresponding formalities, and may impose penalties in accordance with the provisions of Article 90 of this Law. If the party concerned provides the corresponding number plate, logo or goes through the corresponding formalities, it shall return the motor vehicle in time.

Whoever intentionally conceals, defaces or fails to install the motor vehicle number plate in accordance with the provisions shall be punished in accordance with the provisions of Article 90 of this Law.
