Chapter 1 General Provisions Article 1 In order to ensure the state’s pensions and preferential treatment for military personnel, inspire military personnel’s dedication to defending and building the motherland, and strengthen national defense and military construction, in accordance with the Regulations on Pensions and Preferential Treatments for Military Personnel (hereinafter referred to as "Regulations"), these measures are formulated based on the actual situation of the province. Article 2 Active servicemen of the Chinese People's Liberation Army (hereinafter referred to as active servicemen), disabled servicemen who are in active service or who have retired from active service, demobilized servicemen, veterans, survivors of martyrs, survivors of servicemen who died in the line of duty, survivors of servicemen who died of illness, and family members of active servicemen shall be subject to these Measures The prescribed pension and preferential treatment objects shall enjoy pension and preferential treatment in accordance with national and provincial regulations. Article 3 The people's governments at or above the county level shall strengthen leadership over the work of military personnel's pensions and preferential treatment, promptly coordinate and resolve problems that arise in the work of military personnel's pensions and preferential treatment, ensure that the funds required for military personnel's pensions and preferential treatment are borne by the finance at the same level, and ensure that the standards of pensions and preferential treatment are not low. standards set by the country and the province. Article 4: The funds required for military personnel’s pensions and preferential treatment, in addition to those arranged by the central government, shall be borne by the people’s governments of provinces, cities divided into districts, and counties (cities, districts) at different levels. The military pension and preferential treatment funds arranged by finance at all levels are earmarked for special use and are subject to the supervision of finance and auditing departments. Article 5: The civil affairs departments of the people's governments at or above the county level are responsible for the pension and preferential treatment of military personnel within their respective administrative regions.

The finance, human resources and social security, health, education, culture, housing and urban and rural development, transportation, tourism and other departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in providing pensions and preferential treatment for military personnel. Chapter 2 Death Benefit Article 6 If the death of an active-duty soldier is approved as a martyr, is confirmed to have been sacrificed in the line of duty, or died of illness, the civil affairs department of the people's government at the county level that receives the notice from the political agency above the military regiment shall fill in the "People's Government of the People's Republic of China" separately. *Certificate of Martyrs of the People's Republic of China", "Certificate of Soldiers of the People's Republic of China who sacrificed their lives in the line of duty" or "Certificate of Death of Soldiers of the People's Republic of China and the People's Republic of China" (hereinafter referred to as the certificate), shall be issued in accordance with regulations A certificate holder.

The holder of the certificate shall be determined through consultation by the parents (dependants), spouses and children of martyrs, servicemen who died in the line of duty or soldiers who died of illness. The result of the consultation shall be notified in writing to the issuing authority; if the consultation fails, the following order shall be followed Issuance:

(1) Parents (custodians);

(2) Spouse;

(3) Children, if there are multiple children, it will be issued to Elderly people.

If there are no parents (dependants), spouse, or children, it will be issued to brothers and sisters. If there are multiple brothers and sisters, it will be issued to the elder.

If there are no survivors as mentioned above, no certificate will be issued. Article 7 The one-time pension shall be issued to martyrs, servicemen who sacrificed their lives in the line of duty, and the survivors of soldiers who died of illness in accordance with the standards stipulated by the state by the civil affairs department of the people's government at the county level where the holder's household registration is located in the following order:

( 1) Parents (custodians), spouses, and children;

(2) If there are no parents (custodians), spouses, or children, it will be issued to brothers and sisters who are under the age of 18 and those who are over the age of 18 but Brothers and sisters who have no source of living expenses and were supported by the soldier during his lifetime.

If there are no survivors as mentioned above, no one-time pension will be granted.

The amount of one-time pension received by the survivors in the same order shall be determined by the survivors through negotiation; if the negotiation fails, it will be distributed equally according to the number of survivors in the same order. Article 8 In addition to the one-time pensions enjoyed by the surviving family members of martyrs, servicemen who sacrificed their lives in the line of duty, or who have performed meritorious services, or who have performed meritorious services, their surviving family members shall receive an additional one-time pension by the civil affairs department of the people's government at the county level in accordance with the following provisions:

(1) Those who are awarded honorary titles by the Central Military Commission will receive an additional issuance of 50%;

(2) Those who are awarded honorary titles by military region-level units of the army will receive an additional issuance of 40%;

(3) Those who are awarded the first-class merit will be issued an additional 30%;

(4) Those who are awarded the second-class merit will be issued an additional 20%;

(5) Those who are awarded the third-class merit If successful, increase the issuance by 10%.

For martyrs who have won many honorary titles or have performed meritorious services, soldiers who have sacrificed their lives in the line of duty, or soldiers who have died of illness, their survivors will receive an additional one-time pension in accordance with the highest level of reward standards stipulated in the preceding paragraph. Article 9 If there are more than two survivors of martyrs, soldiers who sacrificed their lives in the line of duty, or soldiers who died of illness who are entitled to regular pensions in accordance with the law and their household registrations are not in the same place, their regular pensions shall be issued separately by the civil affairs department of the people's government at the county level in the place of their respective household registrations in accordance with local standards. Article 10 If a martyr, a soldier who sacrificed his life in the line of duty, or a soldier who died due to illness dies and is a family member of a soldier who enjoys a regular pension, in addition to the regular pension that should be received in that month, an additional 6 months of pension will be paid according to the standard of regular pension in the month of death. As funeral subsidy, the certificate for receiving regular pension will be cancelled. Chapter 3 Disability Pensions Article 11 Disabled servicemen who retire from active service shall, within 60 days after completing the formalities for retirement or transfer from the army, present their "Disabled Serviceman Certificate of the People's Republic of China", retirement certificate, disability assessment file and household registration. Certificates and other relevant materials should be submitted to the civil affairs department of the people's government at the county level where the household registration is located to apply for the disability pension relocation procedures. The civil affairs department of the people's government at the county level should complete the procedure within 20 days from the date of receipt of the application.

After a disabled soldier who retires from active service goes through the procedures for moving in a disability pension relationship, the disability pension will be paid starting from January of the following year after retirement; if a disabled soldier who retires from active service fails to go through the procedures for moving in a disability pension relationship within the time limit specified in the preceding paragraph, If the procedures are completed, the disability pension will be paid from January of the next year after the move-in procedures are completed.
