In recent years, with the increase of various debt disputes in society, various debt collection companies have appeared in some areas, illegally engaging in debt collection activities. Some are registered in the name of economic entrustment, business agency and financial consultation. , but the actual activities are beyond the registered business scope, and debt collection karma is carried out; Some engage in debt collection activities without the registration or approval of the relevant departments. Debt collection companies undertake the business of debt collection and collection, and do not have the authority and coercive power given by law. They generally employ laid-off workers, retirees and other social idlers, and get paid through door-to-door dunning, stalking or damaging the debtor's reputation. Some even threaten, intimidate, cajole, blackmail or even kidnap the personal safety of the debtor to seek illegal interests. The activities of debt collection companies not only interfere with the normal work and life of enterprises, institutions, activists and citizens. Endangering social order, disrupting legal order, encouraging violations of law and discipline, and causing adverse effects in society. In order to maintain the normal social and economic order of the country, with the consent of the State Council, the following provisions are formulated:

First, all kinds of debt collection companies are banned, and it is forbidden for any unit or individual to set up any form of debt collection company. Those who continue to engage in illegal debt collection activities and infringe upon the legitimate rights and interests of companies, legal persons and other organizations should resolutely punish corruption.

Two, the administrative departments for Industry and commerce at all levels should strengthen supervision and management, and not approve the registration of enterprises applying for debt collection business; For enterprises engaged in debt collection activities in the name of consulting services and entrusted agents, their business licenses should be revoked according to law; Unregistered debt collection companies will be resolutely banned once they are discovered.

Three, public security organs at all levels should closely cooperate with the administrative department for Industry and commerce, take effective measures to increase the crackdown on illegal debt collection activities. To take intimidation, threats or other means to interfere with the normal life of others, the public security organs should be punished according to the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Four, news organizations should actively cooperate with relevant departments to publicize the provisions of the state on banning all kinds of debt collection companies and the harm caused by illegal debt collection activities to society, and play a correct role in guiding public opinion.
