What is illegal fishing?

Legal analysis: illegal fishing usually refers to IUU fishing internationally, that is, illegal, unreported and unregulated fishing activities, referred to as IUU fishing, which is a serious illegal fishing activity internationally.

Legal basis: Article 4 of the Provisions of the Supreme People's Court on Several Issues Concerning the Trial of Cases Occurred in the Sea Areas under China's Jurisdiction violates the laws and regulations on the protection of aquatic resources, and catches aquatic products in the sea areas, no-fishing areas, no-fishing seasons or by using prohibited tools and methods. In any of the following circumstances, it shall be deemed as "serious circumstances" as stipulated in Article 340th of the Criminal Law:

(a) illegal fishing of aquatic products 1 10,000 kg or more or the value of110,000 yuan or more;

(two) illegal fishing of aquatic animal larvae and brooding parents with important economic value of more than two thousand kilograms or more than twenty thousand yuan;

(3) Fishing aquatic products of more than 2,000 kilograms or worth more than 20,000 yuan in protected areas;

(4) Fishing with prohibited tools and methods in the no-fishing area;

(five) fishing with prohibited tools and methods during the fishing ban;

(six) the use of prohibited fishing gear for fishing operations on the high seas, causing serious impact;

(7) Other serious circumstances.
