Regulations of Jiangsu Province on Radio and Television Administration

Chapter I General Provisions Article 1 In order to strengthen the administration of radio and television, promote the development of radio and television, and enrich the people's spiritual and cultural life, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Services, the Regulations on the Administration of Radio and Television in the State Council, People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the establishment of radio stations, television stations and radio and television stations within the administrative area of this province, the construction and operation of radio and television transmission coverage networks, the production, broadcasting and transmission of radio and television programs, the dissemination of audio-visual program services through information networks and the broadcasting of audio-visual programs by public audio-visual carriers, and their supervision and management. Article 3 The local people's governments at or above the county level shall incorporate the development of radio and television undertakings into the national economic and social development plan and the government public service system, and include the funds required for radio and television public services into the fiscal budget.

Local people's governments at or above the county level shall take measures to support the development of radio and television in rural areas and economically weak areas. Article 4 The administrative departments of radio and television of local people's governments at or above the county level shall be responsible for the administration of radio and television within their respective administrative areas.

Public security, national security, planning, construction, industry and commerce, radio management, communication management and other relevant departments and units shall do relevant work in accordance with their respective responsibilities. Article 5 The local people's governments at or above the county level shall encourage and support technological innovation, equipment updating and media integration in the radio and television industry, build an intelligent and intensive radio and television technology platform, and promote the integrated development and effective utilization of network resources.

The administrative department of radio and television shall, jointly with the departments of development and reform, prepare a special plan for the development of radio and television, co-ordinate technical means such as wireless, cable and satellite, and promote the digitalization, two-way and intelligent construction of radio and television transmission coverage networks. Sixth local people's governments at or above the county level shall incorporate the construction and protection of radio and television facilities into urban and rural planning, and strengthen the comprehensive coordination and publicity and education of the protection of radio and television facilities. Township people's governments and sub-district offices shall assist in the protection of radio and television facilities.

Radio and television facilities are protected by law. No unit or individual may occupy or destroy radio and television facilities. Any unit or individual has the right to stop and report to the relevant departments acts that hinder the normal operation of radio and television facilities and endanger the safety of radio and television facilities. Seventh radio and television industry associations and other social organizations under the guidance of the administrative department of radio and television, in accordance with their articles of association to carry out industry services, self-discipline management.

Radio and television practitioners should practice socialist core values, abide by constitutional laws and regulations, and abide by professional ethics. Article 8 Units and individuals that have made outstanding contributions to the development of radio and television shall be commended by the local people's governments at or above the county level or the radio and television administrative departments in accordance with the relevant provisions of the state and the province. Chapter II Radio and Television Stations and Radio and Television Transmission Coverage Network Article 9 The establishment of a radio and television station shall comply with the relevant provisions of the state and go through the examination and approval procedures according to law. Article 10 The establishment of radio stations and television stations shall conform to the relevant provisions of the State. The establishment of the unit shall apply to the local radio and television administrative department, and be approved by the provincial radio and television administrative department for examination and approval.

Radio and television stations shall not lease, transfer or contract. Article 11 Whoever engages in the business of broadcasting and transmitting TV programs by means of cable, wireless, microwave and satellite shall obtain a license for broadcasting and transmitting TV programs in accordance with the relevant provisions of the state, and engage in the business of broadcasting and transmitting TV programs in accordance with the matters specified in the license. Twelfth institutions engaged in radio and television program transmission business shall not use their own networks, frequencies or other resources to run radio and television programs without authorization, and shall not provide transmission services for illegally run programs and radio and television signals from illegal sources. Article 13 A cable radio and television network business unit shall sign a service agreement with users in accordance with the national and provincial cable radio and television service standards and the promised service items and contents, and specify the service items, service scope, service standards, service time limit, service code, tariff standards, liability for breach of contract and other contents. , and according to the provisions of the basic cable TV viewing maintenance fee. The maintenance fee for basic cable TV viewing is determined by the government. The specific charging standards shall be formulated by the provincial price department and announced to the public.

Cable radio and television network business units shall inform users of the expiration of the viewing service period by means of mobile phone short messages and TV subtitles before the expiration of the viewing service period. If the payment has not been made after the expiration of the viewing service, a grace period of not less than 30 days shall be given, and the viewing service shall not be stopped during the grace period. Fourteenth individuals are not allowed to set up and use ground receiving facilities for satellite TV broadcasting, but in areas where local TV stations, TV relay stations and cable TV stations cannot receive TV programs, individuals can apply for setting up and using ground receiving facilities for satellite TV broadcasting to receive domestic satellite TV programs.

The establishment and use of ground receiving facilities for satellite TV broadcasting to receive domestic satellite TV programs shall go through the examination and approval procedures in accordance with relevant state regulations. Fifteenth the establishment and use of satellite TV broadcasting ground receiving facilities to receive overseas satellite TV programs shall apply to the local radio and television administrative department for examination and approval by the provincial radio and television administrative department.

The reception of overseas satellite TV programs through satellite TV broadcasting ground receiving facilities is limited to the reception of TV programs legally landed in China with encrypted directional transmission through the central overseas satellite TV supervision platform approved by the radio and television administrative department of the State Council.

Without permission, no unit or individual may receive and transmit overseas satellite TV programs through radio and television transmission coverage networks or other information networks.
