What procedures and materials are needed for marriage registration?

The current marriage registration process can be roughly divided into three links: application, examination and registration.

(1) application

Those who meet the conditions for marriage registration shall apply for marriage registration at the marriage registration office where one party's household registration is located together with relevant certification materials and registration photos, and fill in the Declaration on Application for Marriage Registration and other documents.

The preparation materials for marriage registration application depend on the specific circumstances. For example, China citizens who apply for marriage in China must hold their ID card, household registration book, marriage examination certificate, single certificate and a statement that they are not related to each other (lineal blood relatives and collateral blood relatives within three generations). For the divorced party, he/she must also hold a divorce certificate.

Foreigners applying for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who settle in China) must hold their own identity documents (passports or other nationality documents), foreigners' residence permits or temporary entry and residence certificates, official proof of marital status and other materials.

(2) Review

The marriage registration authority shall verify and examine the parties applying for marriage registration to find out whether the marriage application submitted by them is within the conditions. If the application materials submitted by the parties are unknown, the marriage registration authority will generally ask the parties and ask them to provide corresponding certification materials when necessary.

(3) Registration and licensing

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and issue a marriage certificate to the parties; For those who have experienced divorce, the marriage registration office will generally cancel the divorce certificate; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons for disapproval of marriage registration.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If a husband and wife voluntarily divorce in the Mainland, they shall sign a written divorce agreement and jointly apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials as required:

1, my marriage certificate;

2. Relevant valid identity documents that meet the requirements, such as my ID card, household registration book, pass, passport or other valid international travel documents;

3. Fill in the application for divorce registration.

(2) Accept

The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. The marriage registrar shall send a receipt for accepting the application for divorce registration to the parties after the documents and supporting materials submitted by the parties are verified in the first instance. If there are differences with the conditions for divorce registration, the marriage registration authority will not accept it, and the parties may request to issue a notice of not accepting the application for divorce registration.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for acceptance of the application for divorce registration to the parties concerned, if either party does not want to divorce, it can withdraw the previously submitted application for divorce registration from the divorce registration office where the receipt cannot be found, and fill out the Application for Withdrawal of Divorce Registration in person. After verification, the marriage registration authority shall issue a Confirmation Form for Withdrawing the Application for Divorce Registration. Within 30 days after the end of the cooling-off period of divorce, if the couple who ask for divorce fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the period), both parties shall, as required, bring the divorce agreement, marriage certificate, photos and valid certificates to prove their identity and other relevant documents and materials signed by both parties, and jointly apply to the marriage registration authority for divorce certificate. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Those who do not meet the conditions for divorce registration shall not be handled. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.

(5) Registration and certification

The marriage registration authority shall, in accordance with the relevant provisions, register the parties concerned and issue a divorce certificate.
