Is buying lottery tickets gambling? Are there any rules?

Legal analysis: buying lottery tickets is not gambling. Lottery is a kind of voucher issued to raise funds, printed with numbers, graphics, words and face value, which is purchased voluntarily by buyers according to certain rules and whether they get rewards or not. Buying lottery tickets issued and sold according to law is not gambling. Buying illegally issued and sold lottery tickets, such as online lottery tickets, is an illegal lottery ticket and may constitute a gambling crime.

Legal basis: The illegal lottery mentioned in Article 7 of the Detailed Rules for the Implementation of the Lottery Management Regulations refers to the issuance and sale of the following forms of lottery tickets in any way in violation of regulations: (1) Issuing and selling lottery tickets other than welfare lottery tickets and sports lottery tickets without special permission from the State Council; (2) Overseas lottery tickets issued and sold in People's Republic of China (PRC) without authorization; (3) Welfare lottery tickets, sports lottery varieties and lottery games issued and sold without the approval of the Ministry of Finance; (4) Welfare lottery tickets and sports lottery tickets sold without the authorization of lottery issuing agencies and lottery sales agencies. (five) unauthorized use of the Internet to sell welfare lottery tickets and sports lottery tickets. The financial departments at or above the county level, the civil affairs departments, the sports administrative departments, the lottery issuing agencies and the lottery sales agencies shall actively cooperate with the public security organs and the market supervision and management departments to investigate and deal with illegal lottery tickets according to law and maintain the order of the lottery market.
