Electronic court summons delivery methods

Generally, summonses are served through text messages or WeChat public accounts. Generally speaking, the electronic court case filing process is as follows:

1. After logging in to the electronic court, click "Online Case Filing"

2. In the opened interface, select the case category and applicant. Then click "Next", read the instructions for filing the case, and finally click "Enter Online Case Filing".

3. Enter the interface for filling in case filing information and fill in the parties, agents, witnesses, litigation claims, facts and reasons. After the information is completed, click "Confirm and Next".

The user enters the interface for uploading litigation materials, automatically generates or uploads an appeal, and then uploads the certificate materials and evidence materials, confirms and takes the next step. Enter the court selection interface, the system will display the recommended court, or you can re-select another court, click Next, then enter the real-name authentication material submission interface, take real-time photos, and take or upload photos of the front and back of the ID card. If identity authentication has been carried out before, the previous identity authentication information will be automatically associated here and can be modified again. Finally, click "Preview and Submit". In the preview interface that opens, check again whether the case filing information is correct. If there is no problem, click "Submit" and the case filing application is successful.

Article 122 Prosecution must meet the following conditions:

(1) The plaintiff is a citizen, legal person or other organization that has a direct interest in the case;

(4) It falls within the scope of the People’s Court to accept civil litigation and the jurisdiction of the People’s Court subject to the lawsuit

If the case meets the conditions for prosecution, the case shall be filed within seven days and the parties shall be notified; if the conditions for prosecution are not met, a ruling shall be made within seven days and the case will not be accepted; if the plaintiff is dissatisfied with the ruling, he may appeal.
