Legal basis: Article 68 of the Law of People's Republic of China (PRC) on the Administration of Tax Collection stipulates that taxpayers and withholding agents who fail to pay or underpay the tax payable within the prescribed time limit shall be ordered by the tax authorities to pay within the prescribed time limit. If it fails to pay within the time limit, the tax authorities may, in addition to taking compulsory measures to recover the tax it fails to pay or underpays in accordance with the provisions of Article 40 of this Law, impose a fine of not less than 50% but not more than five times the tax it fails to pay or underpays.
