Does threatening harassment by phone messages constitute a crime?

It depends on the specific harassment information sent. According to the fifth paragraph of Article 42 of the Law on Public Security Administration Punishment, whoever repeatedly sends obscene, insulting, threatening or other information, which seriously interferes with the normal life of others, shall be detained for not more than five days or fined 500 yuan. If the circumstances are particularly minor, the punishment may be mitigated or not.

If an actor who violates the administration of public security is under any of the following circumstances and should be given administrative detention punishment according to this Law, administrative detention punishment shall not be executed:

(1) Having reached the age of 14, but under the age of 16;

(2) Having reached the age of 16 but under the age of 18, and violating the administration of public security for the first time;

(3) Over 70 years old;

(four) pregnant or nursing their own babies under the age of 1 year.
