The crime of credit card fraud includes the following acts:
1, fraudulently using forged credit cards. The so-called use includes various services such as purchasing goods with credit cards, withdrawing cash from banks or ATMs, and accepting credit card payment and settlement. The "forged credit card" here refers to the forged credit card stipulated in Article l77 of this Law, that is, the credit card manufactured by various illegal means. For forged credit cards, some counterfeiters use them for fraudulent activities, and some counterfeiters sell or give them to others for fraudulent activities. For users, whether they use it for themselves or others, it is a case of "using forged credit cards". Using forged credit cards, whether shopping or accepting various paid services, is essentially a fraud.
2. Use an invalid credit card for fraud. The so-called invalid credit card refers to the use of credit cards that have expired for legal reasons. According to the relevant regulations, there are mainly the following types of invalid credit cards: (1) Credit cards automatically expire after their effective use period. According to the types of issuing banks and credit cards, the validity period of credit cards is also different, with a term of one year, two years, three years or longer. For those who do not continue to use the credit card or need to continue to use it after the effective period, the expired credit card should be returned to the issuing bank or company. (2) The credit card holder stops using the card in the middle of the validity period. At this point, although the validity period of the credit card has not yet arrived, it will be invalid after going through the formalities of returning the card. (3) The credit card is invalid due to loss reporting.
3. Fraudulent use of other people's credit cards. The so-called fraudulent use of other people's credit cards refers to the behavior of non-cardholders using cardholders' credit cards to defraud property in the name of cardholders. If you use the credit card you found; Without the consent of the cardholder, use the credit card kept by the cardholder for consumption, etc.
4. The credit card is maliciously overdrawn. Credit card overdraft means that the cardholder can still use the credit card for consumption with the approval of the bank when the credit card account of the issuing bank has insufficient funds or no funds. Credit card overdraft is essentially the consumer credit provided by the bank to the cardholder, that is, when the funds are insufficient, the cardholder is allowed to spend first, and then the cardholder makes up the funds and pays certain interest according to the regulations. In China, the issuing bank generally stipulates that cardholders are allowed to make short-term goodwill overdrafts within a certain limit. If the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and fails to return it for more than 3 months after being repeatedly urged by the issuing bank, it shall be deemed as "malicious overdraft" as stipulated in Article 196 of the Criminal Law (latest judicial interpretation).
Nine common methods of credit card fraud
1. SMS notification "friendly" guidance. The swindler pretends to be a bank employee to inform you that your credit card was successfully swiped in a shopping mall and left an inquiry number. When you are in doubt, the liar will "kindly" guide you to operate on the ATM and use all kinds of sweet words to induce you to transfer money to his designated account.
2. Call for the password. The swindler lied that your credit card has been stolen and the suspect has been arrested, and asked the deceived person to report the card number and password to the "bank staff" to avoid "freezing the credit card". When you tell the liar the relevant information, the amount on the credit card will be stolen.
3. Fake websites are easy to be fooled. The scammer "spits" the real bank website, and then posts an advertisement on it saying that the online banking lottery will be held. When you click enter, you will be asked to enter the card number and password.
4. Post a "notice" to induce you to transfer money. Liars often post a notice on ATM machines, such as "banking system failure, please follow the following procedures, otherwise the consequences will be at your own risk". Follow the prompts and you will transfer the amount on the card to the liar.
5. Create the illusion that the credit card has been swallowed. The swindler first tampered with the ATM so that your card could not be taken out, and then disguised as a kind person to remind you to re-enter the password. When your operation is invalid and you ask in the bank business hall, "good people" will take the card away.
6. Play the double spring to switch packages instantly. Someone asks you questions before you take out your card after you finish your business. Before you can turn around and talk, another person next to you has switched your cards.
7. Read the password before you do it. When you withdraw money or swipe your card at ATM, the thief has secretly tracked and recorded your password, and then waited for an opportunity to steal your bank card and embezzle it.
8. Peep at the victim's personal information. Some customers are not aware of the protection of personal information when handling banking business, so some scammers use their super memory to write down the victim's credit card number, ID number, name and bank card password, and then forge the victim's ID card to open online banking in the bank, taking the victim's deposit as their own.
9. Fraud in the name of payment. After the swindler tried his best to find some company information, he called and pretended to pay part of the deposit before placing the order, so that the financial staff could check it in time. A day or two later, the swindler asked if he had received the payment. When the financial staff does not receive the answer, the liar will provide a so-called bank phone number for the financial staff to verify by phone. After the automatic answering phone is connected, you will be reminded to enter your account number and password. After the scammer obtains the account number and password, he will immediately forge an ID card to withdraw money from the bank.
