Article 4

Article 5

Telecom business operators shall register and protect the true identity information provided by telephone users when they go through the network access procedures according to law.

Article 6

When handling network access procedures for users, telecom business operators shall require users to produce valid certificates and provide true identity information, and users shall cooperate.

If the user entrusts others to handle the network access procedures, the telecom business operator shall require the trustee to show the valid certificates of the user and the trustee, and provide the true identity information of the user and the trustee.

Article 7

Individuals who register the true identity information of telephone users may produce one of the following valid certificates:

(1) Resident identity card, temporary resident identity card or household register;

(two) the identity documents of the China People's Liberation Army soldiers and the China People's Armed Police;

(three) Hong Kong and Macao residents to and from the mainland pass, mainland travel permit for taiwan residents or other valid travel documents;

(4) Passports of foreign citizens;

(5) Other valid identity documents stipulated by laws, administrative regulations and the state.

Article 8

The unit that registers the true identity information of telephone users may produce one of the following valid certificates:

(1) Organization code certificate;

(2) Business license;

(3) Certificate of legal person of public institution or registration certificate of legal person of social organization;

(4) Other valid certificates or certificates stipulated by laws, administrative regulations and the state.

When the unit handles the registration, in addition to one of the above documents, it should also show the valid certificate of the agent and the power of attorney of the unit.

Article 9

Telecom business operators should check the certificates produced by users and truthfully register the types of certificates and the information such as name, number and address recorded on the certificates; If the user entrusts others to handle the network access procedures, it shall check the certificate of the trustee and register the above information of the trustee.

In order to facilitate users to provide identity information, go through network access procedures, and protect users' legitimate rights and interests, telecom operators who copy user identity documents shall indicate the name of telecom operators, the purpose and date of copying on the copy.

Article 10

If a user refuses to produce a valid certificate, refuses to provide the identity information recorded in the certificate, fraudulently uses another person's certificate or uses a forged or altered certificate, the telecommunication business operator shall not go through the network access procedures for him.

Article 11

During the period of providing services to telephone users and within two years after the termination of providing services to them, telecom business operators shall keep the identity information and related materials provided by users when they go through the network access procedures.

Article 12

Telecom business operators shall establish and improve the confidentiality management system of users' real identity information.

Telecom operators and their staff shall keep the real identity information of users registered in the process of providing services strictly confidential, and shall not disclose, tamper with, damage, sell or illegally provide it to others, and shall not be used for purposes other than providing services.

Article 13

If the true identity information of telephone users is leaked or may be leaked, damaged or lost, the telecommunication business operator shall take remedial measures immediately; If it causes or may cause serious consequences, it shall immediately report to the relevant telecommunications regulatory agencies and cooperate with the investigation and handling of relevant departments.

Telecom regulatory agencies should evaluate the impact of reported or discovered acts that may violate the provisions on the protection of telephone users' true identity information; If the impact is particularly significant, the communications administrations of the relevant provinces, autonomous regions and municipalities directly under the Central Government shall report to the Ministry of Industry and Information Technology. Before making a decision in accordance with these regulations, the telecommunications regulatory agency may require the telecommunications business operators to suspend relevant acts, and the telecommunications business operators shall implement them.

Article 14

Telecom operators who entrust others to register the true identity information of telephone users through telephone access procedures shall supervise and manage the registration and protection of their true identity information, and shall not entrust agents who do not meet the requirements for the registration and protection of the true identity information of users in these Provisions to handle relevant procedures.

Article 15

Telecom business operators shall conduct a self-examination on the registration and protection of the true identity information of their telephone users at least once a year, and train their staff on the knowledge, skills and safety responsibilities related to the registration and protection of the true identity information of telephone users.

Article 16

Telecommunication management institutions shall supervise and inspect the registration and protection of the true identity information of telephone users of telecommunication business operators. When conducting supervision and inspection, the telecommunications regulatory agency may require the telecommunications business operators to provide relevant information and enter their production and business premises to investigate the situation, and the telecommunications business operators shall cooperate.

When conducting supervision and inspection, the telecommunications regulatory agency shall record the supervision and inspection, and shall not interfere with the normal operation or service activities of the telecommunications business operators, and shall not charge any fees.

Telecommunication management institutions and their staff shall keep confidential the true identity information of telephone users known in the process of supervision and inspection, and shall not disclose, tamper with, damage, sell or illegally provide it to others.

Article 17

Telecom business operators who violate the provisions of Article 6, Article 9 to Article 15 of these Provisions, or fail to cooperate with the supervision and inspection carried out by the telecommunications regulatory agencies in accordance with these Provisions, shall be ordered by the telecommunications regulatory agencies to make corrections within a time limit according to their functions and powers, given a warning, and may be fined between 1 10,000 yuan and 30,000 yuan, and announced to the public. Among them, the "People's Republic of China (PRC) Telecom Regulations" stipulates legal liability, which shall be handled in accordance with its provisions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 18

For users who use fraudulent, forged or altered certificates to access the network, telecom operators shall not provide services for them, and shall be dealt with by relevant departments in accordance with the provisions of the Law of the People's Republic of China on Resident Identity Cards, the Law of People's Republic of China (PRC) on Public Security Administration Punishment, and the Measures for the Application and Issuance of Resident Identity Cards for Servicemen and People's Armed Police.

Article 19

Staff of telecommunication management institutions who neglect their duties, abuse their powers or engage in malpractices for selfish ends in the process of supervision and management of telephone users' real identity information registration shall be dealt with according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 20

Telecom operators shall inform users by telephone, short message, written letter or announcement, and take convenient measures to re-register telephone users who did not provide true identity information or provided incomplete identity information before the implementation of these Provisions.

Telecom business operators shall go through the registration procedures for telephone users and shall not increase the responsibilities of users without authorization.

Telecom business operators shall require users to provide real identity information when confirming the provision of services to users who have not provided real identity information.

Article 21

These Provisions shall come into force on September 20th, 20 13.
