Provisions of Qingdao Municipality on Fire Control Management of Urban Construction Projects

Article 1 In order to strengthen the fire control management of construction projects and prevent and reduce fires, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and other relevant fire control laws and regulations. Article 2 These Provisions shall apply to projects such as new construction, expansion and repair (including interior decoration) within the urban areas and counties (cities) of this Municipality.

Units and individuals from this Municipality and other places who come to Qingdao, as well as the construction, design and construction of Sino-foreign joint ventures, Sino-foreign cooperation and foreign-funded enterprises, shall abide by these provisions. Third urban and rural construction administrative departments and public security fire control institutions are responsible for supervising the implementation of these provisions. Article 4 The urban planning department must incorporate the construction of public fire control facilities such as fire stations, fire water supply, fire communication and fire exits into the overall planning, zoning planning and detailed planning of urban construction. Fifth urban construction, public utilities, posts and telecommunications and other departments shall formulate plans for the planning, construction, maintenance and management of public fire control facilities, and implement them simultaneously with urban construction; If the original public fire control facilities are seriously inadequate, the layout is unreasonable, and there are major fire hazards, it is necessary to implement the responsibilities and gradually transform them. Sixth urban land, planning and management departments in the allocation of construction land and adjust the planning layout, should implement the provisions of the relevant fire technical specifications. Article 7 Newly-built factories, warehouses, open-air freight yards, special stations and docks for producing, storing, loading and unloading inflammable and explosive chemicals must be located in safe places, and the opinions of public security fire control institutions should be sought when selecting sites. Article 8 Designers must strictly implement relevant fire control technical specifications and regulations in engineering design. The design unit shall establish the post responsibility system for fire protection design of each major. In the design scheme of large and medium-sized construction projects, a special chapter should be listed to discuss fire control technical measures. The selected building materials and components must be qualified products, and their combustion performance and fire resistance limit should meet the fire protection requirements. Ninth architectural design units should determine the person in charge of fire prevention. The person in charge of fire prevention shall publicize and educate the engineering designers of the unit on the knowledge of building fire prevention design, and be responsible for reviewing and issuing the fire prevention design scheme. The determination or change of the person responsible for fire control shall be filed with the local public security fire control institution. Tenth Hongkong, Macao and foreign design units to design the project, must meet the requirements of China fire technical specifications. If there is no provision in China's fire protection technical code, the design or construction unit must report the fire prevention measures of the project to the local public security fire supervision institution for examination and approval. Eleventh fire design drawings and materials of new construction, expansion and reconstruction projects shall be audited by the person in charge of fire prevention of the design unit and reported to the local public security fire supervision institution for audit. Without the approval of the fire supervision institution, the urban and rural construction management department shall not issue the construction permit. Twelfth construction, design and construction units in the preparation of project funds plan, should include the implementation of fire protection design and the purchase of fire protection equipment. Thirteenth construction units must be in accordance with the approved fire design drawings, are not allowed to arbitrarily change the fire design content. If it is really necessary to change, the changed drawings must be sent to the original approved public security fire control institutions for re-examination. Article 14 The construction unit shall be responsible for fire prevention management on the construction site, with the assistance of the construction unit. If the construction units in Hong Kong and Macao undertake the construction tasks, they shall incorporate the responsibility system for fire control safety into the contract and report to the public security fire control institutions for the record in time. Fifteenth in the project construction, advanced fire prevention and extinguishing equipment should be adopted. When importing fire fighting equipment produced in Hong Kong, Macao or abroad, the relevant materials must be submitted to the public security fire control institutions for examination and approval. Sixteenth when the construction project is completed and accepted, it shall notify the public security fire control institutions to send people to participate. Unqualified items should be rectified. Projects that have not been rectified or failed to pass the rectification shall not be put into use. Seventeenth designers do not design according to the fire code, construction personnel do not carry out construction according to the fire design, and the person in charge of fire prevention does not perform his duties, the relevant departments should give criticism and education or administrative sanctions; If a fire or other serious consequences are caused, the legal responsibilities of relevant personnel shall be investigated according to law. Eighteenth these Provisions shall be interpreted by the Municipal Public Security Bureau. Article 19 These Provisions shall come into force as of the date of promulgation.
