Shanghai Anti-drug Regulations (revised in 2022)

Chapter I General Provisions Article 1 In order to prevent and punish drug crimes, protect citizens' physical and mental health, and maintain social order, these Regulations are formulated in accordance with the Anti-drug Law of People's Republic of China (PRC), the Regulations on Drug Rehabilitation and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to drug control publicity and education, drug control, drug rehabilitation management services and drug control safety work within the administrative area of this Municipality. Article 3 Anti-drug work follows the principle of giving priority to prevention, comprehensive management, prohibition of seeds, drugs, trafficking and smoking at the same time, and implements the working mechanism of unified leadership of the government, respective responsibilities of relevant departments and extensive participation of society. Article 4 This Municipality implements the responsibility system for drug control. People's governments at all levels shall incorporate drug control work into the national economic and social development plan, into the government performance appraisal, and into the spiritual civilization construction of a safe city, and include drug control funds in the fiscal budget at the corresponding level. Article 5 The municipal and district anti-drug committees shall be responsible for organizing, coordinating and guiding the anti-drug work within their respective administrative areas, and specifically perform the following duties:

(1) Formulating drug control plans, plans and policy measures;

(two) to supervise the implementation of the responsibility of drug control work and organize the assessment, and establish a system of accountability;

(3) Organizing the establishment of anti-drug demonstration and the key rectification of anti-drug;

(four) to check the implementation of laws, regulations and policies on drug control;

(five) coordinate and solve major problems in drug control work;

(six) to organize the investigation and study of drug control work and publish the annual drug control report;

(seven) other duties entrusted by the superior anti-drug commission and the people's government at the same level.

The Narcotics Control Committee has an office to undertake the daily work of the Narcotics Control Committee. Article 6 The member units of the Narcotics Control Committee are composed of public security, judicial administration, health, drug supervision and management, emergency management and other departments. Each member unit shall incorporate the drug control work into the work plan and annual plan of the unit and the system, determine the responsible departments, carry out their duties and cooperate closely, and report the drug control work to the Narcotics Control Committee.

The public security organs are responsible for drug investigation, the banning of original plants, the rectification of key problems of drug absorption and trafficking, the investigation and dynamic control of drug users, the supervision and management of precursor chemicals, the management of compulsory isolation drug rehabilitation places in this system, and the leading organization of drug control at ports.

The judicial administrative department is responsible for the management of compulsory isolation drug rehabilitation centers, the education and reform of drug-related criminals, and the organization and promotion of publicity and education on drug control and the rule of law.

The health department is responsible for the supervision and management of drug rehabilitation medical institutions, jointly with the public security and judicial administrative departments to formulate the establishment plan of drug rehabilitation medical institutions, guide and support drug rehabilitation medical services, and organize and guide the prevention and treatment of mental disorders caused by drug abuse.

The drug supervision and administration department is responsible for the supervision and management of narcotic drugs, psychotropic drugs and pharmaceutical precursor chemicals and drug abuse monitoring.

The emergency management department is responsible for the supervision and management of non-pharmaceutical precursor chemicals.

People's courts and people's procuratorates shall perform their statutory duties and punish drug crimes according to law.

Trade unions, the Communist Youth League and women's federations shall, in light of their respective work, organize anti-drug publicity and education, social assistance and voluntary activities. And assist in the relevant drug control work.

Education, civil affairs, finance, agriculture and rural areas, commerce, cultural tourism, radio and television, market supervision and management, human resources and social security, science and technology, transportation, press and publication, postal services, customs, China People's Bank, airports, railways and other members of the Narcotics Control Committee shall, according to their respective functions and duties, do a good job in drug control. Seventh Township People's governments and sub-district offices are responsible for community drug rehabilitation and community rehabilitation, carry out anti-drug publicity and education according to law, and enhance grassroots anti-drug ability.

Villagers' committees and residents' committees shall assist the people's governments and relevant departments in strengthening anti-drug publicity and education and implementing anti-drug preventive measures. Article 8 Drug control is the common responsibility of the whole society. State organs, social organizations, enterprises and institutions, other organizations and citizens shall perform their duties or obligations in drug control according to law.

Relevant trade associations should strengthen self-discipline, establish and improve the self-discipline norms and related management systems for drug control in their own industries, urge their members to implement preventive measures against drug control, and carry out anti-drug publicity and education. Implement necessary self-discipline measures for members who violate relevant regulations.

Mobilize social forces to participate in drug control work. Establish and improve the team of anti-drug social workers and volunteers, and encourage social workers' organizations, volunteer organizations and other units and individuals to participate in drug prevention, publicity and education, scientific research and social services for drug rehabilitation. People's governments at all levels shall provide guidance and training to anti-drug social workers and volunteers and provide necessary working conditions.

Encourage the society to donate to drug control work and give tax incentives according to law. Article 9 This Municipality shall establish a drug control cooperation mechanism with relevant provinces, autonomous regions and municipalities directly under the Central Government. Under the guidance of relevant state departments, carry out international and regional cooperation and exchanges in drug law enforcement, drug research and drug education.

The city promotes the establishment of information exchange, data resource sharing and response and disposal linkage systems with Jiangsu, Zhejiang and Anhui provinces to improve the effectiveness of regional drug control work.
