Provisions on coal mine leaders' taking shifts to go down the well and safety supervision and inspection

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Notice of the State Council Municipality on Further Strengthening the Work Safety of Enterprises (Guo Fa [2010] No.23) and the provisions of relevant laws and administrative regulations in order to implement the system of taking classes to go underground. Article 2 These Provisions shall apply to the supervision and inspection of coal mine leaders who take classes to go down the well and the coal industry management departments, coal mine safety production supervision and management departments of local people's governments at or above the county level (hereinafter referred to as coal industry management departments and coal mine safety supervision departments respectively) and coal mine safety supervision institutions. Article 3 The management department of coal industry is the competent department to implement the system of taking classes to go down the well in coal mines, and is responsible for urging coal mines to do a good job in the construction and implementation of relevant systems.

Coal mine safety supervision departments conduct daily supervision and inspection of coal mine leaders, and make on-the-spot treatment or administrative punishment for violations of coal mine system.

Coal mine safety supervision institutions shall exercise state supervision over coal mine leaders and make on-the-spot treatment or administrative punishment for violations of the coal mine system. Article 4 The term "coal mines" as mentioned in these Provisions refers to coal production mines and construction mines such as new construction, reconstruction, expansion and technical transformation.

The term "coal mine leaders" as mentioned in these Provisions refers to the main person in charge, members of the leading group and deputy chief engineer of the coal mine.

Mine construction leadership refers to the main person in charge, members of the leading group and deputy chief engineer of the construction unit engaged in coal mine construction. Fifth coal mines and construction units (collectively referred to as coal mines, the same below) are responsible for the implementation of the system of taking classes to go down the well. Each shift must have a mine leader to lead the class to go down the well and go down and up the well at the same time with the workers.

The main person in charge of the coal mine is fully responsible for the implementation of the system of taking the class down the well.

Coal mining group companies should strengthen the supervision and inspection of coal mine leaders who take classes down the well. Article 6 Any unit or individual who fails to take the class down the well or practise fraud according to the regulations has the right to report to the coal industry management department, the coal mine safety supervision department and the coal mine safety supervision institution. Chapter II Working with a Class Article 7 Coal mines shall establish and improve the system of working with a class and conduct strict examination. The system of downhole with shift should specify the number of downhole with shift, the number of downhole with shift every month, the working time of downhole, the tasks of downhole with shift, responsibilities and authority, mass supervision, reward and punishment assessment, etc.

The main person in charge of the coal mine shall not be less than 5 times a month.

When a coal mine leader leads a class down the well, the name of his leader shall be publicized in a prominent position at the wellhead. The completion of the monthly work plan of coal mine leaders shall be publicized on the bulletin board of coal mine and accepted by the masses. Article 8 The system of coal mine leaders taking classes to go down the well shall be reported to the local coal industry management department for the record according to the affiliation of coal mines, and copied to the coal mine safety supervision department and the resident coal mine safety supervision institution. Article 9 Coal mine leaders shall perform the following duties when they lead the class down the well:

(a) to strengthen the patrol inspection of key parts and key links, and fully grasp the safety production situation of underground duty;

(two) timely discover and organize the elimination of hidden dangers and dangers of accidents, timely stop violations of discipline, and strictly prohibit illegal command and super-capacity organization of production;

(3) In case of danger, immediately give the order to stop production and evacuate people, and timely and orderly organize the personnel in the danger-related areas to evacuate to a safe place. Tenth coal mine leaders to implement the system of underground succession.

The former class monitor should explain the underground safety situation, existing problems, causes and precautions in detail. Give it to the underground succession leader and fill in the handover record book carefully. Eleventh coal mines should establish a file management system under the leadership of the class.

Coal mine leaders should timely register the time, place, route, problems found, treatment situation, opinions and other related information after lifting the shaft, and the special person shall be responsible for sorting and filing for future reference.

The storage period of relevant records of coal mine leaders and information stored in underground personnel positioning system is not less than one year. Twelfth coal mine workers have the right to refuse to go down without a license. Coal mines shall not reduce the wages, welfare and other benefits of employees or terminate labor contracts concluded with them. Chapter III Supervision and Inspection Article 13 The administrative department in charge of coal industry shall strengthen the daily management, supervision and inspection of the leaders of coal mines with classes. The coal mine safety supervision department should take the establishment and implementation of the system of taking classes under the well as an important part of daily supervision and inspection, and conduct supervision and inspection on the implementation of taking classes under the jurisdiction of coal mines at least once every quarter.

The implementation of coal mine leaders leading the class to go down the well should be announced to the public in the local major media and accept social supervision. Fourteenth coal mine safety supervision institutions shall incorporate the implementation of the coal mine leadership shift system into the annual supervision and law enforcement plan, and carry out special supervision or key supervision at least twice a year.

The situation of special supervision or key supervision of coal mine leaders leading the class to go down the well shall be reported to the coal mine safety supervision institution at the next higher level and notified to the relevant local people's government. Fifteenth coal industry management departments, coal mine safety supervision departments, coal mine safety supervision institutions can supervise and inspect the situation of coal mine leaders leading the class to go down the well. They can randomly ask coal mine employees on the spot, consult the underground hand-over and underground file records, listen to the reflection of coal mine employees, and read the monitoring records of coal mine underground personnel positioning system.
