Measures of Bengbu Municipality on the Administration of Urban Construction Waste

Article 1 In order to strengthen the management of urban construction waste, ensure the city appearance and environmental sanitation, and promote the resource utilization of construction waste, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Provisions on the Administration of Urban Construction Waste and other relevant laws, regulations and rules, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the collection, transportation, transit, backfilling, consumption and utilization of construction waste in urban areas where urbanization management is implemented in this Municipality.

The term "construction waste" as mentioned in these Measures includes construction waste and decoration waste. Construction waste refers to the waste such as waste soil and materials produced in the process of new construction, reconstruction, expansion, repair or demolition of construction projects; Decoration garbage refers to the waste generated in the process of house decoration. Article 3 The disposal of construction waste shall follow the principles of reduction, recycling, innocuity, and whoever produces and bears the responsibility for disposal. Article 4 The municipal administrative law enforcement department of urban management is the administrative department in charge of construction waste in this Municipality, and is responsible for the disposal permit, resource utilization and organization and coordination of construction waste. District urban management administrative law enforcement departments are responsible for the specific work of construction waste management and administrative punishment within their respective jurisdictions.

The relevant administrative departments of development and reform, public security, land, environmental protection, housing construction, transportation, water conservancy, planning, public resources trading and administrative examination and approval supervision shall, according to their respective functions and duties, do a good job in the management of urban construction waste. Article 5 The municipal and district people's governments (the Administrative Committee of the Municipal High-tech Zone and the Administrative Committee of the Municipal Economic Development Zone, the same below) shall strengthen their leadership over the management of construction waste in their respective regions, and include the funds required for the management of construction waste into the financial budget at the corresponding level.

The township (town) people's government, neighborhood offices and community service centers shall, under the guidance of the district urban management administrative law enforcement departments, do a good job in the source management and coordination of construction waste in this area. Article 6 The municipal administrative law enforcement department of urban management shall, jointly with the district governments and the municipal departments of housing, construction, transportation and public security, establish a construction waste management information system, and all units shall, within their respective functions and duties, incorporate relevant information on construction waste management into the information system. Ninth construction waste generating units shall, within 20 days before the start of the project, declare the construction waste disposal plan to the municipal urban management administrative law enforcement department, handle the disposal procedures, and provide the following materials:

(a) construction land planning permit;

(2) Construction waste disposal plan (total amount of construction waste, planned disposal amount, planned construction period of earthwork and disposal site).

If the low-lying land, waste ditch pond, mine pond mouth and tidal flat need to be backfilled, the receiving unit shall, after soliciting the opinions of the water conservancy department, apply to the municipal urban management administrative law enforcement department for handling the disposal procedures. Tenth construction waste generating units shall pay the construction waste disposal fee in accordance with the charging standards approved by the municipal price department when reporting the disposal plan. Eleventh construction waste generating units shall perform the following obligations:

(a) the construction site set up construction waste transportation and disposal of public signs, indicating the name of the transport unit, management requirements, removal approval department, time and complaint telephone number;

(2) Install the vehicle washing video monitoring system at the entrance and exit of the construction site, and access the "digital urban management" management platform;

(3) It is not less than 50 meters away from the entrance and exit of the construction site, with a buffered hardened pavement and standardized washing equipment;

(four) the establishment of vehicle supervision system in and out of the site, leaving the site of the vehicle body and wheels should be washed clean;

(five) the classification of construction waste generated in the construction site, and the construction waste shall not be mixed with domestic waste and hazardous waste;

(six) other duties as prescribed by laws and regulations. Thirteenth construction waste transport units shall apply to the municipal administrative law enforcement department for construction waste disposal permit before transporting construction waste, and shall meet the following conditions:

(a) submit a written application (including the name of the transportation time, route and disposal place of construction waste, and the contract signed between the construction unit and the transportation unit);

(2) It has a plan and road map of the disposal site, corresponding mechanical equipment such as paving, rolling, dust removal and lighting, drainage and fire fighting facilities, a sound environmental sanitation and safety management system and effective implementation;

(3) Having a classified disposal plan for construction waste;

(4) Having a legal road transport business license and vehicle driving license;

(5) It has a sound system for the operation, safety, quality, maintenance and management of transport vehicles, which has been effectively implemented, and a parking lot and washing equipment that meet the needs of vehicle parking;

(six) there are construction waste transport vehicles that meet the requirements of article fourteenth of these measures.

The municipal administrative law enforcement department of urban management shall issue the approval document of construction waste disposal within 3 working days from the date of acceptance; If it is not approved, it shall inform the applicant and explain the reasons.
