Regulations of Beijing Municipality on Soil and Water Conservation (revised on 20 19)

Article 1 In order to prevent soil erosion, strictly protect and rationally utilize soil and water resources, improve the ecological environment of the capital, and build a harmonious and livable city, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Soil and Water Conservation and the actual situation of this Municipality. Article 2 These Regulations shall apply to soil and water conservation activities within the administrative area of this Municipality. Article 3 Soil and water conservation shall adhere to the principles of giving priority to prevention, giving priority to protection, overall planning, comprehensive management, public participation and liability for damage, and adopt economic, technical and management policies and measures to ensure the ecological security of the capital. Article 4 The municipal and district people's governments shall strengthen unified leadership over the work of soil and water conservation, improve the management system of soil and water conservation, implement a strict system of soil and water resources protection, incorporate the work of soil and water conservation into the national economic and social development plan and annual plan at the corresponding level, and organize the implementation of the tasks determined in the soil and water conservation plan.

The city implements the target responsibility system for soil and water conservation and the system of assessment, reward and punishment. The municipal and district people's governments will incorporate the completion of soil and water conservation tasks into the assessment content, and the assessment results will serve as an important basis for assessment and rewards and punishments.

The people's governments of townships and towns and the subdistrict offices shall assist the water administrative department to do a good job in soil and water conservation in this area. Fifth municipal water administrative department is responsible for the city's soil and water conservation work. The district water administrative department shall be responsible for the work of soil and water conservation within its administrative area in accordance with the management authority.

Development and reform, natural resources planning, agriculture and rural areas, landscaping, urban management, ecological environment, housing and urban construction, market supervision and management, finance and other relevant departments shall, according to their respective responsibilities, do a good job in the prevention and control of soil erosion. Article 6 Enterprises, institutions and other producers and operators shall prevent and reduce soil erosion and be responsible for the consequences of soil erosion according to law.

All units and individuals shall fulfill their obligations to protect water and soil resources and prevent soil erosion according to law, and have the right to report acts that destroy water and soil resources and cause soil erosion to the water administrative department. Those who report and verify the facts and provide key clues or evidence for investigating and handling major illegal cases of soil and water conservation shall be rewarded by the water administrative department. Seventh people's governments at all levels in this Municipality shall organize publicity and education activities to protect water and soil resources and prevent soil erosion, popularize relevant scientific knowledge and raise citizens' awareness of soil and water conservation.

Schools should incorporate the knowledge of soil and water conservation into the educational content to enhance students' awareness of soil and water conservation.

The news media should strengthen the publicity of laws and regulations on soil and water conservation and popularize the knowledge of soil and water conservation; Supervise acts violating laws and regulations on soil and water conservation; The municipal news media shall publish and broadcast the propaganda content of soil and water conservation. Article 8 The Municipal People's Government shall establish and improve the cooperation mechanism of soil and water conservation with relevant provinces and cities, promote the coordination of soil and water conservation planning, soil and water conservation policies, measures and technical standards, key projects, supervision and prevention, and gradually realize the sharing of prevention progress and monitoring information, so as to keep pace with the prevention and control of soil erosion. Article 9 The municipal water administrative department shall, jointly with relevant departments, formulate technical standards for soil and water conservation such as prevention and control of soil erosion in production and construction projects, construction of ecological clean small watersheds, and monitoring of soil and water conservation. Tenth municipal water administrative departments shall organize a survey of soil erosion in the whole city every five years, and publish the survey results; If serious soil erosion is caused by major natural disasters, the investigation of soil erosion in relevant areas shall be carried out in time.

The municipal water administrative department shall, jointly with the relevant departments, prepare the city's water and soil conservation plan according to the survey results of soil erosion; The district water administrative department shall, jointly with relevant departments, prepare the water and soil conservation plan of this administrative region according to the city's water and soil conservation plan. After the approval of the people's government at the corresponding level, the water and soil conservation plan shall be announced to the public and implemented by the water administrative department.

Water and soil conservation planning should delimit the functional areas of water and soil conservation, determine the layout of water and soil resources protection objectives and measures, control and binding indicators of water and soil conservation, and clarify the objectives and tasks of water and soil conservation supervision and management, monitoring and ecological clean small watershed construction. Eleventh urban and rural planning, land use planning, main functional area planning, water resources planning and environmental protection planning and other comprehensive planning. The organization department shall make a special demonstration on the prevention and control of soil erosion when preparing the plan.

Planning for infrastructure construction, mineral resources development, urban construction, public service facilities construction, tourism development and construction, etc., the organizing department shall prepare a chapter on soil and water conservation in the planning, put forward countermeasures and measures to prevent soil erosion according to the technical standards of soil and water conservation of the state and this Municipality and the requirements for vertical control of land use, and attach the opinions of the water administrative department when the planning is submitted for approval. Article 12 The municipal and district people's governments shall, according to the needs of soil erosion prevention and control, incorporate rivers, lakes, wetlands, ecological public welfare forests, green belts, public green spaces, country parks, riverside forest parks, greenways, landslide danger areas, debris flow-prone areas, flood storage and detention areas and other areas into the prohibited construction areas and restricted construction areas determined by urban and rural planning for management, and announce the specific scope to the public. Thirteenth it is forbidden to reclaim, graze and plant crops on steep slopes above 25 degrees.

If economic forests are planted on steep slopes above 25 degrees, tree species should be selected scientifically, the scale should be determined reasonably, and soil and water conservation measures such as undergrowth vegetation protection, building terraces and tree trays, water storage and moisture conservation, water-saving irrigation, and controlling the application of chemical fertilizers and pesticides should be taken to prevent soil erosion.

When planting crops on sloping fields with a temperature of more than five degrees and a temperature of less than twenty-five degrees, soil and water conservation measures such as no-tillage, contour tillage and rotation tillage should be taken to control the application of chemical fertilizers and pesticides and prevent soil erosion.

For planting economic forests on steep slopes above 25 degrees, and planting crops on steep slopes above 5 degrees and below 25 degrees, the District People's Government shall take measures to encourage the withdrawal of planting, carry out ecological restoration on the slopes, and give subsidies to the main bodies that have withdrawn from planting. The specific scope shall be delineated and announced by the District People's Government.
