Regulations of Shanxi Province on Classified Management of Municipal Domestic Waste (202 1 Amendment)

Chapter I General Provisions Article 1 In order to strengthen the classified management of municipal solid waste, promote the improvement of urban living environment, raise the level of civilization of the whole society and ensure the sustainable development of economy and society, these provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation and other laws and regulations. Article 2 These Provisions shall apply to the classification of domestic waste and its supervision and management activities in urban built-up areas within the administrative region of this province.

The term "domestic garbage" as mentioned in these Provisions refers to the wastes generated in daily life or activities providing services for daily life, and the solid wastes defined as domestic garbage by laws and regulations. Article 3 The classified management of municipal solid waste shall follow the principles of government promotion, national participation, local conditions, coordinated promotion, education guidance and governance according to law. Article 4 The provincial and municipal people's governments shall strengthen the organization and leadership of municipal solid waste classification, and incorporate it into the national economic and social development plan of their respective administrative regions, and into the assessment of the government's target responsibility system. The funds required for the classification of municipal solid waste shall be included in the fiscal budget at the corresponding level.

Street offices are responsible for the daily management of the organization, publicity and supervision of domestic waste classification within their respective jurisdictions. Fifth provincial housing and urban-rural construction departments are responsible for the supervision and management of the classification of urban domestic waste in the province.

The municipal people's government shall be responsible for the supervision and management of the classification of municipal solid waste, prepare the implementation plan of the classification of municipal solid waste, and organize the implementation after the approval of the people's government at the same level. Sixth provincial development and reform department is responsible for the preparation of the province's urban domestic waste treatment facilities construction and development planning in conjunction with the provincial housing and urban and rural construction departments, and study and formulate policies and measures for the management of urban domestic waste classification fees.

The provincial finance department is responsible for establishing the municipal solid waste classification reward system, urging the provincial housing and urban-rural construction departments to increase investment in the classification of municipal solid waste in the existing special funds, and supervising and managing the implementation.

The Provincial Department of Ecology and Environment is responsible for guiding the construction of hazardous waste disposal facilities in the province and supervising and managing the environmental pollution caused by the disposal of municipal solid waste.

The provincial commerce department is responsible for guiding the construction of the province's renewable resources recovery system.

The provincial education administrative department is responsible for guiding schools at all levels in the province to carry out classified education of municipal solid waste.

Directly under the authority affairs management department is responsible for supervising and guiding the public institutions in the province to carry out the classification of municipal solid waste.

Provincial Civilization Office, Provincial Women's Federation, Communist Youth League Committee and other relevant departments shall do a good job in the classification of municipal solid waste according to their respective responsibilities. Seventh Municipal People's Government, as the main body responsible for the classification of municipal solid waste, shall determine the responsibilities of relevant government departments according to the actual situation, and establish the corresponding comprehensive coordination mechanism. Article 8 The people's governments of provinces and cities shall strengthen the publicity and education on the classification of domestic waste, popularize the knowledge of domestic waste classification, promote the classification of domestic waste in institutions, schools, enterprises, communities, families and hospitals, guide the whole society to develop a green production lifestyle and good behavior habits, and form an atmosphere in which the whole people participate and everyone starts to carry out domestic waste classification. Chapter II Classified Release Article 9 Domestic garbage shall be classified according to recyclables, hazardous wastes, kitchen wastes and other wastes. Bulk garbage and decoration garbage are classified separately.

Recyclable materials refer to articles suitable for recycling and reuse.

Harmful waste refers to the domestic garbage that directly or potentially harms human health and the natural environment.

Kitchen waste refers to food residue, kitchen waste and waste oil produced by catering services, collective catering and other units in the production and operation process and family daily life.

Other garbage refers to the domestic garbage generated in the daily life of units and families except recyclables, harmful waste and kitchen garbage.

Large pieces of garbage refer to discarded furniture and household appliances.

Decoration garbage refers to the waste generated in the process of house decoration.

The specific catalogue of domestic waste classification shall be formulated by the city people's government according to the relevant provisions of the state and combined with the actual situation and announced to the public. Article 10 Units and individuals that produce domestic garbage shall be responsible for the classified delivery of domestic garbage, and shall reduce the output of domestic garbage, fulfill the obligation of classified delivery of domestic garbage, and deliver different kinds of domestic garbage at the specified time, place and manner. Article 11 The system of management responsible person shall be implemented for the classified delivery of domestic garbage. The person in charge of management shall be determined in accordance with the following provisions:

(a) the party and government organs, enterprises and institutions, social organizations and other units of the office, production and business premises, by the unit or its entrusted property services enterprises as the management responsible person;

(two) roads, parks, squares, airports, passenger stations and public places such as tourism, culture, sports, commerce, etc., and the management unit or the property service enterprise entrusted by it is the person in charge of management;

(3) The residential area, the realty service enterprise or the management unit is the person in charge of management.

If the person responsible for management cannot be determined in accordance with the provisions of the preceding paragraph, it shall be managed by the local sub-district office or determined by it. Twelfth people responsible for the management of domestic waste shall perform the following duties:

(a) to establish a daily management system for the classification of domestic waste, announce the time, place and manner of putting domestic waste, and guide and supervise the units and individuals in the area of responsibility to put domestic waste in a classified manner;

(2) Classified domestic garbage shall be collected and transported by units determined by the local government;

(three) to carry out publicity and education on the knowledge of domestic waste classification within the scope of duties.
