Chapter V Legal Responsibility of Hangzhou River Protection and Management Measures

Thirtieth acts that violate the relevant water administrative laws, regulations and rules within the scope of urban river management shall be entrusted by the water administrative department to organize the implementation of administrative punishment in accordance with the conditions stipulated in the Administrative Punishment Law of the People's Republic of China. Approved by the people's government of the State Council or the province, the administrative punishment that belongs to the scope of the relatively centralized administrative punishment right of urban management shall be implemented by the administrative law enforcement organs of urban management.

Article 31 Whoever commits any of the acts specified in Items (2), (3), (4), (5) and (7) of Article 26 of these Measures shall be punished by the urban management administrative law enforcement organ in accordance with the relevant provisions of the Regulations of Hangzhou Municipality on the Administration of Municipal Facilities.

Article 32 In violation of the provisions of Article 20 of these measures, construction projects such as high soil piling, deep foundation pit excavation, piling and blasting are implemented within 20 meters outside the scope of urban river management, and the construction unit fails to send the construction protection scheme to the urban management administrative department for the record, the urban management administrative law enforcement organ shall order it to make corrections and may impose a fine of more than 2,000 yuan in 200 yuan.

Thirty-third one of the following acts, the urban management administrative law enforcement organs shall order it to stop the illegal act, immediately correct, compensate for the losses, and may be punished according to the following provisions:

(1) Those who block, dismantle or move, alter ancillary facilities of rivers and damage communication and lighting facilities without authorization shall be fined from 500 yuan to 2,000 yuan.

(two) unauthorized extraction of water for production and operation from the river, a fine of more than 2000 yuan in 500 yuan.

(III) Cleaning oil containers, spoiled goods, machinery and vehicles that pollute water bodies, and setting up car washing points without authorization to endanger river water bodies, and imposing fines on individuals from 50 yuan to 200 yuan; The unit shall be fined from 500 yuan to 2000 yuan.

(4) Those who wash rivers, bathe, swim and fish in prohibited waters shall be fined below 50 yuan.

(five) hanging or drying articles that hinder the landscape on facilities or buildings such as guardrails, telephone poles, trees and hedges along the river shall be fined in 50 yuan.

(six) in the culvert, the inlet and outlet of the pumping station and other areas where it is forbidden to stop the ship, a fine of 2,000 yuan or more shall be imposed on 500 yuan.

(seven) in the river embankment, water blocking channels, water blocking roads, shipwrecks and other obstacles to the function of flood drainage, non-operating 500 yuan more than 2000 yuan fine; Impose a fine of not less than 5,000 yuan but not more than 50,000 yuan on the merchants.

(eight) the implementation of blasting, sand mining, quarrying, earth borrowing, drilling, piling, drilling wells, digging fish ponds and other acts that affect the stability of river regime and endanger the safety of river banks and dikes, and impose a fine of not less than 2,000 yuan on non-operating acts; Impose a fine of not less than 5,000 yuan from 500 yuan on business activities.

Thirty-fourth in violation of the provisions of these measures, involving other laws, regulations and rules, the relevant administrative departments shall be punished according to law.

Article 35 If the staff of urban management administrative departments, urban river management institutions and other administrative departments neglect their duties, abuse their powers or engage in malpractices for selfish ends, they shall be given administrative sanctions by their units or the competent authorities at higher levels; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
