Measures for the administration of product quality supervision and inspection in chemical industry

Chapter I General Provisions Article 1 In order to strengthen the quality supervision and inspection of chemical products, urge chemical production enterprises to implement product technical standards, and improve the quality and economic benefits of chemical products to meet the needs of socialist modernization and people's life, these measures are formulated in accordance with the relevant provisions of the Trial Measures for Product Quality Supervision approved by the State Council. Article 2 Product quality supervision and inspection is an important measure for quality supervision departments and quality supervision and inspection institutions at all levels to supervise and inspect the product quality of enterprises according to product technical standards, to promote the continuous improvement of enterprise management level and product quality level, and also to safeguard people's economic interests and safety and health. Article 3 The quality supervision and inspection of chemical products shall be under unified leadership and managed at different levels (Ministry, prefecture and enterprise). Competent departments and enterprises at all levels in the chemical industry can set up quality supervision and inspection institutions, equipped with certain professionals, to undertake the task of product quality supervision and inspection of their own departments and units. Chapter II Institutions and Responsibilities Article 4 The Science and Technology Bureau of the Ministry of Chemical Industry is responsible for the centralized management of product quality supervision and inspection in the national chemical industry system, and its main responsibilities are:

1. Implement the national guidelines and policies on product quality supervision and inspection, formulate laws and regulations on product quality supervision and inspection in the chemical industry, organize the preparation of medium-and long-term and annual plans for chemical product quality supervision, and check the implementation of the plans;

2. Unified planning, establishment and centralized management of various professional product quality supervision, inspection and testing centers of the Ministry of Chemical Industry, organization of supervision and inspection network, and development of chemical product quality supervision and inspection;

3 to guide and inspect the quality supervision and inspection of chemical products in charge of the chemical departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government and the chemical bureaus of cities under separate state planning.

4. Supervise and inspect the implementation of product technical standards by enterprises, organize the state and the Ministry to supervise product quality spot checks, and reflect product quality, existing problems and suggestions to relevant departments;

5. Organize the quality inspection and review of national high-quality products, Ministry high-quality products and production license products, and organize product quality certification;

6. Organize arbitration of major product quality disputes;

7. Organize technical exchanges and personnel training for quality supervision and inspection. Article 5 The chemical industry departments (bureaus) of provinces, autonomous regions and municipalities directly under the Central Government and the chemical industry bureaus of cities under separate state planning may set up quality supervision departments, which are staffed with specialized personnel for management. Their main responsibilities are:

1. Carry out the guidelines and policies of higher authorities on product quality supervision and inspection, formulate the management measures for quality supervision and inspection in this region, and prepare the medium, long-term and annual plans for quality supervision in this region.

2. Responsible for the implementation of standards at all levels, organize the inspection of product quality of local chemical enterprises, regularly analyze product quality, put forward opinions and requirements to improve product quality, assist enterprises to solve the material and technical conditions necessary to ensure product quality inspection, and strengthen the management of enterprise quality supervision and inspection institutions.

3. Negotiate with local standardization management departments, set up and manage local chemical product quality supervision, inspection and testing stations, organize pre-examination and review of local high-quality products, implement production license products and product quality certification, and organize regular supervision and inspection of local products.

4. Deal with quality problems and product quality disputes in product quality supervision and inspection in this region.

5. Organize technical exchanges and personnel training for quality supervision and inspection in this region. Article 6 The professional product quality supervision, inspection and testing center of the Ministry of Chemical Industry is a legal monitoring institution authorized by the Ministry of Chemical Industry with a third-party impartial status. In principle, the monitoring center is located in scientific research institutes directly under the Ministry, and the original administrative affiliation remains unchanged. Its quality supervision and inspection business is under the centralized management of the Science and Technology Bureau of the Ministry of Chemical Industry. The specific work shall be carried out in accordance with the provisions of the Administrative Measures of the Product Quality Supervision, Inspection and Testing Center of the Ministry of Chemical Industry. Article 7 Local chemical product quality supervision and inspection stations (hereinafter referred to as quality inspection stations) are local authorized legal inspection institutions and have the impartial status of a third party. In principle, quality inspection stations should be located in local chemical research institutes (institutes). The management measures and tasks of quality inspection stations may be formulated by the local competent department in accordance with the relevant provisions of the local standardization management department and with reference to the management measures of the product quality supervision, inspection and testing center of the Ministry of Chemical Industry. Article 8 The professional product quality monitoring center of the Ministry of Chemical Industry and the local chemical product quality supervision and inspection stations shall strengthen technical guidance and business contacts within the professional scope, cooperate with each other to undertake the task of product quality supervision and inspection, and each local quality inspection station shall form a professional product quality supervision and inspection network after being examined and approved by the monitoring center. Ninth all enterprises (including township enterprises) should set up independent full-time product quality supervision and inspection institutions, led by the factory director. Enterprise quality supervision and inspection institutions not only undertake the inspection tasks in the production process of enterprises, but also supervise the product quality of enterprises on behalf of the national quality supervision department. It is necessary to improve the quality inspection network combining self-inspection, mutual inspection and special inspection, implement a three-level inspection system, and give full play to the supervision and guidance role of inspection work in production. The specific work of enterprise quality supervision and inspection institutions shall be implemented in accordance with the Measures for the Administration of Product Quality Supervision and Inspection of Chemical Production Enterprises.
