Can retail be legal in law?

It is not necessarily legal for shops to sell separately. If the separated shops can declare their property rights independently, it is legal for them to sell separately. They must first file a pre-sale with the local real estate management department and obtain the relevant pre-sale permit.

Article 5 of the Measures for the Administration of Pre-sale of Urban Commercial Housing

The pre-sale of commercial housing shall meet the following conditions:

(a) have paid all the leasing fees for land use rights and obtained the certificate of land use rights;

(2) Holding a construction project planning permit and a construction permit;

(three) according to the calculation of commercial housing provided for pre-sale, the funds invested in development and construction have reached more than 25% of the total investment in engineering construction, and the construction progress and completion delivery date have been determined.

Article 6

The pre-sale of commercial housing is subject to a licensing system. The development enterprise shall apply to the real estate management department for the pre-sale permit and obtain the "Pre-sale Permit for Commercial Housing".

Without obtaining the "pre-sale permit for commercial housing", the pre-sale of commercial housing shall not be carried out.
