Regulations of Xinyang Municipality on the Protection of Traditional Villages
The term "traditional village" as mentioned in these Regulations refers to a village that was formed earlier, has material and intangible cultural heritage, and has high historical, cultural, scientific, artistic, social and economic value, and has been identified by the national and provincial traditional village evaluation department or the Municipal People's Government, and is listed in the national, provincial and municipal traditional village list. Article 3 The protection of traditional villages shall follow the principles of planning first, overall protection, balanced development, government guidance, social participation, villagers' voluntary, local conditions and live transmission. Article 4 The people's governments of cities and counties (districts) shall incorporate the protection of traditional villages into the overall planning of urban and rural construction, increase investment and support for the protection of traditional villages, and establish a coordination mechanism for the protection of traditional villages. Fifth city and county housing and urban construction departments are responsible for guiding and coordinating the protection and development of traditional villages, supervising and managing the construction of traditional villages, and organizing the implementation of these regulations in conjunction with relevant departments.
City and county urban and rural planning departments are responsible for the supervision, management and guidance of traditional village protection and development planning.
City, county (District) cultural (cultural relics) department (hereinafter referred to as the cultural department) is responsible for the supervision, management and guidance of the protection of cultural relics and intangible cultural heritage in traditional villages.
City, county (District) development and reform, public security, finance, land and resources, environmental protection, water conservancy, agriculture, forestry, industry and commerce, transportation, tourism and other departments, according to their respective responsibilities, do a good job in the protection of traditional villages. Article 6 The people's governments of townships (towns) where traditional villages are located shall perform the following duties:
(a) to participate in the preparation and implementation of traditional village protection and development planning;
(two) improve the traditional village infrastructure, public service facilities, rational use of traditional village resources, improve the living environment;
(3) Excavate traditional folk customs, encourage villagers to carry out rural cultural activities according to traditional habits, and protect relevant space places and material carriers;
(four) the implementation of fire safety responsibility;
(five) to guide and urge the villagers' committees to do a good job in the protection of traditional villages. Article 7 The villagers' committee where a traditional village is located shall perform the following duties:
(a) to publicize the relevant laws and regulations on the protection of traditional villages and participate in the formulation of the development plan for the protection of traditional villages;
(two) to guide and urge the villagers to make rational use of traditional buildings in accordance with the requirements of traditional village protection;
(three) to register the traditional buildings in danger of damage, and report to the township (town) people's government in a timely manner;
(four) collect and protect the collapsed and scattered traditional building components, and report to the township (town) people's government in a timely manner;
(five) to discourage violations of traditional village protection regulations, and report to the township (town) people's government in a timely manner. Article 8 The people's governments of cities, counties (districts) and townships (towns) shall organize publicity and education activities on the protection of traditional villages, popularize protection knowledge and enhance the protection awareness of the whole society. Article 9 The protection and utilization of traditional villages should mobilize the enthusiasm of villagers to participate and safeguard their legitimate rights and interests. Chapter II Declaration and Identification Article 10 Establish a municipal list of traditional villages.
Municipal traditional villages shall meet one of the following conditions:
(1) Traditional buildings such as historical buildings, local buildings, cultural relics and historic sites are distributed in contiguous areas or the total amount reaches one third of the total amount of village buildings, which fully reflects the traditional features of a certain historical period;
(two) the village site selection has traditional characteristics and local representation, which is closely related to the use of natural environmental conditions to maintain production and life, reflecting the specific historical and cultural background;
(3) The village pattern clearly reflects the representative traditional culture and traditional production and lifestyle, and the overall pattern of the village is well preserved;
(four) there are relatively rich intangible cultural heritage resources, with distinctive national or regional characteristics, or there are representative projects of intangible cultural heritage at or above the municipal level, and the inheritance form is good, and it is still alive today;
(5) It is rich in red cultural relics or red cultural resources, which can reflect the fighting, production and lifestyle in a specific period. Eleventh villages that meet the conditions stipulated in Article 10 of these regulations shall be applied by the township (town) people's government to the county-level housing and urban-rural construction department, and shall be declared by the county-level housing and urban-rural construction department to the municipal housing and urban-rural construction department after the consent of the county-level people's government. The municipal competent department of housing and urban construction shall, jointly with the municipal urban and rural planning, culture, finance and other departments, organize expert review, report to the Municipal People's government for approval, and publish and include it in the list of traditional villages in Xinyang City.
When the township (town) people's government declares a traditional village, it shall be discussed and agreed by the villagers' group meeting, villagers' meeting or villagers' representative meeting where the traditional village is located. Twelfth housing and urban construction departments shall, in accordance with the relevant provisions of the province and the state, recommend and declare provincial and national traditional villages in the list of traditional villages in Xinyang.
