Chapter 1 General Provisions Article 1 In order to prevent and control air pollution, improve the quality of the atmospheric environment, protect public health, adhere to the harmonious existence of man and nature, promote the construction of ecological civilization, and promote sustainable economic and social development, These regulations are formulated in accordance with the Environmental Protection Law of the People's Republic of China, the Atmospheric Pollution Prevention and Control Law of the People's Republic of China, and other laws and regulations, and in light of the actual situation of this city. Article 2: These regulations apply to the prevention and control of air pollution and its supervision and management within the administrative region of this city. Article 3 Air pollution prevention and control adheres to the principles of planning first, prevention first, combination of prevention and control, regional linkage, public participation, and liability for damage. Article 4 The municipal and district (county) people's governments shall be responsible for the quality of the atmospheric environment within their respective administrative regions, incorporate air pollution prevention and control into the national economic and social development plans, optimize the industrial structure and layout, increase financial investment in air pollution prevention and control, and have Planned control or reduction of total emissions of key air pollutants. Article 5 The Municipal People's Government shall establish a unified and effective supervision and governance system with clear division of labor, and strengthen overall coordination.

The municipal ecological environment department is responsible for the organization, implementation, supervision and management of these regulations. District and county ecological environment authorities shall implement specific supervision and management of air pollution prevention and control within their respective jurisdictions. Municipal and county ecological environment authorities are responsible for releasing atmospheric environment quality information within their respective jurisdictions.

The departments in charge of development and reform, industry and informatization, urban and rural construction, and natural resources planning are responsible for energy structure adjustment, industrial structure adjustment, and industrial layout optimization.

The public security organs and transportation authorities shall supervise and manage motor vehicle exhaust pollution according to their respective responsibilities.

The competent departments of natural resources planning, urban and rural construction, urban management, transportation, housing security, real estate, forestry and grassland shall supervise and manage dust pollution according to their respective responsibilities.

The competent departments of finance, agriculture and rural areas, market supervision, education, health, and meteorology shall coordinate the implementation of these Regulations within the scope of their respective responsibilities.

The township (town) people's governments and sub-district offices (communities) shall supervise the prevention and control of air pollution within their respective jurisdictions. If illegal activities are discovered, they shall promptly report to the competent ecological environment department and cooperate with the investigation and handling.

The industrial park management committee shall supervise and inspect the air pollution prevention and control work in the industrial park and assist relevant government departments in fulfilling their management responsibilities in accordance with the law. Article 6: This city implements an atmospheric environment quality target responsibility system and an assessment and evaluation system. Municipal, district (county) people's governments should use the completion of atmospheric environment protection goals and tasks as part of the assessment of relevant departments at the same level and the people's governments at the next level and their responsible persons. The assessment results should be an important part of the performance assessment of the government and relevant departments and be announced to the public. Article 7 This city advocates civilized, frugal, and low-carbon production and lifestyle.

Governments, enterprises, institutions, social organizations and individuals shall abide by laws and regulations on air pollution prevention and control, fulfill their obligations to protect the atmospheric environment, and participate in atmospheric environment protection work.

Municipal, district (county) people's governments should encourage and support scientific and technological research on air pollution prevention and control, carry out research on the source analysis of major pollutants, and analyze air pollutants such as particulate matter, sulfur dioxide, nitrogen oxides, and volatile organic compounds. Implement coordinated control; strengthen publicity and popularization of atmospheric environmental protection, encourage and support the public to participate in air pollution prevention and control, and encourage social capital to invest in air pollution control.

Education authorities and schools should incorporate air pollution prevention and control knowledge into school education content and cultivate students’ awareness of atmospheric environmental protection.

The news media should carry out publicity on atmospheric environmental protection laws, regulations and scientific knowledge on atmospheric environmental protection, and conduct public opinion supervision of environmental violations. Article 8 The municipal, district (county) people's governments shall establish a hierarchical early warning and response mechanism for heavy pollution weather. When heavily polluted weather occurs, municipal, district (county) people's governments should promptly activate emergency plans. According to different pollution warning levels, early warning information is released to the society and corresponding response measures are taken. Article 9 The municipal, district (county) people's governments shall improve the air pollution reporting system, make the reporting hotlines public, and clarify the acceptance scope and responsibilities of relevant government departments. After receiving a report, the relevant departments shall promptly handle it in accordance with the law and inform the whistleblower of the processing results. If the content of the report is verified to be true, the whistleblower shall be commended or rewarded.

The department that receives the report shall keep the relevant information of the whistleblower confidential.

Article 10 The Municipal People's Government shall strengthen joint prevention and control of air pollution with surrounding states (cities), establish a notification system for major pollution events, gradually realize the sharing of major monitoring information and pollution prevention and control technologies, and promote regional joint prevention, joint control and emergency response. Chapter 2 Management of Air Pollutant Emissions Article 11 Air pollutant emissions shall implement a management system that combines concentration control and total emission control of major air pollutants.

The air pollutants emitted by enterprises, institutions and other producers and operators shall not exceed the emission standards and total emission control indicators of major air pollutants stipulated by the country and the province. Article 12 The municipal and district (county) people's governments shall formulate annual plans and control measures based on the total emission control indicators and reduction indicators of major air pollutants issued by the people's government at the next higher level and in combination with the actual conditions of their respective administrative regions. The total emission control indicators and reduction indicators of major air pollutants will be broken down and implemented to enterprises, institutions and other production operators.
