Regulations of Zigong Municipality on the Administration of Village Planning

Chapter I General Provisions Article 1 In order to strengthen the management of village planning, rationally distribute the ecological space of production and life, promote rural revitalization and promote the integrated development of urban and rural areas, in accordance with the People's Republic of China (PRC) Urban and Rural Planning Law, the Land Administration Law of the People's Republic of China, the People's Republic of China (PRC) Rural Revitalization Promotion Law, the Sichuan Provincial Regulations and other laws and regulations, and in combination with the reality of Zigong City, Article 2 These Regulations are applicable to the formulation, revision and implementation of village planning within the administrative area of this Municipality.

The term "village planning" as mentioned in these Regulations refers to the practical detailed planning of rural areas outside the urban development boundary in the national land spatial planning system.

The formulation, revision and implementation of the planning of historical and cultural villages and traditional villages shall comply with the provisions of relevant laws and regulations in addition to the provisions of these regulations. Article 3 Village planning is the basis for the development and protection of village land space, the control of land space use, the issuance of planning permission for rural construction projects and various construction activities. Article 4 The formulation, revision and implementation of village planning should be scientifically planned, rationally distributed, adapted to local conditions, saving resources, adhering to the dominant position of farmers, giving full play to the role of villagers, respecting the wishes of villagers, historical and cultural traditions, natural and economic ties, respecting the law of urban and rural development, coordinating agricultural space and ecological space, planning before construction, protecting natural features, history and culture, and embodying local and rural characteristics. Article 5 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of village planning management within their respective administrative areas, and guide, supervise and inspect the preparation, approval and implementation of village planning.

County (District) people's government in the overall planning of land space, should take the county as the main unit, scientific division of village-level areas; It is clear that the offices of the township (town) people's government undertake the management responsibilities of village planning and construction, and are equipped with corresponding planning and construction management personnel.

The township (town) people's government is responsible for the management of village planning and construction within its administrative area. Article 6 The competent department of natural resources shall take the lead in guiding, supervising and managing the compilation, revision and implementation of village planning.

The competent department of agriculture and rural areas is responsible for the reform and management of rural homestead.

The competent department of housing and urban construction is responsible for guiding the management of villagers' housing construction.

The water conservancy department is responsible for guiding rural water conservancy work.

Other relevant departments shall be responsible for the relevant work of village planning and management in accordance with their respective responsibilities. Seventh village committees organize and guide villagers to participate in the preparation, implementation and management of village planning, and assist in the construction and management of rural homestead and villagers' houses; Encourage the relevant contents of village planning to be incorporated into village rules and regulations. Eighth any unit or individual has the right to check whether the construction activities meet the requirements of village planning in conjunction with the competent department of natural resources; In violation of village planning, have the right to report or accuse to the township (town) people's government or relevant departments. Ninth county (District) and township (town) people's governments shall include the village planning and management funds in the fiscal budget at the corresponding level, and the Municipal People's government shall give support and subsidies. Tenth township (town) people's government should integrate the villagers' housing planning permission and land use approval service process, establish a "joint review, joint approval, joint office" working mechanism, and implement "one-stop service".

We will implement the rural planner system and the rural homestead coordinator system. Eleventh township (town) people's government shall report to the township (town) people's congress on the formulation, revision, implementation, supervision and inspection of village planning every year, and accept supervision. Chapter II Compilation of Planning Article 12 The compilation of village planning shall meet the following requirements:

(a) obey the superior planning, coordinate with the relevant special planning, and connect with the overall deployment of rural ecological civilization construction;

(two) shall not be in areas protected by law and prone to natural disasters and other uninhabitable areas planning village settlements;

(three) in accordance with the provisions in the village planning reserved construction land mobility index, for the development of villagers' houses, irrigation and water conservancy facilities, transportation infrastructure, public service facilities, public welfare undertakings, rural tourism and leisure, rural new industries and formats;

(4) to implement the requirements of disaster prevention and mitigation in the superior planning or special planning, and put forward the comprehensive disaster prevention and mitigation objectives and the layout of fire prevention and mitigation facilities such as fire fighting, flood control and drainage, geological disaster prevention and earthquake resistance;

(5) Optimize the ecological space such as rural water system, forest network and roads. If the planned project is adjacent to the planning control line of rivers and lakes, railways and highways, communication and electric power, pipeline facilities, etc., it shall make concessions in accordance with the provisions of laws and regulations;

(six) pay attention to the surrounding buildings that reflect the village form, maintain local customs, reflect historical features and local characteristics, and have certain protection value. The newly built or rebuilt buildings should be coordinated with their architectural styles;

(seven) in accordance with the requirements of relevant laws, regulations, policies and norms. Thirteenth village planning shall include the following contents:

(a) analysis of the resources and environment, spatial layout, industrial base, supporting facilities and rural housing construction;

(2) development orientation and population size;

(three) permanent basic farmland control line, ecological protection red line, village construction land boundary;

(four) the layout of agricultural land, agricultural facilities construction land layout, construction land layout and other land layout;

(five) the focus of industrial development, industrial development space, industrial land layout;

(six) public service facilities, road traffic facilities, municipal infrastructure, water conservancy facilities, disaster prevention and mitigation facilities;

(seven) the general layout, architectural design, style orientation and facilities of rural residential areas;

(8) Other planning contents.
