Regulations of Shanghai Municipality on the Protection of Minors (revised on 20 13)

Chapter I General Provisions Article 1 In order to protect the physical and mental health of minors, safeguard their legitimate rights and interests, promote their all-round moral, intellectual and physical development, and cultivate successors with ideals, morality, culture and discipline in the socialist cause, in accordance with the Law of People's Republic of China (PRC) on the Protection of Minors, the Law of People's Republic of China (PRC) on the Prevention of Juvenile Delinquency and other relevant laws and regulations. Article 2 These Regulations shall apply to the protection of citizens under the age of 18 within the administrative area of this Municipality. Article 3 The protection of minors shall follow the following principles:

(a) to protect the legitimate rights and interests of minors;

(2) Respecting the personal dignity of minors;

(three) to adapt to the characteristics of physical and mental development of minors;

(4) Combination of education and protection. Article 4 It is the common responsibility of the whole society to protect the legitimate rights and interests of minors, optimize the environment for their growth and prevent juvenile delinquency. Article 5 The municipal, district and county people's governments shall lead and coordinate the protection of minors within their respective administrative areas, and discuss and decide on major issues concerning the protection of minors.

City, county, township people's governments and sub-district offices shall set up committees for the protection of minors, and do a good job in the protection of minors in accordance with the provisions of laws and regulations and the requirements and arrangements of the people's governments at higher levels. The Committee for the Protection of Minors shall be equipped with necessary staff.

* * * The Communist Youth League, women's federations, trade unions, youth federations, student federations, young pioneers, urban and rural grassroots mass autonomous organizations, the Red Cross and other relevant social organizations shall, according to their respective functions and duties, assist people's governments at all levels to do a good job in the protection of minors. Chapter II Family Protection Article 6 Parents or other guardians shall perform guardianship duties and support obligations for minors according to law, and guarantee the right of minors to receive education; Ensure their necessary material, spiritual and medical conditions; Ensure that minors have enough rest and entertainment time; Concerned about the physiological and psychological changes and ideological and moral conditions of minors of different ages, and giving correct guidance in time; Do not spoil, indulge, abuse or punish minors.

Other adults in the family have the responsibility to assist the parents or other guardians of minors in educating and protecting minors. Seventh parents or other guardians and other adults shall not arrange minors under the age of 12 to take the passenger seat; When carrying a minor under four years old, a family passenger car should be equipped with and use a child safety seat correctly. Eighth parents or other guardians should take good care of minors and avoid leaving preschool children alone. Article 9 Parents or other guardians shall guide minors to develop good study and living habits, encourage and support minors to participate in family labor, social welfare labor and various positive and healthy cultural and sports activities and social communication activities, enhance their self-study, self-care and self-discipline abilities, and promote their healthy physical and mental development. Article 10 Parents or other guardians shall prevent and stop minors from smoking, drinking, wandering, indulging in internet and electronic games; To prevent and stop minors from reading and watching books, newspapers, films and television programs, audio-visual products and electronic publications that are not suitable for minors to read; To prevent and stop minors from gambling, drug abuse, prostitution and other illegal acts; If minors are found to play truant or stay out at night, they should look for them in time; If it is found that minors are deceived, coerced or abetted to commit crimes, it shall promptly report to the public security organ or the institution for the protection of minors.

Parents or other guardians shall educate minors who have bad behaviors and assist relevant departments to correct them. Eleventh parents or other guardians should accept the guidance of schools and family education institutions, learn the correct methods of education and guardianship, and educate, influence and protect minors with healthy thoughts, good words and deeds and correct methods. Chapter III Protection of Schools Article 12 Schools shall fully implement the national education policy, follow the laws of education and the laws of physical and mental development of minors, and improve their ideological and moral, scientific and cultural and health qualities.

Schools should establish a system for the protection of minors and make it clear that a person in charge of the school is responsible for the protection of minors. Article 13 Teachers should abide by professional ethics, influence and educate students with their own good morality, words and deeds, combine imparting knowledge with cultivating sentiment and forming good behavior habits, and guide students to develop morally, intellectually, physically and aesthetically in an all-round way.

Teachers should respect students' personality and safeguard their legitimate rights and interests; No ill-treatment, corporal punishment, corporal punishment in disguised form or other acts that insult personal dignity shall be carried out on students. Fourteenth schools should establish a security system, and non-school personnel are not allowed to enter the school without permission. Canteen, student dormitory, reception room and other places must be equipped with personnel who meet the requirements of the administrative department of education.

If a school uses a school bus, it shall obtain a school bus use license in accordance with state regulations and establish a school bus safety management system. The school bus shall meet the national standards and be driven by qualified drivers. When the school bus carries students, the school should be equipped with on-board caregivers, who should perform their duties according to law to ensure the safety of students taking the school bus.

Schools should provide students with safe study and living facilities. Food, medicine, students' clothing and other articles for study and daily use should meet the relevant standards of the state and this Municipality, and the procurement situation should be made public to parents, students and school staff.

During the period of education and teaching activities, the school shall immediately deal with incidents involving the personal and property safety of students in conjunction with relevant departments in accordance with relevant laws and regulations.
