Article 1. In order to protect public safety, personal and property safety, and prevent and control environmental pollution, in accordance with the "Atmospheric Pollution Prevention and Control Law of the People's Republic of China" and the "Environmental Protection Law of the People's Republic of China" These regulations are formulated in accordance with the provisions of laws and regulations such as the Noise Pollution Prevention and Control Law, the Regulations on the Safety Management of Fireworks and Firecrackers, and in light of the actual situation of this city. Article 2 Within the administrative areas of this city, it is prohibited to set off fireworks and firecrackers in the following areas:
(1) Shinan District, Shinan District, and Licang District;
(2) Laoshan District , Chengyang District, and Huangdao District’s built-up areas. The scope of the built-up area shall be delimited by the district people's government and announced to the public.
The people's governments of other districts (municipalities) other than those stipulated in the preceding paragraph may delineate areas within their jurisdiction where the setting off of fireworks and firecrackers is prohibited and announce it to the public.
If laws and regulations have other provisions on the prohibition of setting off fireworks and firecrackers in special areas such as civil airport clearance areas, those provisions shall prevail. Article 3 Within the administrative area of ??this city, it is prohibited to set off fireworks and firecrackers in the following places:
(1) Government offices;
(2) Cultural relics protection units;
(3) Transportation hubs such as airports, stations, docks, and railway line safety protection zones;
(4) Medical institutions, schools, kindergartens, and rest places for the elderly;
(5 ) Roofs, balconies, stairs, corridors, and windows of buildings;
(6) Woodlands, green spaces and other key fire prevention areas;
(7) Production of flammable and explosive items, Storage units;
(8) Warehouses and bases for storing important flammable materials;
(9) Safety protection zones for power transmission and transformation facilities;
(10) ) other places designated by the district (city) people's government.
In the places listed in the preceding paragraph, the district (municipal) people's government shall organize and set up warning signs prohibiting the setting off of fireworks and firecrackers, and provide safety reminders and precautions. Article 4 It is prohibited to make fireworks and firecrackers within the administrative area of ??this city. Article 5 Fireworks and firecrackers shall not be sold in areas or places where the setting off of fireworks and firecrackers is prohibited.
Outside areas and places where the setting off of fireworks and firecrackers is prohibited, no fireworks and firecrackers such as crackers, throwing crackers, smashing crackers and other dangerous fireworks are allowed to be sold or set off. Article 6 If it is necessary to hold large-scale fireworks display activities due to major public festivals or celebrations, the organizer shall submit an application to the public security organ, and upon approval, the fireworks will be set off at the designated time and place. Article 7 The municipal and district (municipal) people's governments shall strengthen the organization and leadership of the safety management of fireworks and firecrackers, establish a joint meeting system, and coordinate the ban on setting off fireworks and firecrackers.
The public security organs are responsible for the public safety management of fireworks and firecrackers.
The emergency management department is responsible for the supervision and management of the safety production of fireworks and firecrackers.
Urban management, ecological environment, transportation, market supervision, radio and television, meteorological and other departments should do a good job in banning fireworks and firecrackers in accordance with their respective responsibilities.
Sub-district offices and town people’s governments should incorporate the ban on setting off fireworks and firecrackers into grassroots social governance and strengthen organization, coordination, guidance and supervision. Article 8 Residents’ committees, villagers’ committees, and property service companies shall assist relevant departments in the work related to prohibiting the setting off of fireworks and firecrackers, and strengthen publicity, education, and guidance to residents, villagers, and owners. Article 9 The municipal, district (city) people's governments and their relevant departments, sub-district offices, and town people's governments should strengthen publicity work on the prohibition of setting off fireworks and firecrackers.
News media such as radio, television, newspapers, and the Internet should carry out public welfare propaganda and public opinion supervision on the prohibition of setting off fireworks and firecrackers.
Governments, enterprises, institutions and other social organizations should carry out publicity and education on the prohibition of setting off fireworks and firecrackers in their own units and industries.
Schools and guardians of minors should educate minors on the safety knowledge of fireworks and firecrackers and the prohibition of setting off fireworks and firecrackers. Article 10: Any unit or individual who discovers illegal activities involving fireworks and firecrackers has the right to dissuade or report to the public security, urban management, emergency management, market supervision and other departments. If the report is verified to be true, the whistleblower will be rewarded.
The reporting reward measures shall be formulated and announced by the Municipal People's Government.
When hosting banquets and ceremonies, hotels, guesthouses, wedding companies and other units should discourage any behavior that violates these regulations by setting off fireworks and firecrackers; those who do not listen to the dissuasion should report to the public security organs. Article 11 Violate the provisions of Article 2, Article 3, Paragraph 1, and Article 5, Paragraph 2 of these Regulations, set off fireworks and firecrackers in areas or places where the setting off of fireworks and firecrackers is prohibited, or set off crackers, throw down crackers, smash crackers, or Those who set off other dangerous fireworks and firecrackers will be ordered by the public security organs to stop setting off and be fined not less than 300 yuan but not more than 500 yuan; those who set off illegal fireworks and firecrackers during heavy pollution weather will be fined 500 yuan.
Heavy pollution weather is determined and released to the public by the Municipal People's Government based on the early warning reports of the ecological environment and meteorological departments. Article 12 Anyone who illegally produces, sells, transports, carries, or mails fireworks or conducts large-scale fireworks display activities without approval shall be punished by the relevant administrative law enforcement departments in accordance with the Regulations on the Safety Management of Fireworks and Firecrackers.
Confiscated illegal fireworks and discarded fireworks and firecrackers will be destroyed and disposed of by the public security organs. Article 13 Anyone who violates these regulations and constitutes a violation of public security management shall be punished in accordance with the "Public Security Management Punishment Law of the People's Republic of China"; if it constitutes a crime, criminal responsibility shall be investigated in accordance with the law; if it causes personal injury or property loss to others, he shall be punished. Compensation should be made in accordance with the law.
