Chapter 1 General Provisions Article 1 In order to strengthen funeral management, protect and conserve land resources, and promote the construction of socialist material civilization and spiritual civilization, according to the State Council's "Interim Regulations on Funeral Management" and "Guangdong Province Funeral These measures are formulated in light of the actual conditions of our city in accordance with the provisions of laws and regulations such as the "Administrative Measures". Article 2 The task of funeral management is to actively and step by step promote cremation, reform burial, abandon feudal and superstitious funeral customs, and promote civilized and frugal funerals.

Promoting cremation is the direction of funeral reform. Article 3 The city, county (including county-level cities, the same below) and district people's governments are the leading organs for funeral management. They should effectively strengthen leadership, support the competent departments in funeral management, and coordinate public security, industry and commerce, urban management, religion, and health. , construction, land, forestry, planning, finance, overseas Chinese affairs, transportation, labor, social insurance, personnel, news and other relevant departments, mobilize the whole society to promote funeral reform. Article 4 The municipal, county, and district civil affairs departments are the competent departments for funeral and burial management (hereinafter referred to as the competent departments). They implement funeral and burial management work under the leadership of the people's government at the same level. Their main responsibilities are:

( 1) Promote and implement national and provincial laws, regulations, rules and policies on funeral and burial reform, and be responsible for funeral and burial management within the jurisdiction;

(2) Formulate plans and measures for funeral and burial reform;

(3) Lead and manage funeral management offices, funeral parlors, crematoriums, cemeteries and other funeral units;

(4) Work with relevant departments to conduct regular inspections and supervision of funeral management work, and deal with funeral violations Manage prescribed behavior. Article 5: All agencies, groups, military units, enterprises and institutions, and urban and rural grassroots organizations should conduct publicity and education on funeral reforms to personnel in their own units or jurisdictions, and ensure that relevant laws, regulations, and policies on funeral management are implemented. Article 6 Cities and counties should establish and improve funeral and interment management offices (hereinafter referred to as the funeral and interment management departments), and equip them with corresponding personnel to be responsible for the funeral and interment management work in their respective regions. Its responsibilities are:

(1) Inspect and supervise the grassroots implementation of the local people's government's funeral reform measures;

(2) Do a good job in publicity and education on the promotion of cremation and reform of burial. Article 7: Implement a funeral management responsibility system and incorporate it into the term target responsibility system of government leaders at all levels. The municipal competent department should assign funeral management task indicators to each county and district on an annual basis, and from each county and district to each town (street) and each management district (village, residence). Article 8 The municipal and county people's governments should incorporate the construction of funeral facilities (including funeral parlors, crematoriums, cemeteries, etc.) into local economic and social development plans, and arrange land and funds to meet the needs of funeral reform. Chapter 2 Cremation Management Article 9 Crematoriums should be established in Shantou City, Chaoyang City, and Chenghai City to carry out cremation. Article 10 Scope of cremation areas:

The entire urban area of ??Shantou City shall be designated as cremation areas; Chaoyang City and Chenghai City shall demarcate cremation areas in accordance with relevant provincial regulations, and the population of the delineated cremation areas shall be Accounting for more than 70% of the total population of the region. Article 11 All remains in the cremation area shall be cremated. Burial and sale of coffins are prohibited.

If a non-local person dies in Shantou and needs to be transported back to his place of origin for funeral due to special reasons, he should apply for transportation of the body to the county or district competent authority at the place of death with a certificate from the civil affairs department at or above the county level where the deceased's household registration is located. formalities. Article 12 For persons who die in the hospital in the cremation area, the hospital shall promptly notify the funeral management department, and the local funeral parlor will collect and transport the body for cremation. Burial shall not be allowed. Medical institutions should establish a body registration system. If a body needs to be transported, a certificate issued by the city, county, or funeral management department should be provided.

For those who die at home in the cremation area, relatives of the deceased should promptly notify the funeral management department, and the local funeral home will collect and transport the remains for cremation. They are not allowed to collect and bury the remains by themselves. Article 13 When a person dies normally in the cremation area, the cremation of the remains shall be accompanied by a death certificate issued by the unit where the deceased worked or the residents' (village) committee, public security agency or court. Article 14: Bodies that have died of infectious diseases or have decomposed must be disinfected by the health and epidemic prevention department before being cremated immediately; bodies that have died abnormally or are unclaimed must be inspected by the public security organs and issued with certificates before they can be cremated. Article 15 If cremation is not carried out after the death of cadres and employees of enterprises, institutions and foreign-invested enterprises owned by the whole people and collectively in the cremation area, their units and relevant departments shall not pay funeral expenses and one-time pensions to their relatives.

Article 16 The cremated ashes are handled by the bereaved person themselves and can be stored in an ashes hall, ashes wall, or ashes cemetery. They can also be buried in trees and scattered into the sea, but they are not allowed to be buried in graves in areas other than the cemetery. Article 17 In areas with a large number of overseas Chinese in the cremation area, with the consent of the people's government at the same level, and the Shantou Civil Affairs Bureau reporting to the Provincial Department of Civil Affairs for approval, the overseas Chinese cemetery can be planned and constructed in a unified manner to bury the ashes, remains or skeletons of overseas Chinese and compatriots from Hong Kong, Macao and Taiwan. . No unit or individual may build an overseas Chinese cemetery without authorization. Chapter 3 Burial Management Article 18 The entire administrative area of ??Nan'ao County and the areas in each county-level city that are not classified as cremation areas shall be burial reform areas. Burial reform areas should be based on counties, towns or management areas, and cemeteries should be established on barren hills and barren land for centralized burial. Burial in areas other than cemeteries is prohibited.

Existing cemeteries and graves in the city, unless otherwise provided by laws and regulations, will be taken over and renovated by the local funeral management department.
