Chapter I General Provisions Article 1 In order to strengthen river management, ensure flood control safety, improve and protect urban and rural water environment, and give full play to the comprehensive benefits of rivers, these Regulations are formulated in accordance with People's Republic of China (PRC) Water Law, People's Republic of China (PRC) Flood Control Law, People's Republic of China (PRC) River Management Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, regulation, utilization, protection and other related management activities of rivers (including rivers, lakes, artificial waterways and streams) and their supporting projects within the administrative area of this Municipality.

The management of Yongjiang River, Fenghua River and Yuyao River has been stipulated in the Regulations of Ningbo Municipality on the Management of Yongjiang River and Fenghua River, and its provisions shall prevail.

The waterway in the river shall be implemented in accordance with the provisions of the state, province and city on waterway management. Article 3 River management in this Municipality is based on the combination of unified management of water system and regional hierarchical management, and follows the principles of flood control priority, overall planning, comprehensive improvement, rational utilization and active protection. Article 4 The municipal water administrative department is the competent authority of rivers in this Municipality, responsible for the management and supervision of rivers in this Municipality, and implementing the management of rivers directly managed by this Municipality.

County (city) and district water administrative departments are the competent authorities of rivers within their respective administrative areas, and are responsible for the management and supervision of rivers within their respective administrative areas according to their duties and powers.

The town (township) people's government shall be responsible for the river management of the town (township) in accordance with its duties and powers.

On the premise of unified river planning, unified flood control and unified water resources management, with the approval of law, the administrative department of urban management (construction) may exercise some management functions and powers over the urban rivers in this city, and the specific management scope shall be stipulated by the municipal or county (city) and district people's governments.

Transportation, environmental protection, ocean and fishery, land and resources, planning, development planning, agriculture, maritime affairs and other administrative departments. , should cooperate in river management according to their respective responsibilities. Article 5 The municipal water administrative department shall, jointly with relevant departments, put forward a plan to determine the rivers directly managed by this Municipality, which shall be published after being approved by the Municipal People's Government; Rivers managed by counties (cities) and districts and rivers managed by towns (townships) shall be determined by the water administrative departments of counties (cities) and districts jointly with relevant departments, approved and promulgated by the people's governments of counties (cities) and districts, and reported to the water administrative departments of cities for the record.

According to the needs of river management, the water administrative department at a higher level may entrust the water administrative department at a lower level or the town (township) people's government and sub-district offices to carry out daily supervision and management. The entrusting department is responsible for implementing the funds needed for management. Article 6 The municipal, county (city) and district people's governments shall incorporate river regulation into the national economic and social development plan, arrange investment in river regulation, carry out river regulation in a planned way, and give full play to the comprehensive functions of rivers.

The cost of river regulation shall be raised in accordance with the principle of combining government investment with the reasonable burden of beneficiaries. Seventh river flood control and obstacle clearing work to implement the chief executive responsibility system of the people's governments at all levels. Eighth units and individuals that have made remarkable achievements in river regulation and protection shall be commended and rewarded by the city and county (city), the District People's government or the water administrative department. Chapter II Planning and Renovation Article 9 The professional planning of river courses should obey the comprehensive planning of river basins, conform to the flood control and drainage standards stipulated by the state, provinces and cities and other relevant technical regulations, and ensure the water-surface ratio of river networks required for flood control and drainage and the maintenance of regional ecological balance.

Other professional planning involving rivers should be coordinated with the professional planning of rivers. Article 10 The professional planning of the river directly under the municipal government shall be compiled by the municipal water administrative department in conjunction with the departments of development planning, planning, land and resources, and implemented after the approval of the Municipal People's government, and reported to the provincial water administrative department for the record; The professional planning of other rivers shall be compiled by the county (city) and district water administrative department in conjunction with the development plan, planning, land resources and other departments, implemented after the approval of the people's government at the same level, and reported to the municipal water administrative department for the record.

The revision or adjustment of the professional planning of river courses shall be approved by the original approving authority. Eleventh river management scope line should be determined in the river professional planning.

The management scope of the river directly under the municipal government shall be announced by the municipal water administrative department, and boundary markers shall be set up; The management scope of other rivers shall be announced by the county (city) and district water administrative departments, and boundary markers shall be set up. Twelfth river management scope is determined in accordance with the following provisions:

(a) the river with dikes, the scope of management is between the dikes on both sides of the strait (including dikes) and five to ten meters outside the backwater slope foot of dikes;

(two) the river without dikes, and the professional planning of the river has been formulated, and the management scope of the river is the control scope determined by the professional planning of the river; Without professional river planning, the scope of river management is the waters, beaches and flood discharge areas that have reached the highest flood level in history or the designed flood level.

The scope of management and protection of culverts shall be implemented in accordance with the relevant provisions of provinces and cities. Thirteenth city and county (city), the district water administrative department shall, jointly with the relevant departments, formulate the annual plan for river regulation and organize its implementation in accordance with the phased regulation objectives determined by the river professional planning.

The annual plan for river regulation shall specify the responsible units and regulation projects. Emergency measures should be taken to give priority to regulation projects in rivers where siltation seriously affects flood discharge and drainage.

River regulation projects include main projects such as revetment, dike, dredging, sewage interception, widening, bridge demolition and construction, culvert gate setting and other supporting projects such as management and protection facilities, cross-strait greening and ecological landscape construction.
