Chapter I General Provisions Article 1 This Law is formulated in accordance with the Constitution for the purpose of standardizing and strengthening land border work, ensuring the security and stability of land borders and national borders, promoting good-neighborly friendship and exchanges and cooperation between China and its land neighbors, and safeguarding national sovereignty, security and territorial integrity. Article 2 This Law shall apply to the delimitation and demarcation of land borders in People's Republic of China (PRC), the defense, management and construction of land borders and national borders, and international cooperation in land border affairs. Article 3 The land boundary refers to the boundary between the territorial sea and internal water of People's Republic of China (PRC) and its land neighbors. The land boundary vertically divides the airspace and subsoil of the people of China and its land neighbors.

A certain area within the land boundary of People's Republic of China (PRC) is the national boundary. Article 4 The sovereignty and territorial integrity of People's Republic of China (PRC) are inviolable.

The state takes effective measures to resolutely safeguard territorial sovereignty and land border security, and prevent and combat any acts that damage territorial sovereignty and destroy land borders. Article 5 The State exercises unified leadership over land border work. Article 6 The Ministry of Foreign Affairs is responsible for foreign-related affairs of land borders, participates in relevant work of land border management, takes the lead in foreign negotiations, signing contracts, performing contracts and international cooperation, handles problems that need to be solved through diplomatic channels, and organizes the maintenance and management of national borders and boundary markers.

The public security department of the State Council is responsible for the public security work in the border areas, guiding and supervising the border public security organs to strengthen social security management, and preventing and cracking down on illegal and criminal activities in the border areas.

The General Administration of Customs is responsible for the supervision and administration of entry and exit at border ports, and organizes customs supervision and quarantine of inbound and outbound means of transport, goods, articles and personnel according to law.

The national entry-exit administration department is responsible for entry-exit administration in border areas, and organizes and implements entry-exit frontier inspection, border personnel exchange management and border area frontier management according to law.

Other relevant departments of the State Council shall, according to their respective responsibilities, exercise their functions and powers according to law and carry out related work. Article 7 Under the leadership of the Central Military Commission (CMC) (hereinafter referred to as the Central Military Commission), the relevant military organs shall organize, guide and coordinate the land border and border defense control, maintain social stability, handle emergencies, border defense cooperation and related work.

According to their respective tasks, the China People's Liberation Army and the Chinese People's Armed Police Force guard the land border, resist armed aggression, deal with major emergencies and terrorist activities on the land border and the border, cooperate with or assist local authorities to prevent, stop and crack down on illegal cross-border activities, and safeguard the security and stability of the land border and the border. Article 8 The people's congresses at various levels in border provinces and autonomous regions and their standing committees shall ensure the compliance and implementation of laws and regulations on land borders and national borders within their respective administrative areas.

People's governments at all levels in border provinces and autonomous regions shall manage land borders and border work within their respective administrative areas in accordance with laws and regulations. Article 9 The relevant departments and units of the military and land rely on the relevant overall coordination institutions to jointly promote border defense construction, organize border defense control and border infrastructure construction and maintenance, and jointly safeguard the security, stability and normal order of land borders and borders. Article 10 The State shall take effective measures to strengthen border defense construction, support border economic and social development and opening to the outside world, promote the action of strengthening the border and enriching the people, improve the level of border public services and infrastructure construction, improve border production and living conditions, encourage and support border residents to work and live in the border, and promote the coordinated development of border defense construction and border economy and society. Article 11 The State shall strengthen publicity and education on land borders, establish the sense of identity of the Chinese nation, carry forward the Chinese nation's spirit of defending the unity and territorial integrity of the motherland, enhance citizens' awareness of national and territorial security, and build the spiritual home of the Chinese nation.

People's governments at all levels and relevant educational and scientific research institutions should strengthen the collection, protection and research of historical materials related to land boundaries and national boundaries.

Citizens and organizations who discover historical materials, historical sites and objects related to land boundaries and national boundaries shall report them in time or hand them over to the relevant state departments according to law. Article 12 The state guarantees the funds for land border work.

The people's governments at or above the county level in the State Council and the border provinces and autonomous regions shall incorporate the land border and border work into the national economic and social development plan. Thirteenth citizens and organizations should maintain the security and stability of land borders and borders, protect landmark buildings and border defense infrastructure, and cooperate and assist the land border related work.

The state encourages and supports citizens and organizations that cooperate and assist in land border work, and commends and rewards citizens and organizations that have made outstanding contributions in accordance with relevant regulations. Article 14 People's Republic of China (PRC) abides by treaties on land border affairs concluded with foreign countries or jointly acceded to. Article 15 The State adheres to the principle of equality, mutual trust and friendly consultation, handles land border and related affairs with its land neighbors through negotiations, and properly resolves disputes and border issues left over from history. Chapter II Delimitation and Delimitation of Land Boundary Article 16 The State and its land neighbors shall conclude a land boundary delimitation treaty through negotiation, so as to clarify the direction and position of the land boundary.

Treaties that demarcate land boundaries shall be submitted by the State Council to the NPC Standing Committee for approval according to law, and approved by President People's Republic of China (PRC) according to the decision of the NPC Standing Committee.
