Provisions on quality supervision and management of highway and waterway engineering

Chapter I General Provisions Article 1 In order to strengthen the quality supervision and management of highway and waterway engineering and ensure the engineering quality, these provisions are formulated in accordance with the Highway Law of People's Republic of China (PRC), the Port Law of People's Republic of China (PRC), the Waterway Law of People's Republic of China (PRC), the Regulations on Quality Management of Construction Projects and other laws and administrative regulations. Article 2 These Provisions shall apply to the quality supervision and management of highway and waterway engineering. Article 3 The term "highway and waterway engineering" as mentioned in these Provisions refers to the construction projects such as new construction, reconstruction and expansion of highway and waterway infrastructure that have been approved or filed according to law.

The quality of highway and waterway engineering mentioned in these Provisions refers to the comprehensive requirements of laws, regulations, rules, technical standards, approved design documents and engineering contracts for the safety, applicability, economy and aesthetics of highway and waterway engineering construction.

The term "business units" as mentioned in these Provisions refers to units engaged in business activities such as highway and waterway engineering construction, survey, design, construction, supervision, test and detection. Article 4 The Ministry of Transport shall be responsible for the quality supervision and management of national highway and waterway engineering. The Yangtze River Waterway Administration of the Ministry of Transport shall supervise and manage the quality of the Yangtze River trunk waterway project in accordance with the prescribed duties.

The transportation departments of local people's governments at or above the county level shall be responsible for the quality supervision and management of highway and waterway engineering within their respective administrative areas in accordance with the prescribed responsibilities.

The quality supervision and management of highway and waterway engineering can be implemented by the construction engineering quality supervision institution entrusted by the transportation department. Article 5 The competent transportation department shall formulate and improve the quality supervision and management system, policies and measures of highway and waterway engineering, strengthen the quality supervision and management according to law, and improve the quality supervision and management level. Article 6 Encourage and support the popularization and application of new concepts, technologies and methods of quality management in the field of highway and waterway engineering construction. Chapter II Responsibilities and Obligations of Quality Management Article 7 Business units shall establish and improve the project quality assurance system, formulate the quality management system, strengthen the project quality management measures and improve the project quality target assurance mechanism.

The lifelong quality responsibility system is implemented in highway and waterway engineering. Construction, survey, design, construction, supervision and other units shall designate corresponding project leaders and quality leaders in writing. Relevant personnel of business units shall bear corresponding quality responsibilities within the reasonable service life of the project in accordance with national laws, regulations and relevant provisions. Article 8 The construction unit shall be responsible for the project quality management, organize and manage scientifically, implement the provisions of national laws and regulations and mandatory standards for project construction, strictly implement the relevant national project construction management procedures, establish and improve the project management responsibility mechanism, improve the project management system, and strictly implement the quality responsibility system. Article 9 The construction unit shall specify the project quality objectives, quality management responsibilities and requirements in the contracts with survey, design, construction and supervision units, strengthen the contract performance management of key personnel and construction equipment involved in quality, organize quality inspection, and urge relevant units to rectify quality problems in time. Tenth survey and design units shall be responsible for the quality of survey and design, and shall conduct survey and design in accordance with relevant regulations and mandatory standards to ensure the depth and quality of survey and design work. The survey results documents provided by the survey unit shall meet the needs of engineering design. The design unit shall carry out engineering design according to the survey results documents. Eleventh design units should do a good job in design disclosure, design changes and follow-up services in accordance with relevant regulations, ensure the implementation of design intent in construction, and timely deal with quality and technical problems related to design in construction. Article 12 Before the completion and acceptance of highway and waterway engineering, the design unit shall conduct a comprehensive inspection, analysis and evaluation on whether the project construction content meets the design requirements and whether it meets the use function, and issue an evaluation opinion on the conformity of the project design to the construction unit. Thirteenth construction units responsible for the quality of engineering construction, should be set up in accordance with the contract site quality management agencies, equipped with engineering and technical personnel and quality management personnel, the implementation of engineering construction quality responsibility system. Article 14 The construction unit shall carry out the construction in strict accordance with the engineering design drawings, construction technical standards and contract stipulations, and inspect raw materials, mixtures, components, engineering entities, mechanical and electrical equipment, etc. Implement the quality control procedures of team self-inspection, process handover inspection and full-time quality inspector inspection according to regulations; Self-evaluation of sub-projects, sub-projects and unit projects. Those who fail the inspection or self-evaluation shall not enter the next working procedure or put into use. Fifteenth construction units should strengthen the quality control of the construction process, form a complete and traceable construction quality management information, and the hidden parts of the main project should also keep image data. Responsible for rework of quality problems or unqualified projects in construction; For projects with quality problems within the warranty scope and warranty period, the warranty obligations shall be fulfilled. Sixteenth survey, design and construction units shall standardize the subcontracting behavior according to law, and be fully responsible for the project quality undertaken by them, and the subcontracting units shall be responsible for the project quality within the subcontracting scope. Seventeenth supervision units shall supervise the quality of the project, and set up on-site supervision institutions in accordance with the contract, inspect, test and accept the quality of the project in accordance with the prescribed procedures and standards, and promptly urge the rectification of the quality problems found, and shall not lower the quality standards of the project.

Before the completion and acceptance of highway and waterway engineering, the supervision unit shall, in accordance with the requirements of relevant standards and norms, inspect and verify the engineering quality, prepare the engineering quality evaluation or evaluation report, and submit it to the construction unit.
