Party A: xxxxxx Automobile Maintenance Economic & Trade Co., Ltd.
Party B: Dongping Branch of China Pacific Property Insurance Co., Ltd.
In order to better provide quality services to customers, realize resource sharing and complementary advantages, promote the common development of Party A and Party B, and comprehensively enhance the brand value of both parties, the following agreement is reached through friendly negotiation on the basis of equality and mutual benefit.
I. Scope of cooperation
1. During the term of this cooperation agreement, under the condition that Party B provides insurance products and rates, Party A actively uses its own advantages to insure motor vehicles such as operating buses, operating trucks, non-operating vehicles and family cars for Party B in the course of business development. Party B will make use of its own resources to actively guide and recommend all insured motor vehicle customers to Party A for maintenance after they get out of danger, and make it as convenient as possible in procedures and links.
2. Party A and Party B should strive to expand each other's brand awareness in as many occasions and publicity as possible in the spirit of mutually beneficial cooperation. Party A and Party B shall send special customer service managers to contact each other, keep in touch at any time, actively solve problems and promote smooth cooperation between the two parties.
3. Both parties will jointly launch a customer service value-added plan in the form of an attachment according to the cooperation intention and customer demand, and implement it after confirmation by both parties.
Second, the rights and obligations of both parties
1. Party B will do a good job in brand promotion and customer recommendation for Party A in the process of underwriting and claim settlement, so as to ensure the increase in the number of vehicles repaired by Party A in the factory.
2. Party B shall make use of its own operating characteristics to help publicize and introduce Party A's corporate image, maintenance and service quality, and special service items.
3. Party B will fully cooperate with Party A, timely and reasonably verify the maintenance price of the accident vehicle according to the standards determined in the annex, and designate a special person to do the maintenance work and give timely feedback on the work opinions. If the two sides have differences on the price, they should promptly report to the leaders of both sides for coordination. 4. Party B promises to provide preferential rates for the vehicles insured by Party A within the rates stipulated by China Insurance Regulatory Commission. 5. Party B shall provide training on relevant insurance knowledge and skills for Party A's employees, actively provide insurance business consulting services, and give technical support to problems encountered by Party A in specific insurance business.
6. Party A shall provide 24-hour rescue service for Party B's insured vehicles in Dongping County at the request of Party B in case of mechanical accident or other emergency.
7. Party A shall actively assist Party B in determining the loss of the insured vehicle and provide technical and data support to Party B.. When the insured vehicle insured by Party B is repaired by Party A, the loss shall be determined through negotiation within the working hour price standard agreed by both parties. For the items not specified in detail in the original man-hour price, Party A shall be more favorable in terms of man-hour than the same model of similar maintenance manufacturers. When adjusting the working hours standard of automobile maintenance and the price of spare parts, both parties shall promptly notify and obtain the consent of the other party before implementation.
8. When Party A cooperates with Party B to determine the loss items, it shall adhere to the principle of "repair first and then make up". If the damaged parts can continue to be used after repair and can meet the corresponding technical safety requirements, Party A shall advise customers to carry out maintenance and cooperate with Party B to do a good job in customer explanation and persuasion.
9. Party A shall not claim compensation from Party B for accidents and damage items beyond the scope of insurance liability entrusted by the insured, and shall cooperate with Party B to publicize and persuade such cases. At the same time, actively emphasize the importance of first-hand reports to customers.
10. If Party A has any objection to the maintenance price of the accident vehicle, it can raise it with Party B before the maintenance, and Party A and Party B will handle it through friendly negotiation. Before Party B investigates and determines the loss, Party A shall keep the accident vehicle in its original state. Without Party B's consent, Party A shall not dismantle the car and start repairs without authorization, otherwise Party B has the right to refuse compensation or re-check the losses according to regulations.
1 1. Party A shall do a good job in promoting Party B in the enterprise, and promote Party B's business by using the excellent resources and enterprise effects of the enterprise.
12. In order to facilitate the cooperation and exchange of claims between Party A and Party B, Party B has set up a damage assessment center in Party A's work area, and Party A provides Party B with office and office supplies and other related facilities.
Third, claims service.
1. Party B shall provide a 24-hour, 365-day national unified reporting hotline for vehicles insured by Party A. ..
2. After the vehicle insured by Party A's agent is in danger, it shall be reported to Party B's 95500 service hotline, and Party B's survey personnel shall arrive at the site for survey within 30 minutes after receiving the 95500 dispatch.
3. In view of Party B's full trust in Party A's credit standing, Party B has specially set up a green channel to provide faster and more convenient quality insurance services for the vehicles insured by Party A's agent. 1)24-hour claim service provides 24-hour claim service. Whenever the vehicle insured by Party A is in danger, the insured (or driver) only needs to call Party B's hotline 95500 to report the case in time, and Party B's surveyor will rush to the site for investigation within the specified time. 2) One-stop claims service The vehicles insured by Party A will enjoy Party B's "VIP customer" service. If the insured vehicles are in danger, Party B will send a "customer service manager" with rich experience in accident handling to provide full claims tracking service.
4. Once the vehicle insured by Party A has an insurance accident, Party B will recommend the customer to Party A for maintenance, but it cannot interfere with the customer's compulsory maintenance. The choice of the maintenance manufacturer will ultimately be subject to the customer's wishes.
5. In order to strengthen the cooperation between Party A and Party B in claims settlement, after receiving all dispatching information, Party B's surveyors will inform Party A's claims Commissioner of the urgent information of customers as soon as possible, and both parties will jointly do a good job in claims settlement services for customers.
6. When Party A repairs a vehicle with a service station agreement, Party B must verify the loss according to the service station price, and Party A shall also issue a VAT invoice for vehicle maintenance with a service station agreement to Party B. ..
7. During the validity period of the agreement, Party A can make claims for the vehicles in danger with full respect for the wishes of the insured, but the bad customers confirmed by Party B do not enjoy the entrusted claims service. According to Party A's credit status, Party B reserves the final right to cancel this right.
Fourth, the cost settlement
Party A acts as agent for Party B's vehicle insurance business, and the premium is settled on a per-vehicle basis. After checking with Party B, Party A will settle the vehicle insurance premium, or Party A will directly deposit it into the bank account provided by Party B. After the money arrives, Party B will settle the agency fee at the agreed time (written handover procedures are required).
Verb (abbreviation of verb) Alteration, Supplement and Termination of Agreement
1. If there is any change during the performance of this agreement, both parties shall reach a written agreement through negotiation, and the changed or supplemented contents shall have the same effect as this agreement.
2. This agreement shall be implemented as of the date of signing and shall be valid for one year. When the agreement expires, if both parties have no objection, it will be automatically extended for one year. During the execution of this agreement, if one party needs to change or dissolve this agreement, it shall notify the other party one month in advance, and the two parties can only change or dissolve it after reaching a written agreement through consultation, otherwise this agreement will remain valid.
3. Any dispute arising from or related to this Agreement shall be settled by both parties through friendly negotiation.
4. If Party A and Party B unilaterally violate national laws, regulations and this Agreement, the other party has the right to unilaterally terminate this Agreement and reserve the right to pursue legal and economic responsibilities. This Agreement shall automatically terminate as of the date when the breach is confirmed and a written notice of termination is sent to the other party.
5. Without the written consent of the other party, either party shall not inform the third party of all or part of the rights and obligations in this agreement, otherwise the economic losses caused to the other party shall be borne by the breaching party.
6. This agreement is made in duplicate, with legal effect, and each party holds one copy.
