article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of air pollution, the regulations of the State Council on the safety management of fireworks and firecrackers, and other relevant laws and regulations, in order to strengthen the management of fireworks and firecrackers, protect the environment, and ensure the safety of people and property. Article 2 These Regulations shall apply to the discharge management of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership in the management of fireworks and firecrackers, and coordinate major issues in the management of fireworks and firecrackers.

the public security organs of the people's governments of cities and counties (districts) are the competent departments for the management of fireworks and firecrackers.

emergency management, urban management, ecological environment, civil affairs, housing and urban and rural construction, market supervision and management, transportation, meteorology and other departments of the people's government of the city and county (district) shall, according to their respective responsibilities, do a good job in the management of fireworks and firecrackers.

township (town) people's governments and sub-district offices should do a good job in the management of fireworks and firecrackers in their respective areas.

the village (neighborhood) committees shall assist in the management of fireworks and firecrackers. Fourth people's governments at all levels and relevant departments should carry out publicity activities on the management of fireworks and firecrackers.

TV, radio, newspapers, internet and other media should do a good job in the public welfare publicity of the management of fireworks and firecrackers, and increase publicity during major holidays and heavily polluted weather. Fifth schools should educate students to set off fireworks and firecrackers in accordance with the law, civilization and safety. The guardian shall educate and manage the discharge of fireworks and firecrackers by the ward. Article 6 Encourage the research and development of new fireworks and firecrackers with low pollution, low noise and no personal harm, and advocate the use of safe and environmentally-friendly fireworks and firecrackers as substitutes. Article 7 The Municipal People's Government shall, in accordance with the law, determine the areas where fireworks and firecrackers are prohibited and announce them to the public. The county (District) people's government shall, according to the actual situation in this area, determine the time, area and type of prohibiting or restricting the discharge of fireworks and firecrackers according to law, and announce it to the public. Article 8 Fireworks and firecrackers are prohibited in the following places:

(1) Traffic hubs such as railway stations and bus stations and railway line safety protection zones;

(2) supermarkets, shopping malls, bazaars, public cultural and sports venues, public entertainment venues and other crowded places;

(3) state organs, medical institutions, kindergartens, schools, children's welfare homes and homes for the aged;

(4) key fire prevention areas such as forests and meadows, nature reserves and first-class protection areas for drinking water sources;

(5) gas filling stations, bottled liquefied petroleum gas supply stations (points), gas stations, places where inflammable and explosive articles such as grain, oil, cotton and hemp are produced, sold, stored and used, gas pipeline safety protection zones, and places where fireworks are strictly prohibited in factories and mines;

(6) units for the protection and preservation of cultural relics, within the security protection zones of military and power transmission and transformation facilities, and near overhead power and communication facilities and their lines;

(7) Other places where the people's governments of cities and counties (districts) prohibit the discharge of fireworks and firecrackers. Ninth during the heavily polluted weather, the whole administrative area of this Municipality is prohibited from setting off fireworks. The early warning information of heavy pollution weather and the announcement prohibiting the discharge of fireworks and firecrackers shall be released to the public by the Municipal People's Government according to law. Tenth fireworks parties and other large-scale fireworks display activities shall abide by the provisions of relevant laws, regulations and rules. Article 11 Fireworks and firecrackers shall be set off in accordance with the discharge instructions, and the following acts are not allowed:

(1) Projecting or throwing at crowds, buildings, structures and manholes;

(2) obstructing the safety of pedestrians and vehicles and affecting traffic order;

(3) discharge in buildings;

(4) discharge in other ways that endanger the safety of the public and personal and property safety. Twelfth any unit or individual has the right to discourage illegal fireworks or report to the public security organs. After receiving the report, the public security organ shall promptly handle it and give feedback to the informant. Article 13 If public security organs and other departments and their staff abuse their powers, neglect their duties or engage in malpractices for selfish ends in the management of fireworks and firecrackers, the directly responsible person in charge and other directly responsible personnel shall be punished according to law. Article 14 Whoever, in violation of the provisions of this Ordinance, sets off fireworks and firecrackers at a time, area or place where fireworks and firecrackers are prohibited, or sets off fireworks and firecrackers in a way that endangers the safety of the public and personal and property safety, shall be ordered by the public security organ to stop the discharge and be fined between 1 yuan and 5 yuan; If it constitutes a violation of public security administration, it shall be punished according to law. Fifteenth in violation of the provisions of this Ordinance, laws and regulations have been punished, its provisions shall apply. Sixteenth Pingxiang Economic and Technological Development Zone management agencies, Pingxiang Wugongshan scenic area management agencies, in accordance with the provisions of this Ordinance to perform the duties of the people's government at the county level fireworks management. Article 17 These Regulations shall come into force as of September 1, 221.
