Article 1 In order to strengthen the management of setting off fireworks and firecrackers, improve the quality of atmospheric environment, and ensure the safety of the public, people and property, these Measures are formulated in accordance with the provisions of the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 Fireworks and firecrackers are prohibited in the west of the East Outer Ring Road, south of the North Outer Ring Road, east of the 202 Provincial Road (He Sui Road) and north of Wusong Road. In areas outside the area where fireworks and firecrackers are prohibited, the county (district) people's government may, according to the actual situation of their respective administrative areas, determine the time, place and types of fireworks and firecrackers that are prohibited.

If it is really necessary to adjust the area where fireworks and firecrackers are prohibited, it shall be decided by the Municipal People's Government and announced to the public. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership over the management of fireworks and firecrackers, and establish a coordination and guarantee mechanism for the management of fireworks and firecrackers.

The public security organ is the competent department of fireworks management. Safety production supervision and management, urban management comprehensive law enforcement, market supervision and management departments shall, within the scope of their respective duties, do a good job in the management of fireworks and firecrackers.

The town people's government and street offices shall incorporate the management of fireworks and firecrackers into the comprehensive management of social security at the grassroots level, and strengthen organization, coordination, guidance and supervision.

Economic Development Zone shall, in accordance with the provisions of these measures, do a good job in the management of fireworks and firecrackers in this area. Fourth residents' committees, villagers' committees and property service enterprises, hotels, hotels and other units to assist in the management of fireworks and firecrackers, timely discourage violations of fireworks and firecrackers management. If dissuasion is ineffective, it shall report to the public security organ in time. Article 5 People's governments at all levels and their relevant departments shall organize and carry out education on the lawful, civilized and safe discharge of fireworks and firecrackers, and advocate the use of safe and environmentally-friendly alternative products such as electronic firecrackers and fireworks discharge tubes.

Radio, television, newspapers, internet and other media should carry out the management of setting off fireworks and firecrackers and public welfare propaganda to change customs.

Schools and guardians of minors shall educate minors about civilized and safe fireworks and firecrackers. Article 6 Fireworks and firecrackers are prohibited in the following places and areas outside the forbidden zone:

(a) the location of the state organ;

(2) cultural relics protection units;

(3) Medical institutions, kindergartens, schools, nursing homes, libraries, archives, museums, etc. ;

(four) shopping malls, bazaars, public cultural activities, religious activities and other crowded places;

(5) Built-up areas and industrial clusters of economic development zones;

(six) transportation hubs and urban trunk roads, rail transit facilities and railway line safety protection zones;

(seven) within the scope of safety protection of the production, storage and business units of inflammable and explosive goods;

(8) Within the safety protection zone of power transmission and transformation facilities;

(nine) scenic spots, forests, parks, green spaces and nurseries;

(ten) other places and areas where fireworks and firecrackers should be prohibited. Seventh heavy pollution during the weather, the city banned fireworks.

Meteorological, environmental protection and other departments should timely release heavy pollution weather forecast and early warning information through the news media to remind the public not to set off fireworks and firecrackers during this period. Eighth areas and places where fireworks and firecrackers are prohibited, fireworks and firecrackers shall not be set up or sold.

When setting up retail outlets in areas other than the areas where emissions are prohibited, the safety production supervision and management department shall strictly examine and issue them in accordance with the principles of ensuring safety, rational layout, total amount control and gradual reduction; Establish and improve the fireworks business license file management system and information management system; Strengthen the supervision and management of the whole process of business activities. Ninth in the time and area where fireworks are allowed, the following provisions shall be observed:

(a) it is forbidden to set off fireworks and firecrackers in buildings and structures or throw fireworks and firecrackers from balconies and windows;

(two) not to fireworks retail outlets, pedestrians, vehicles, buildings, structures, construction sites, trees, rivers, public green spaces, manhole throwing fireworks;

(three) shall not affect the road traffic safety;

(four) shall not endanger public safety and personal and property safety by other means. Tenth units and individuals are encouraged to report the illegal production of fireworks and firecrackers and the illegal acts of operating, storing, transporting and setting off fireworks and firecrackers.

Public security, safety production supervision and management, urban management comprehensive law enforcement and other departments should establish a reward system for reporting, promptly investigate and deal with reported violations, and feedback the investigation results to informants. Eleventh in violation of the provisions of Article 2, Article 6 and Article 7 of these measures, fireworks are set off in areas, places or time where fireworks are prohibited, and the public security organ shall order it to stop and impose a fine of more than 100 yuan and less than 500 yuan. Twelfth in violation of the provisions of article ninth of these measures, to endanger public safety and personal and property safety of fireworks, the public security organ shall order it to stop the discharge, and impose a fine of more than one hundred yuan to five hundred yuan; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
