Article 1 In order to strengthen the safety management of fireworks and firecrackers, ensure public safety and personal and property safety, and improve the quality of atmospheric environment, these Provisions are formulated in accordance with the provisions of the State Council's Regulations on the Safety Management of Fireworks and Firecrackers, Bengbu City Management Regulations and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the discharge of fireworks and firecrackers and related safety management within the administrative area of this Municipality. Third, it is forbidden to set off fireworks and firecrackers within the scope of Central Road in the urban area, and fireworks and firecrackers are not allowed to be set off at any time in the forbidden area; The area outside the urban forbidden area is a restricted discharge area, and fireworks and firecrackers are prohibited at other times except for the national legal Spring Festival holiday and weddings.

The people's governments of Huaiyuan County, Wuhe County and Guzhen County shall determine and announce the areas where fireworks and firecrackers are prohibited or restricted. Article 4 The Municipal People's Government shall strengthen the management of fireworks and firecrackers in the whole city, establish a leading organization for the safety management of fireworks and firecrackers, and regard the safety management of fireworks and firecrackers as an important part of the creation of civilization and the comprehensive management of social security.

County (District) People's Government (the Administrative Committee of the Municipal High-tech Zone and the Administrative Committee of the Municipal Economic Development Zone, the same below) is responsible for the safety management of fireworks and firecrackers within its jurisdiction, and urges relevant departments to perform their duties of safety management of fireworks and firecrackers according to law.

Township (town) people's governments and street offices shall incorporate the safety management of fireworks and firecrackers into the comprehensive management of grassroots social security, strengthen daily publicity, guidance and supervision, and find and discourage illegal discharge. Article 5 The public security department is the administrative department in charge of the safety management of fireworks and firecrackers. It is responsible for the safety management of fireworks and firecrackers, and investigates and punishes the unauthorized transportation of fireworks and firecrackers and the illegal discharge of fireworks and firecrackers according to law.

The safety production supervision and management department shall be responsible for the supervision and management of the safety production of fireworks and firecrackers, and investigate and deal with the unauthorized production and operation of fireworks and firecrackers according to law.

Urban management administrative law enforcement departments should investigate and deal with mobile sales or occupation of fireworks and firecrackers, as well as the failure to remove fireworks and firecrackers residues in time to destroy environmental sanitation and other acts; Those who find illegal fireworks and firecrackers should be discouraged in time. If dissuasion is ineffective, it shall promptly notify the public security department.

Housing and urban and rural construction, environmental protection, meteorology, civil affairs, transportation, industrial and commercial quality supervision, education and other departments shall, in accordance with their respective responsibilities, do a good job in the safety management of fireworks and firecrackers. Sixth organs, enterprises and institutions, social organizations and other organizations are responsible for the safety management of fireworks and firecrackers in this unit, and should do a good job in the safety management of fireworks and firecrackers in this unit.

Neighborhood (village) committees, owners' committees, property service enterprises, hotels and other units shall promptly discourage the acts of setting off fireworks and firecrackers in violation of regulations in territorial management or service areas; If dissuasion is ineffective, it shall report to the public security department in time.

Neighborhood (village) committees, owners' committees and property service enterprises shall organize residents, villagers, units, hotels and other units in the territorial management or service area to formulate the convention on the safety management of fireworks and firecrackers, and supervise the implementation. Seventh county (District) people's government and its relevant departments, neighborhood (village) committees, enterprises, institutions and social organizations shall regularly organize fireworks safety management publicity, and increase publicity during major festivals.

Radio, television, newspapers, internet and other media should regularly carry out safety management of fireworks and firecrackers and public welfare publicity to change customs.

Schools and guardians of minors shall strengthen education and supervision over the safety of fireworks and firecrackers for students and minors. Eighth in the restricted discharge area, the following places prohibit the discharge of fireworks:

(a) the location of the state organ;

(2) cultural relics protection units;

(three) transportation hubs and urban trunk roads, rail transit facilities and railway line safety protection zones;

(four) within the scope of safety protection of the production, storage and business units of inflammable and explosive goods;

(5) Within the safety protection zone of power transmission and transformation facilities;

(six) enterprises, medical institutions, kindergartens, schools, nursing homes, libraries, archives, museums, etc.;

(seven) scenic spots, forests, parks, green spaces and nurseries;

(eight) shopping malls, bazaars, public cultural places and other crowded places;

(nine) other places where fireworks and firecrackers should be prohibited.

Places that prohibit the discharge of fireworks and firecrackers shall set warning signs that obviously prohibit the discharge of fireworks and firecrackers, and do a good job in safety tips and prevention. Ninth environmental protection and meteorological departments should strengthen environmental and air pollution monitoring, timely release early warning information of heavy air pollution.

When the yellow warning of heavy polluted weather is started, fireworks and firecrackers are prohibited within the administrative area of this Municipality. Tenth in areas and places where fireworks and firecrackers are prohibited, fireworks and firecrackers shall not be set up or sold.

Only short-term retail outlets can be set up in areas where fireworks and firecrackers are restricted, and the safety production supervision and management departments shall conduct examination and approval in accordance with the principles of reasonable layout, total control and gradual reduction. Article 11 If it is really necessary to hold a fireworks party or other large-scale fireworks display activities due to major celebrations and festivals, the organizer shall apply to the public security department for a fireworks display license according to law after obtaining the consent of the people's government of the city or county, and conduct fireworks display operations in accordance with the fireworks display safety regulations and the approved fireworks display operation plan.

The public security department that made the license shall announce to the public the time, place, type, specification and quantity of the license discharge.
