Regulations of Chongqing Municipality on the Administration of Municipal Engineering Facilities

chapter I general provisions article 1 these regulations are formulated in accordance with the relevant provisions of the state for the purpose of strengthening the management of municipal engineering facilities in cities, protecting the integrity of municipal engineering facilities, giving full play to the functions of municipal engineering facilities and promoting the economic and social development of cities. Article 2 These Regulations shall apply to the administration of municipal engineering facilities in Chongqing.

the cities mentioned in these regulations refer to the urban planning areas of Chongqing, county-level cities and established towns. Article 3 The Municipal Urban Construction Bureau is the administrative department in charge of municipal engineering facilities management in the whole city.

the district (city) and county urban and rural construction committees (bureaus) are responsible for the management of municipal engineering facilities within their respective administrative areas according to the division of labor.

planning, public security, transportation, industry and commerce, construction management, environmental protection, landscape and other departments should cooperate with the administrative department of municipal engineering facilities according to their respective responsibilities, and do a good job in the management of municipal engineering facilities. Fourth municipal engineering facilities management should adhere to the principle of unified planning, supporting construction, construction and maintenance management. Fifth all units and individuals have the right and obligation to use and protect municipal engineering facilities according to law, and have the right to advise and report violations of these regulations.

Chapter II Planning and Construction Management of Municipal Engineering Facilities Article 6 The administrative department in charge of municipal engineering facilities shall, in accordance with the needs of urban economic and social development and the requirements of the overall urban planning, work out professional plans and annual implementation plans for the construction of municipal engineering facilities in conjunction with relevant departments, and organize their implementation after approval. Article 7 The professional planning and annual implementation plan for the construction of urban public facilities such as water supply, power supply, gas supply, fire protection, flood control and communication shall be coordinated with the professional planning and annual implementation plan for the construction of municipal engineering facilities, and the corresponding departments shall be responsible for organizing the implementation after comprehensive and balanced approval by the planning authorities. Article 8 In the development of new urban areas and the reconstruction of old urban areas, the municipal engineering facilities construction projects determined in urban planning must be included in the comprehensive development plan and supported by construction.

Article 12 If municipal engineering facilities invested by social units and built by urban comprehensive development and construction units according to the requirements of urban planning need to be handed over to the administrative department of municipal engineering facilities, they shall be reported to the administrative department of municipal engineering facilities for examination and acceptance and go through the handover procedures. If it is not handed over, the property right unit of the municipal engineering facilities shall be responsible for maintenance, repair and management in accordance with the provisions of these regulations, and accept the management supervision of the administrative department of municipal engineering facilities. Chapter III Management of Urban Road Facilities Article 13 The municipal engineering facilities management department and the public security traffic management department shall work closely together to strengthen the management of urban roads, strictly control the temporary occupation and excavation of urban roads, and ensure the sound road facilities and smooth and safe traffic. Fourteenth municipal engineering facilities management departments in accordance with the division of responsibilities, responsible for the maintenance of urban road facilities under their respective jurisdiction.

all kinds of manhole covers and box covers located on urban roads shall conform to the construction and maintenance norms and ensure safety. In case of loss, damage or impact on the safety of vehicles and pedestrians, the unit responsible for maintenance shall immediately take safety protection measures and supplement or repair them as soon as possible. Article 16 When carrying out maintenance and construction of urban roads, the repair period shall be specified, and the main roads in busy areas shall be constructed at night to avoid the peak traffic hours.

if the traffic is affected by the construction site, the maintenance unit shall, jointly with the public security traffic management department, take measures to maintain traffic order. If it is temporarily impassable, it shall issue a notice in advance. Article 17 The following acts are prohibited on urban roads:

(1) Unauthorized occupation and excavation of roads;

(2) conducting various operations that damage road facilities without authorization;

(3) setting up stalls and markets on the roads without authorization;

(4) driving iron-wheeled vehicles, tracked vehicles and over-limit vehicles without authorization;

(5) parking and driving non-motor vehicles and motor vehicles on the sidewalk;

(6) Parking, car washing and commissioning on non-designated road sections;

(7) posting or hanging slogans and advertisements on road facilities without authorization;

(8) building various buildings (structures) without authorization;

(9) discharging sewage, dumping garbage (dregs) and spilling other solid and fluid substances;

(1) other behaviors that damage road facilities and hinder traffic safety.
