Measures of Baotou Municipality on the Administration of Outdoor Advertising and Plaques

Chapter I General Provisions Article 1 In order to strengthen the management of outdoor advertisements and plaques in cities and create a clean and tidy city environment, these measures are formulated in accordance with the State Council's Regulations on the Administration of City Appearance and Environmental Sanitation, Baotou's Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, combined with the actual situation of our city. Article 2 In Kunming District, Qingshan District, Donghe District, Jiuyuan District (hereinafter referred to as the four districts of the city) and Rare Earth High-tech Industrial Development Zone, outdoor advertising, plaque setting and related management activities shall abide by these measures. Article 3 The term "outdoor advertising" as mentioned in these Measures refers to the act of using the external space of public buildings, self-owned buildings, vehicles and other facilities or outdoor venues and facilities to set up advertisements for the purpose of publishing commercial and public service advertisements. Specifically including:

(a) the use of outdoor venues, roads, bridges, light poles, tunnels, underground passages and other municipal facilities and buildings (structures) to set up exhibition boards, electronic display devices, light projection devices, neon lights, physical models, painted canvases, public advertising columns and other advertising facilities;

(two) the use of the building (structure) facade or the top of the building to set up signs, neon lights, transparent three-dimensional figures and other signs advertising behavior;

(3) Using airports, passenger stations, railway stations, light rail stations, subway stations, bus shelters and other stations, as well as newsstands, telephone booths, road name brands, etc. to set up advertising facilities such as display boards, electronic display devices and painting canvases;

(4) Drawing, posting and hanging advertisements by means of transportation, floating objects on water, lift-off equipment, inflation and other facilities;

(five) the use of fences or enclosures to draw and post advertisements;

The measures referred to in plaque setting, refers to enterprises, institutions, other organizations and individual industrial and commercial households, using their own or leased buildings (structures) and other facilities to set up the registered name, font size and logo of the unit. Fourth outdoor advertising and plaque settings follow the principles of unified planning, zoning control, rational layout and standardized setting.

The right to set up outdoor advertisements and the right to use facilities are obtained through market-oriented methods such as bidding, auction and agreement transfer. Article 5 The municipal administrative law enforcement department of urban management is responsible for the management of outdoor advertisements and plaques in four districts and rare earth high-tech industrial development zones in the city.

The municipal administrative department of urban and rural planning is responsible for the organization, compilation, implementation and management of outdoor advertising and plaque setting planning.

The urban management administrative law enforcement departments of the four districts and rare earth high-tech industrial development zones in the city (hereinafter referred to as the district urban management administrative law enforcement departments) are responsible for the management of plaque and temporary advertising settings within their respective jurisdictions according to their functions and powers, and accept the supervision of the municipal urban management administrative law enforcement departments in business.

Development and reform, public security, finance, construction, transportation, industry and commerce departments shall, in accordance with their respective functions and powers, do a good job in the management of outdoor advertising and plaque setting. Chapter II Layout Planning Article 6 The municipal administrative department of urban and rural planning shall, jointly with the municipal administrative law enforcement department of urban management, organize the preparation of special plans for outdoor advertising and plaque setting, which shall be implemented after being approved by the Municipal People's Government.

The preparation of special planning for outdoor advertising and plaque setting shall solicit the opinions of public security, finance, construction, transportation, industry and commerce and other relevant functional departments in advance, and listen to the opinions of experts, industry associations and the public through hearings, argumentation meetings and symposiums.

Outdoor advertising and plaque set up special planning approved by the Municipal People's government, no unit or individual shall be allowed to adjust; Special circumstances really need to be adjusted, should be carried out according to the original set of special planning approval procedures. Article 7 The special planning for outdoor advertising and plaque setting shall conform to the requirements of the overall urban planning and urban appearance standards, and be connected with the special planning of related industries. Article 8 After the special plan for outdoor advertising and plaque setting is approved and published, the municipal administrative department of urban and rural planning shall make it public on its government website for free access by the public. Ninth outdoor advertising and plaque setting special planning includes the following contents:

(a) the principles, types and general technical standards of outdoor advertising and plaque setting;

(two) the total amount of outdoor advertising, zoning planning, important nodes and characteristics of the control requirements;

(three) to determine the road sections, areas and planning guidelines that allow or prohibit the installation of outdoor advertisements;

(four) the overall management requirements for the implementation of the plan. Tenth any of the following circumstances, shall not set up outdoor advertising:

Using traffic safety facilities and traffic signs;

(two) affect the use of municipal public facilities, traffic safety facilities, traffic signs or hinder the safe sight distance and the passage of vehicles and pedestrians;

(three) the use of street trees or the occupation of green space, which is detrimental to the greening landscape;

(four) state organs, cultural relics protection units, excellent modern buildings and building control zones in scenic spots;

(five) the use of windows in various office buildings and apartments;
