Chapter 1 General Provisions Article 1 In order to standardize the management of domestic waste, improve the living environment of urban and rural residents, and promote the construction of ecological civilization, in accordance with the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste" and "Urban "City Appearance and Environmental Sanitation Management Regulations" and other relevant laws and regulations are formulated based on the actual situation of this city. Article 2 These regulations apply to the cleaning, classification, placement, collection, transportation, disposal and related supervision and management of urban and rural domestic waste within the administrative area of ????this city.

Domestic waste as mentioned in these regulations refers to solid waste generated in daily life or activities that provide services for daily life, and solid waste that is regarded as domestic waste according to laws and regulations.

If laws, regulations and rules already provide for the management of solid waste such as hazardous waste, medical waste, discarded electrical and electronic products, construction waste, such provisions shall prevail. Article 3 Domestic waste is divided into the following four categories:

(1) Recyclables refer to items suitable for recovery and recycling;

(2) Organic and perishable Garbage refers to organic and perishable materials such as catering waste, household kitchen waste and discarded vegetables, fruits, flowers and trees;

(3) Hazardous waste refers to the direct impact on human health and the natural environment. Or potentially harmful substances;

(4) Other garbage refers to domestic garbage other than the first three items. Article 4 Domestic waste management shall follow the principles of government leadership, public participation, urban and rural coordination, and territorial responsibility, implement a mandatory classification system of classified placement, collection, transportation, and disposal, and gradually realize the reduction, resource utilization, and disposal of domestic waste. harmless. Article 5 The municipal and county (city, district) people's governments shall coordinate the management of urban and rural domestic waste in their respective administrative regions, incorporate domestic waste management into the national economic and social development plans at the same level, clarify the goals of domestic waste disposal, and implement the clean-up of domestic waste. , classification, placement, collection, transportation and disposal safeguard measures.

Township people's governments and sub-district offices are responsible for organizing and implementing the daily management of domestic waste within their jurisdictions, carrying out publicity, education and training on the reduction and classification of domestic waste, and guiding village (resident) committees to organize and implement daily life management work. Garbage sorting and collection, etc. Article 6: The competent environmental sanitation departments of the municipal and county (city, district) people's governments are responsible for the supervision and guidance of domestic waste management, as well as the supervision and management of domestic waste cleaning, classification, release, collection, transportation, and disposal.

Other relevant departments shall coordinate the management of domestic waste in accordance with the following responsibilities:

(1) The development and reform department shall be responsible for incorporating the construction of domestic waste treatment facilities into the national economic and social development plan , and do a good job in the project approval and other work of facility projects such as domestic waste classification, collection, transportation and disposal;

(2) The urban and rural planning department is responsible for incorporating relevant contents of the special plan for domestic waste management into this administrative region Urban and rural planning, and do a good job in the planning and reservation of relevant land;

(3) The competent department of housing and urban and rural development is responsible for the classification and collection of domestic waste, the construction of disposal equipment and facilities, etc., and supervises property service enterprises and construction Provide guidance on the implementation of domestic waste classification by project construction units;

(4) The land and resources department is responsible for ensuring the land for the construction of domestic waste classification and treatment facilities;

(5) Commercial Supervisor The department is responsible for promoting the construction of a recycling system for recyclables, formulating and publishing recycling specifications and standards to the public;

(6) The industrial and commercial administration department is responsible for providing plastics to supermarkets, shopping malls, bazaars and other retail venues. Supervision and management of shopping bags;

(7) The environmental protection department is responsible for the centralized transfer of domestic waste and supervision and management of pollutant emissions from terminal treatment facilities;

(8) The traffic management department of the public security organ is responsible for reviewing and determining the driving routes, times and road traffic safety of domestic waste transport vehicles;

(9) The education department is responsible for popularizing the knowledge of domestic waste reduction and classification in primary and secondary schools and kindergartens Publicity and other work;

(10) The financial department is responsible for formulating financial policies to support urban and rural domestic waste management and implementing funding guarantees;

(11) Transportation, Departments such as water affairs, agriculture, culture, radio, television and news shall do a good job in domestic waste management in accordance with laws, regulations, rules and the responsibilities determined by the people's government at the same level. Article 7: If the responsibilities related to environmental sanitation management and law enforcement are transferred to the urban management and comprehensive law enforcement departments according to the requirements of functional transformation and institutional reform, the original competent departments will no longer exercise them.

The administrative penalties stipulated in these Regulations and the administrative enforcement measures related to administrative penalties shall be implemented collectively by the urban management and comprehensive law enforcement departments in the field of comprehensive law enforcement. Article 8 The municipal and county (city, district) people's governments shall establish and improve a joint meeting system attended by relevant departments such as environmental sanitation, environmental protection, housing and urban-rural development, and commerce to coordinate and resolve major issues in domestic waste management within their respective administrative regions. . Article 9 The village (resident) committee shall organize, guide and supervise the cleaning, classification, and collection of domestic waste in the village (community), and assist the people's government and relevant departments in the management of domestic waste. Article 10: Units and individuals should consciously abide by the regulations on the reduction and classification of domestic waste, and do a good job in cleaning, classifying and placing domestic waste.

City and county (city, district) people's governments should formulate relevant incentive measures based on local realities, and guide and promote units and individuals to actively participate in the reduction and classification of domestic waste.
