Measures of Fuzhou Municipality on the Administration of Underground Hot Water (Hot Springs)

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Water Law of People's Republic of China (PRC) and relevant laws and regulations, combined with the actual situation of this Municipality, in order to effectively protect and rationally develop and utilize the underground hot water resources in Fuzhou (hereinafter referred to as hot springs) and meet the needs of the national economy and people's lives. Article 2 All units and individuals who explore, develop and utilize hot springs in Fuzhou urban area and carry out construction and construction in hot spring protection areas must abide by these measures. Article 3 The term "hot springs" as mentioned in these Measures refers to groundwater with a certain amount of heat. Hot springs belong to the country. No unit or individual may occupy, destroy or waste hot springs.

The legitimate rights and interests of hot spring exploration, development, utilization and operation are protected by law. It is forbidden to illegally buy, sell, lease or transfer the mining right, use right and management right of hot springs in other forms, and the mining right, use right and management right shall not be used as collateral. Article 4 The development and utilization of hot springs shall follow the principles of unified planning, unified management, unified supply and paid use. Fifth municipal water administrative department is the competent department of groundwater resources, responsible for the unified planning and coordination of hot springs, and guide the protection of hot springs.

Fuzhou city construction administrative department is the competent department of hot spring development and utilization (hereinafter referred to as the municipal hot spring department), responsible for the unified management of hot spring protection and development and utilization.

The municipal department of geology and mineral resources is responsible for the general survey and exploration of hot springs, participating in the formulation of long-term protection, development and utilization plans of hot springs in our city, verifying and controlling the total amount of exploitation, and supervising the rational development and utilization of hot springs.

Water conservancy, urban construction, geology and mineral resources departments should take their respective responsibilities and cooperate with each other to ensure the implementation of these measures. Article 6 Units and individuals that have made remarkable achievements in hot spring exploration, protection, scientific and technological research and economical utilization shall be commended and rewarded by the Fuzhou Municipal People's Government. Chap II exploration, development and utilization article 7 units engage in hot spring exploration (hereinafter referred to as exploration units) shall conduct exploration in accordance with that overall urban plan of Fuzhou City, obtain the consent of the competent department of urban planning administration, go through the registration formalities with the mineral resources exploration management authority and obtain the exploration license. If the exploration project is changed, it shall go through the formalities again. Article 8 Exploration units and departments of geology and mineral resources shall, in accordance with the provisions of the state, provide hot spring exploration reports and relevant technical data necessary for the planning, development, utilization, management and protection of hot springs that have been recognized and approved by the relevant departments of the state or province. According to the situation of resource exploration and the principle of rational development and utilization, the boundaries of hot spring exploitation are approved. Article 9 The municipal water administrative department shall organize urban construction, geology and mineral resources, scientific research and other departments to formulate a plan for the protection, development and utilization of hot springs in Fuzhou city according to the overall urban planning and the plan for the development and utilization of groundwater in Fuzhou, and implement it after being approved by the Fuzhou Municipal People's Government.

The development and utilization of hot springs should be based on the needs of urban people's lives, taking into account agriculture, industry, scientific research and other uses.

The development and utilization of underground hot water and low-temperature hot water at the edge of underground cold water in hot spring protection areas should also be planned as a whole, managed in a unified way and rationally utilized. Tenth development and utilization of hot springs, we must adjust measures to local conditions, adopt reasonable technology, improve the quality of sinking, and take insulation measures to improve the utilization value of hot springs. Eleventh units and individuals using hot springs must plan and save water. Pay the hot spring exploitation fee and resource fee, and if it is not paid within the time limit, the late payment fee will be increased.

Hot spring exploitation fee and resource fee shall be collected by the municipal hot spring department, which shall be used for special purposes, incorporated into the municipal financial supervision and management, and audited regularly. The hot spring exploitation fee and resource fee shall be used exclusively for the protection and management of hot springs and the construction of hot spring facilities, and shall not be used for other purposes. The twelfth hot spring is a franchise. Except for the hot spring water plant approved by Fuzhou Municipal People's Government, no other unit or individual may operate hot springs in any form. Chapter III Management and Protection Article 13 All units and individuals who build, rebuild, expand and maintain hot spring wells (including cold water wells in first-class hot spring protection zones), lay hot spring pipelines, build thermal insulation and water storage facilities, and carry out construction activities related to the development and utilization of hot springs shall provide the approval documents and design technical data of relevant departments, and can start construction only after obtaining the construction permit with the approval of the municipal hot spring department. After completion, the municipal hot spring department shall, jointly with other departments. Fourteenth hot spring well drilling construction units must hold the "hot spring well construction permit" issued by the municipal hot spring department, and those without a license may not drill. During drilling construction, the construction supervision of the municipal hot spring department and relevant departments must be accepted. Fifteenth units and individuals to explore and use hot springs, after the completion of construction, must carry out the following work:

(a) according to the relevant requirements will be useless hot spring well backfill or properly handle;

(two) the long observation wells reserved by exploration units shall be recorded and reported to the competent department of hot springs for the record;

(3) Restoration of vegetation in the construction area or land reclamation and utilization;

(four) to eliminate the unsafe hidden dangers left by the construction;

(5) Do a good job of environmental protection in the construction area. Sixteenth units or individuals that develop and utilize hot springs shall apply to the competent department of hot springs in the city for the "Hot Springs Access Certificate". The municipal hot spring department shall, according to the hot spring protection, development and utilization plan approved by the municipal competent department of geology and mineral resources and control the total amount of exploitation, examine and issue the Hot Spring Access Certificate, and submit the certificate to the municipal water administrative department and the competent department of geology and mineral resources for the record.

City Department of Geology and mineral resources that the "hot spring access card" issued improperly, should put forward written rectification opinions, the city department in charge of hot springs should be re-examined, found that there is an error, should revoke the issued "hot spring access card".
