Measures of Hubei Province for Implementing the Flood Control Law of People's Republic of China (PRC)

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Flood Control Law of People's Republic of China (PRC) (hereinafter referred to as the "Flood Control Law") and in light of the actual situation of this province in order to prevent and mitigate floods, ensure the safety of people's lives and property, and ensure the smooth progress of socialist modernization. Second engaged in flood control activities within the territory of this province, must abide by the "Flood Control Law" and these measures.

The term "flood control" as mentioned in these Measures refers to various activities to prevent or mitigate flood disasters according to their characteristics. Article 3 Flood control work shall follow the principles of overall planning, overall consideration, tackling both the symptoms and root causes, and comprehensive management; Adhere to the principle of simultaneous storage and release, focusing on release. Article 4 All units and individuals have the obligation to protect flood control engineering facilities and participate in flood control and flood fighting according to law. Article 5 People's governments at all levels shall exercise unified leadership and be fully responsible for flood control work within their respective administrative areas.

People's governments at all levels shall organize relevant departments to educate the masses on flood control, popularize flood control knowledge and raise their awareness of flood control; Organize relevant forces and rely on scientific and technological progress to establish and improve flood control systems and hydrological, meteorological, communication, information remote control, early warning and flood disaster monitoring systems; Harness rivers and lakes in a planned way, build flood control projects, and consolidate and improve flood control capacity; Strengthen the maintenance and management of flood control works to ensure safety. Article 6 The chief executive of the people's governments at all levels shall be responsible for flood control and flood fighting, with unified command and responsibility at different levels.

The water administrative department of the people's government at or above the county level (including the county level, the same below), under the leadership of the people's government at the corresponding level, is responsible for the organization, coordination, supervision and guidance of flood control and flood fighting within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, under the leadership of the people's governments at the corresponding levels, be responsible for flood control and flood fighting in accordance with the division of responsibilities for flood control. Entrusted by the water administrative department, the professional institutions of flood control projects and the water conservancy project management institutions across administrative regions under the water administrative department at or above the county level shall exercise their responsibilities of flood control coordination, supervision and management within their jurisdiction according to law. Article 7 People's governments at or above the county level shall set up flood control and flood fighting headquarters composed of responsible persons of relevant departments, provincial military regions or military divisions, and people's armed forces departments. Under the leadership of the flood control headquarters at a higher level and the people's government at the same level, lead the flood control and flood fighting work within their respective administrative areas, and their offices are located in the water administrative departments at the same level. During the flood season, township people's governments, enterprises and institutions may set up temporary flood control headquarters according to the needs of flood control and flood fighting. Eighth units and individuals that have made remarkable achievements in flood control and flood fighting shall be commended and rewarded. Chapter II Flood Control Planning and Management of Flood Control Engineering Facilities Article 9 The flood control planning of the Yangtze River in this province must conform to the flood control planning of the Yangtze River basin approved by the State Council.

Flood control planning of Hanjiang River, Dongjing River, Fuhuan River, hanbei river River, Zhang Ju River, Qingjiang River, qu shui River, Fushui River, Changhu Lake, Honghu Lake, Liangzi Lake, Xiliang Lake and Diaocha Lake. Prepared by the provincial administrative department in conjunction with relevant departments and regions and submitted to the provincial people's government for approval.

Flood control planning or regional flood control planning for other small and medium-sized rivers and lakes shall be compiled by the local water administrative department at or above the county level in conjunction with relevant departments and regions on the basis of comprehensive river basin planning and regional comprehensive planning, and submitted to the people's government at the same level for approval and to the water administrative department at the next higher level for the record.

Urban flood control planning shall be compiled by the water administrative department and other relevant departments of the people's government of the city according to the flood control planning of the river basin, and shall be incorporated into the overall urban planning after examination and approval according to regulations. Tenth the province's waterlogging control planning shall be formulated by the provincial administrative department.

The people's governments in waterlogging-prone areas shall, according to the province's waterlogging control planning, formulate waterlogging control planning in their respective administrative areas.

Urban waterlogging control planning shall be formulated by the relevant departments of the Municipal People's Government and incorporated into the overall urban planning. Eleventh river regulation and control, guide the flow direction of the river, protect the river bank construction, should take into account the relationship between the upstream and downstream and the left and right banks, in accordance with the river regulation plan, and shall not arbitrarily change the flow direction of the river.

The planning and management of the Yangtze River in this province shall be implemented in accordance with the planning approved by the water administrative department of the State Council.

The planning control lines of Hanjiang River, Dongjing River, Fuhuan River, hanbei river River, Zhang Ju River, Qingjiang River, qu shui River and Fushui River shall be drawn up by the provincial water administrative department to organize relevant localities and departments and submitted to the provincial people's government for approval. The planning control line of other small and medium-sized rivers shall be drawn up by the water administrative department at or above the county level and submitted to the people's government at the same level for approval. Article 12 The flood control management of rivers and lakes shall follow the principle of unified management according to water system and graded management according to regions, strengthen protection and ensure smooth flood discharge.

The reach of the Yangtze River within the territory of this province shall be managed by the provincial water administrative department in accordance with the scope designated by the water administrative department of the State Council.

Other rivers and lakes shall be managed by the water administrative department at or above the county level in accordance with the scope designated by the provincial water administrative department.

Rivers and lakes with dikes, the management scope covers waters, sandbars, beaches, flood discharge areas and dikes, forbidden mining areas, engineering reserved areas, rivers and lakes without dikes, and the management scope covers waters, sandbars, beaches and flood discharge areas where the historical highest water level or design flood level has reached.

The management scope of other water projects shall be designated by the people's governments at or above the county level.
