Regulations of Shanghai Municipality on the Prevention and Control of Air Pollution (revised 20 18)

Chapter I General Provisions Article 1 In order to prevent and control air pollution, improve the quality of the atmospheric environment in this Municipality, safeguard public health, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC) and the Law on the Prevention and Control of Air Pollution of People's Republic of China (PRC), combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of air pollution within the administrative area of this Municipality. Article 3 The prevention and control of air pollution is the common responsibility of the whole society.

The prevention and control of air pollution in this city follows the principles of people-oriented, prevention first, combination of prevention and control, * * co-governance, regional linkage and self-responsibility for damage. Article 4 People's governments at all levels in this Municipality shall strengthen their leadership over atmospheric environmental protection, incorporate atmospheric environmental protection into national economic and social development plans, rationally plan and adjust urban and rural development and industrial layout, ensure the investment of environmental protection funds, take effective measures to prevent and control atmospheric pollution, strengthen ecological construction and governance, and protect and improve the atmospheric environment. Article 5 The municipal administrative department of ecological environment shall exercise unified supervision and management over the prevention and control of air pollution in this Municipality, and shall be responsible for organizing the implementation of these Regulations. The competent administrative department of ecological environment of the district shall implement specific supervision and management on the prevention and control of air pollution within its jurisdiction.

Municipal and district development and reform, economic informatization, planning and resource management departments and traffic administrative departments are responsible for energy structure adjustment, industrial structure adjustment, industrial layout optimization and transportation structure adjustment.

The municipal and district administrative departments of public security, transportation, market supervision and management, construction and maritime affairs shall, according to their respective functions and duties, supervise and manage the air pollution caused by motor vehicles, ships and non-road mobile machinery.

City, district construction, greening, transportation, housing management and other administrative departments in accordance with their respective responsibilities, the implementation of supervision and management of atmospheric dust pollution.

City, district finance, agriculture, education, health, urban management and law enforcement, meteorology and other departments shall cooperate in the implementation of these regulations within the scope of their respective duties. Article 6 Township people's governments and sub-district offices may, under the guidance of the district ecological and environmental departments, coordinate the prevention and control of air pollution in community supporting service units such as catering, auto repair, hardware processing and dry cleaning within their respective jurisdictions.

For disputes arising from the discharge of air pollutants by units specified in the preceding paragraph, the parties may apply to the people's governments of townships and towns or street offices for mediation. Article 7 This Municipality implements the target responsibility system and assessment system for atmospheric environmental protection. The municipal and district people's governments shall take the completion of the objectives and tasks of atmospheric environmental protection as the content of the assessment of the relevant departments at the same level and the people's governments at the next level and their responsible persons. The assessment results should be regarded as an important part of the performance assessment of the government and relevant departments, and announced to the public. Article 8 Units and individuals that discharge pollutants into the atmosphere shall strengthen internal management, improve environmental management systems and adopt advanced production and control technologies to prevent and reduce atmospheric environmental pollution; Those who cause atmospheric environmental pollution shall bear legal responsibility according to law. Article 9 This Municipality encourages and supports the development of industries related to atmospheric environmental protection, and encourages social capital to invest in the field of air pollution prevention and control. Article 10 This Municipality encourages scientific and technological research, international and regional cooperation and exchanges in the prevention and control of air pollution, encourages the development and utilization of clean energy, and promotes advanced clean energy technologies and air pollution prevention and control technologies. Article 11 This Municipality advocates civilized, economical and green consumption and lifestyle.

Enterprises, institutions, social organizations and individuals shall abide by the laws and regulations on the prevention and control of atmospheric pollution, fulfill their obligations to protect the atmospheric environment, and participate in the work of atmospheric environmental protection.

People's governments at all levels and their relevant departments should strengthen publicity, popularize scientific knowledge of atmospheric environmental protection, and create a good atmosphere for protecting the atmospheric environment. The administrative department of education should gradually promote environmental education, incorporate the knowledge of atmospheric environmental protection into school education, and cultivate young people's awareness of atmospheric environmental protection. Twelfth within the administrative area of this Municipality, any unit or individual has the right to report acts that pollute the atmospheric environment, as well as acts that the competent department of ecological environment and other relevant administrative departments and their staff do not perform their duties according to law.

The municipal competent department of ecological environment shall publish the unified telephone number of the whole city and handle the report in a timely manner. If the clues are verified, the ecological environment department shall reward the informants in accordance with the relevant provisions.

The news media of this Municipality shall publicize the laws and regulations on atmospheric environmental protection and the scientific knowledge of atmospheric environmental protection, and supervise the illegal acts by public opinion. Thirteenth units and individuals that have made outstanding achievements in the prevention and control of air pollution, protection and improvement of the atmospheric environment shall be commended and rewarded by the municipal or district people's government. Chapter II Supervision and Administration of Prevention and Control of Air Pollution Article 14 The municipal ecological and environmental department shall, jointly with relevant departments, organize the preparation of the prevention and control plan of air pollution in this Municipality, and organize its implementation after the approval of the Municipal People's Government.

The people's government of a city shall formulate plans and phased targets for achieving the atmospheric environmental quality standards, and take strict measures for the prevention and control of atmospheric pollution to ensure that the city meets the national atmospheric environmental quality standards within the prescribed time limit. Fifteenth this city in accordance with the provisions of the state designated atmospheric environmental quality functional zones. The municipal competent department of ecological environment shall, according to the requirements of the overall urban planning, environmental protection planning objectives and atmospheric environmental quality functional zones, put forward the key remediation areas of air pollution in this Municipality and their remediation objectives, division of responsibilities and plans for reaching the standards within a time limit, and implement them after being approved by the Municipal People's Government.
