What can't be planted in permanent basic farmland

Strictly observing the red line of cultivated land protection and ensuring food security are major strategic issues related to China's national economic development, social stability and national security. I. Relevant laws and regulations

Planting poplar and other tree species in permanent basic farmland is a serious violation of national laws and regulations.

1. Article 37 of the Land Management Law stipulates that it is forbidden to occupy cultivated land to build kilns and graves, or to build houses, dig sand, quarry, mine or borrow soil on cultivated land without authorization. It is forbidden to occupy permanent basic farmland to develop forestry and fruit industry and dig ponds to raise fish.

2. Article 51 of the Regulations for the Implementation of the Land Management Law stipulates that in violation of the provisions of Article 37 of the Land Management Law, those who illegally occupy permanent basic farmland to develop forestry and fruit industry or dig ponds to raise fish shall be ordered by the competent natural resources department of the people's government at or above the county level to make corrections within a time limit; If no correction is made within the time limit, a fine of more than 2 times and less than 5 times the cultivated land reclamation fee shall be imposed according to the occupied area. (The current implementation standard of cultivated land reclamation fee is 60,000 yuan/mu, and the fine is 1.2-0.3 million yuan/mu)

Second, the job requirements

1. It is forbidden for any unit or individual to plant poplars and other trees in permanent basic farmland. If the villagers illegally occupy permanent basic farmland, please clean up and restore the planting conditions on their own from the date of promulgation of this notice. Any act of destroying permanent basic farmland will be severely punished according to relevant laws and regulations.

2. Establish a long-term mechanism, incorporate it into grid management, and compact responsibilities step by step. Villages will prohibit planting trees in permanent basic farmland into village rules and regulations, strengthen villagers' autonomy, and completely prohibit planting poplar and other trees in permanent basic farmland.

3 departments, communities and villages should strengthen daily inspections and supervision, and stop planting poplar and other trees in permanent basic farmland in time.
