Interim Provisions of Shanghai Municipality on Prohibiting posting, scribbling and portraying in disorder

In order to maintain a clean and tidy city appearance and environment, and to stop posting, scribbling and portraying indiscriminately, these Provisions are formulated in accordance with the relevant provisions of the Regulations on the Administration of City Appearance and Environmental Sanitation and the actual situation of this Municipality. Article 2 (Organization and Executive Body)

These Provisions shall be organized and implemented by the Shanghai Municipal Administration Committee Office (hereinafter referred to as the Municipal Political Commissar Office). Article 3 (General Provisions)

All units and individuals should consciously maintain the cleanliness of buildings, structures, trees and other facilities, and have the right to stop and report acts that damage their cleanliness. Article 4 (Posting, scribbling and drawing are prohibited)

Sporadic posters should be posted in a fixed public poster column according to law.

Posting other publicity materials except sporadic posters or graffiti slogans on buildings, structures, trees and other facilities shall be carried out within the specified time and geographical scope with the approval of the municipal, district (county) urban management department, and timely removal shall be done.

Except as stipulated in the first and second paragraphs of this article, posting and scribbling on buildings, structures, trees and other facilities are prohibited.

It is forbidden to depict on buildings, structures, trees and other facilities. Article 5 (Obligations of Administrative Organs)

City, district (county) urban management departments should strengthen the management of disorderly posting, scribbling and portraying.

Sub-district offices and Town People's governments shall choose appropriate places in streets and residential areas, set up public welfare posters and strengthen management.

In case of posting, scribbling or scribbling stains in the area of civil strife, the municipal, district (county) urban management department and the street monitoring team shall trace the violator and deal with it according to law; If it is difficult to find the offender at the moment, it should be cleaned up. Article 6 (Rights and Obligations of Relevant Units)

All units shall keep the buildings, structures, trees and other facilities used and managed clean and tidy. In the above buildings, structures, trees and other facilities chaos posting, scribbling, depicting, have the right to ask the actor to clear in time, compensation for losses; If it is difficult to find the perpetrators at the moment, they should be removed first. Article 7 (Administrative Punishment)

In violation of the provisions of article fourth, the city, district (county) urban management department may order it to be cleared, and shall be punished in accordance with the following provisions:

(a) posted, graffiti, each warning or fine 10 yuan;

(two) graffiti, according to each 20 yuan shall be given a warning or a fine. Article 8 (Punishment Power of Street Monitoring Team)

The street monitoring team has the right to impose administrative punishment on the disorderly posting, scribbling and portraying of blocks, alleys and residential areas in accordance with these Provisions, but the punishment authority shall not exceed the provisions of the Interim Provisions of Shanghai Municipality on Street Supervision and Punishment. Article 9 (Standards for Relocation Expenses)

Violators who fail to clean up the disorderly posting, scribbling or scribbling stains within the time limit can be removed by the city, district (county) city management department and the street monitoring team on their behalf, and ordered to pay the removal fee.

The cost of demolition is calculated according to the standard of posting, scribbling, depicting each place 10 yuan and depicting each place's 20 yuan; However, if the demolition cost is obviously higher than the prescribed standard, it shall be calculated according to the actual cost.

If the relevant units organize the removal or remove it on their behalf, they may require the violator to pay the removal fee according to the standards stipulated in the preceding paragraph. Article 10 (Punishment Procedure)

City, district (county) urban management department or street monitoring team shall give administrative punishment in accordance with the provisions, and shall make a decision on administrative punishment.

City, district (county) urban management department or street monitoring team shall inform the parties of the facts, reasons and basis for making the decision on administrative punishment before making the decision; If the violator announces the number of his communication tool in the act of posting, scribbling or doodling, he can inform him to accept the treatment at the designated time and place through his communication tool. If he fails to accept the treatment within the time limit, he can suspend the use of his communication tool.

The time limit for suspending the use of communication tools shall not exceed 30 days at a time. During the suspension of the use of communication tools, if the parties accept the treatment, they shall resume the use of communication tools in time. Article 11 (Suspension of Communication Tools)

According to Article 10 of these Provisions, if the violator suspends the use of communication tools, after investigation and evidence collection by the district (county) urban management department or the street monitoring team, it shall be reported to the municipal political commissar office for examination and decision, and the municipal political commissar office shall notify the relevant telecom business enterprises in writing to suspend the use of the communication tools.

The municipal administrative department of posts and telecommunications shall supervise the relevant telecommunications enterprises to cooperate with the implementation of these Provisions, and the municipal administrative department of posts and telecommunications shall punish the telecommunications enterprises that refuse to cooperate with the implementation in accordance with the relevant provisions. Article 12 (Reconsideration and Litigation)

If a party refuses to accept a specific administrative act made by the city, district (county) urban management department or the street monitoring team, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Regulations on Administrative Reconsideration and the Administrative Procedure Law of the People's Republic of China.

If the party concerned does not apply for reconsideration, bring a lawsuit or perform a specific administrative act within the statutory time limit, the city appearance management department or the street monitoring team that made the specific administrative act may apply to the people's court for compulsory execution in accordance with the provisions of the Administrative Procedure Law of the People's Republic of China.
