The constitutive conditions of accident (1) behavior objectively caused damage results; (2) The result of subjective damage caused by the actor to his own behavior is neither intentional nor fault; (3) The damage result is caused by irresistible or unforeseeable reasons. In this case, melon farmers used pesticides, but neighbors stole melons, resulting in two deaths and one injury. But the melon farmers didn't want to poison anyone, so they didn't say intentionally or negligently subjectively. Everyone didn't expect neighbors to steal melons under the condition of marking, which was unpredictable. So it was an accident, and the melon farmers were not responsible.
