2022 New Criminal Law Regulations on the Crime of Dangerous Driving

The penalty for dangerous driving is imprisonment and a fine. According to Article 22 of the Eighth Amendment to the Criminal Law and Article 133-1 of the Criminal Law: “Whoever drives a motor vehicle to chase or race on the road in a serious manner, or drives a motor vehicle drunk on the road , shall be sentenced to criminal detention and shall also be fined. If the conduct in the preceding paragraph also constitutes other crimes, he shall be convicted and punished in accordance with the provisions of the Criminal Law of the People's Republic of China and the People's Republic of China. One is revised to read: "Anyone who drives a motor vehicle on the road and falls under any of the following circumstances shall be sentenced to criminal detention and shall also be fined: (1) Pursuing and racing, if the circumstances are egregious; (2) Driving a motor vehicle while drunk; (3) Engaging in School bus business or passenger transportation seriously exceeds the rated passenger capacity, or seriously exceeds the prescribed speed; (4) Transporting hazardous chemicals in violation of the safety management regulations of hazardous chemicals, endangering the safety of the owner and management of the motor vehicle. If a person is directly responsible for the conduct in Item 3 or 4 of the preceding paragraph, he shall be punished in accordance with the provisions of the preceding paragraph. If the conduct in the preceding two paragraphs also constitutes other crimes, he shall be convicted and punished in accordance with the provisions of the People's Republic of China. ***Article 133 of the Criminal Law of the People's Republic of China stipulates that the crime of dangerous driving refers to driving a motor vehicle on the road: chasing and racing, the circumstances are serious; driving a motor vehicle while drunk; engaging in school bus business or passenger transport, serious Carrying more passengers than the quota, or driving at a speed seriously exceeding the prescribed limit; transporting hazardous chemicals in violation of the safety management regulations for hazardous chemicals and endangering public safety.
