Chapter 1 General Provisions Article 1 In order to strengthen urban gas management, ensure gas supply, prevent and reduce gas safety accidents, protect citizens’ lives, property safety and public safety, and protect gas operators and gas To protect the legitimate rights and interests of users and promote the healthy development of the gas industry, these regulations are formulated. Article 2 These regulations shall apply to urban gas development planning and emergency support, gas operations and services, gas use, gas facility protection, gas safety accident prevention and handling, and related management activities.

This regulation does not apply to the production and import of natural gas and liquefied petroleum gas, the transmission of natural gas pipelines outside city gate stations, the use of gas as raw materials for industrial production, and the production and use of biogas and straw gas.

The term “gas” as mentioned in these Regulations refers to gaseous fuels used as fuel and meeting certain requirements, including natural gas (including coalbed methane), liquefied petroleum gas and artificial coal gas, etc. Article 3: Gas work shall adhere to the principles of overall planning, ensuring safety, ensuring supply, standardizing services, and energy conservation and efficiency. Article 4 People’s governments at or above the county level shall strengthen leadership over gas work and incorporate gas work into national economic and social development plans. Article 5: The construction administrative department of the State Council is responsible for the national gas management work.

The gas management departments of local people's governments at or above the county level are responsible for the gas management within their own administrative regions.

Other relevant departments of the people's governments at or above the county level shall be responsible for relevant gas management work within the scope of their respective responsibilities in accordance with the provisions of these Regulations and other relevant laws and regulations. Article 6: The state encourages and supports gas science and technology research and promotes the use of new gas technologies, new processes and new products that are safe, energy-saving, efficient and environmentally friendly. Article 7 Relevant departments of the people's governments at or above the county level shall establish and improve the gas safety supervision and management system, publicize and popularize gas laws, regulations and safety knowledge, and improve the public's awareness of gas safety. Chapter 2 Gas Development Planning and Emergency Support Article 8 The construction administrative department of the State Council shall, in conjunction with relevant departments of the State Council, based on the national economic and social development plan, overall land use plan, urban and rural planning, and energy planning, combined with the total balance of national gas resources, Organize the preparation of the national gas development plan and organize its implementation.

The gas management department of the local people's government at or above the county level shall, in conjunction with relevant departments, organize the preparation of this document based on the national economic and social development plan, overall land use plan, urban and rural planning, energy planning and the gas development plan at the next level. The gas development plan of an administrative region shall be organized and implemented after being submitted to the people's government at the corresponding level for approval, and shall be reported to the gas management department of the people's government at the next higher level for record. Article 9 The content of the gas development plan shall include: gas source, gas type, gas supply method and scale, gas facility layout and construction sequence, gas facility construction land, gas facility protection scope, gas supply guarantee measures and safety guarantee measures, etc. . Article 10 Local people's governments at or above the county level shall increase investment in the construction of gas facilities in accordance with the requirements of the gas development plan and encourage social funds to invest in the construction of gas facilities. Article 11 When carrying out the construction of new areas and the renovation of old areas, supporting gas facilities shall be constructed or land reserved for the construction of gas facilities in accordance with urban and rural planning and gas development planning.

For gas facility construction projects within the scope of the gas development plan, when issuing site selection opinions in accordance with the law, the urban and rural planning authorities shall seek the opinions of the gas management department on whether the gas facility construction complies with the gas development plan; not If it is necessary to issue a site selection opinion letter, the urban and rural planning authorities shall seek the opinions of the gas management department on whether the construction of gas facilities complies with the gas development plan when issuing a construction land planning license or a rural construction planning license in accordance with the law.

After the gas facility construction project is completed, the construction unit shall organize completion acceptance in accordance with the law, and report the completion acceptance to the gas management department for record within 15 days from the date of passing the completion acceptance. Article 12 Local people's governments at or above the county level shall establish and improve a gas emergency reserve system, organize the preparation of gas emergency plans, and take comprehensive measures to improve gas emergency support capabilities.

The gas emergency plan should specify the gas emergency gas source and type, emergency supply method, emergency response procedures, emergency rescue measures, etc.

The gas management departments of local people's governments at or above the county level shall work with relevant departments to monitor, predict and provide early warning on gas supply and demand.

Article 13 After the occurrence of serious gas supply shortages, supply interruptions and other emergencies, local people's governments at or above the county level shall promptly take emergency measures such as mobilization of reserves and emergency dispatch. Gas operators and other relevant units and individuals shall cooperate and bear the responsibility. related emergency tasks. Chapter 3 Gas Operations and Services Article 14 For gas facilities invested and constructed by the government, gas operators shall be selected through bidding.

For gas facilities invested and constructed by social funds, investors can operate them themselves or choose another gas operator. Article 15 The state implements a licensing system for gas operations. Enterprises engaged in gas business activities should meet the following conditions:

(1) Meet the requirements of the gas development plan;

(2) Have gas sources and gas facilities that meet national standards;

(3) Have a fixed business location, a complete safety management system and a sound business plan;

(4) The main person in charge of the enterprise, the production safety management personnel and the operation, Maintenance and emergency repair personnel must be professionally trained and pass the assessment;

(5) Other conditions stipulated by laws and regulations.

If the conditions specified in the preceding paragraph are met, the gas management department of the local people's government at or above the county level shall issue a gas operation license.
